`
`IN THE NAME AND BY AUTHORITY OF THE STATE OF TEXAS:
`
`Before me, the undersigned Assistant District Attorney of Harris County, Texas, this day appeared the undersigned affiant, who under oath says
`that he has good reason to believe and does believe that in Harris County, Texas, WAYNE JOSEPH BRIGHT, hereafter styled the
`Defendant, heretofore on or about August 27, 2019, did then and there unlawfully, with intent to commit thefi, enter a building not then open
`to the public, owned by Carlos CarrizalezOvalle, a person having a greater right to possession of the building than the Defendant and
`hereafier styled the Complainant, without the effective consent of the Complainant, namely, without any consent of any kind.
`
`Before the commission of the offense alleged above, (hereafter styled the primary offense), on April 19, 2013, in Cause Number 1384542,
`in the 184th District Court of Harris County, Texas, the Defendant was convicted of the felony of Felon in Possession of a Weapon.
`
`Before the commission of the primary offense, and after the conviction in Cause Number 1384542 was final, the Defendant committed the
`felony of Felon in Possession of a Weapon and was finally convicted ofthat offense on July 28, 2014, in Cause Number 1435878, in the
`180th District Court of Harris County, Texas.
`
`Probable Cause
`
`Affiant, T.P. Wilson, a credible and reliable person, employed as a peace officer with the Houston Police Department, has reason to believe
`and does believe that Wayne Joseph Bright, hereafter the defendant, committed the offense of burglary located at Great Value Public
`Storage, 11702 Beechnut Street, Houston, Harris County Texas, on or about August 27, 2019. Affiant bases his belief upon the following
`facts:
`
`On August 27, 2019, storage units #6011, 6013, and 6015, were burglarized at the Great Value Storage Facility, 11702 Beechnut Street,
`Houston, Texas 77072. The incident was captured on surveillance footage. The footage depicted Defendant Wayne Joseph Bright allowing a
`box truck to access the facility on at 0351 hours, and letting the same truck exit the facility at 0524 hours. Surveillance footage of the actual
`burglary ofthe storage units was not captured. Sergeant T. P. Wilson traveled to the offense location on September 4, 2019, and met with
`Defendant Bright DOB 05/16/1969 SPN02674187, who admitted opening the gate during on an audio recorded conversation with Sergeant
`Wilson. Defendant Bright stated that an Asian male he knew as "Mike" burglarized the storage units, that "Mike" had called him to let him
`into the storage facility, and that "Mike" moved property into his own units at the location. Defendant Bright admitted that it was obvious
`"Mike" was breaking into units at the location, but claimed not to have seen him actually do it. Defendant Bright stated that he moved some
`items from "Adam's" truck into Adam’s storage unit. Defendant Bright admitted that “Mike” had paid him twenty dollars to open the
`storage facility security gate.

`
`Sergeant T. Wilson obtained storage facility scan logs, which also depict Defendant Bright opening the security gate during the time frame
`in which the burglary occurred. Sergeant T. Wilson obtained rental agreements for units #5067, and #5046. Upon reviewing the rental
`agreements Sergeant Wilson found that the units had been rented to Co-defendant Giau Ngoc Thai. Sergeant T. Wilson was able to identify
`Co-defendant Thai from her personal data included on the lease agreement, and ran her through a pawn inquiry. Upon running Co-defendant
`Thai Sergeant T. Wilson found that she had pawned a stolen Stihl edger bearing serial #186677948, and a Redmax 75 cc leaf blower at
`EZPawn #10239, 12303 Bellaire Blvd. Houston TX, 77072, on August 31, 2019, at approximately 1052 hours. The edger had the exact
`serial number as that stolen from Complainant, Carlos Carrizalez-Ovalle, out of storage unit #6011 during the burglary, and the leaf back
`pack blower matched the description ofthe one provided by Complainant Carrizalez-Ovalle. The edger was valued at $559.00, and the
`backpack leaf blower was worth $560.00. The total value for both items were $1119.00
`
`On September 5, 2019, at approximately 0930 hours Sergeant T. Wilson traveled to the EZPawn, and recovered Complainant Carrizlez-
`Ovalle's stolen property. On September 6, 2019, at approximately 0930 hours Sergeant T. Wilson traveled to the EZPawn, and obtained still
`images of Co-defendant Thai, and"Co-defendant Anh Duy Dao ("Adam") pawning the aforementioned stolen property. At the time the
`images were obtained Co-defendant Dao was not identified. On September 12, 2019, at 1150 hours, Sergeant T. Wilson called Co-
`defcndant, Thai in an attempt to get a statement regarding her' role in the offense. Co-defendant Thai answered, and advised Sergeant T.
`Wilson that she was currently posting her bond in an unrelated case. Sergeant T. Wilson scheduled a meeting with Co-defendant Thai
`regarding this case, but Co-defendant Thai missed the appointment, and has since been unavailable to Sergeant Wilson. On September 13,
`2019, at approximately 1300 hours Sergeant T. Wilson researched Co—defendant Thai's unrelated charge. Sergeant T. Wilson learned that
`Defendant Thai was arrested with Co-defendant Dao on September 10, 2019. Sergeant T. Wilson compared Co-defendant, Dao's mugshot
`photo to the images he obtained from the EZPawn, and was able to identify the Co-defendant Doa, in possession of, and pawning
`Complainant Carrizalez-Ovalle's stolen property. Complainant Carrizalez-Ovalle (Tenant of storage unit #6011), and Complainant Octavio
`Corona Lopez (Tenant of storage unit #6015) wish to pursue charges. Assistant District Attorney Alfred accepted burglary charges on
`Defendant Bright as a party to the offense.
