Pursuant to the July 2019 update to the AIA Trial Practice Guide, Petitioner submits this notice of its ranking and explanation of the material difference between its petitions for inter partes review of U.S. Patent No. 8,156,528 (hereinafter “the ’528 Patent”) filed in IPR2020-00809, IPR2020-00810, and IPR2020-00811.
The primary reference in Petition 2, Boyle, discloses “a digital video recorder connectable to a set-top box configured to receive electronic program guide information.” Ex. 1106 at 2:17-20.
The Boyle and Kubischta references therefore make it possible that there will be “a dispute about priority date requiring arguments under multiple prior art references.” See “TRIAL PRACTICE GUIDE UPDATE (July 2019)” at 26.
Additionally, instituting Petition 3 is justified in order to allow Petitioner to present the references that shows the state of the art at the time closest to the alleged invention.
