Motion Sequence No.35 Uponconsidering the Affirmation of Shaun E. Werbelow, dated August 12, 2021 (“Werbelow Affirmation”), andall prior papers and proceedingsherein,it is hereby ORDEREDthat Plaintiffs show cause before this Court, located at 60 Centre Street, New York, New York, 10007, on August 27, 2021, at 9:30 a.m., why an order should notbe entered, pursuant to 22 NYCRR 216.1 and 202.5-b(d)(3)(iii) , granting the followingrelief: 1. directing that the document at Dkt. 659 besealed; 2. directing that Defendantsfile a redacted version of the document at Dkt. 659, attached to the Werbelow Affirmation as Exhibit A; 3. directing that the sealed version of the documentat Dkt. 659 shall remain under seal and shall not be madeavailable to anyone other than the parties, their respective counsel, andall parties authorized to view Confidential Information underthe Stipulation and Order for the Production and Exchange of Confidential Information(the “Protective Order”) (Dkt. No. 69), including authorized Court Personnel; ORDEREDthatresponsive papers,if any, shall be served electronically and via electronic mail and NYSCEFonor before August 24, 2021; andit is further ORDEREDthat, pending the determination of Defendants’ Motionto Seal, the Clerk of the Court shall temporary place the documentfiled at Dkt. 659 in “restricted” status on the NYSCEFsite, to be made available for viewing by court staff and the parties but not the general public as provided in Uniform Rule § 202.5-b(d)(3)(iii); andit is further ORDEREDthatservice via email of a copy ofthis Order to Show Cause, together with copies of the papers in support thereof, on counsel for the parties to the above-captioned litigation on or before August 7; 2021, shall be deemed good andsufficient service thereof.
Unless otherwise instructed by the Court, the motion will be decided on submission and no appearanceis necessary on August 27,
