Rodriguez’s negligent, careless, and reckless ownership, leasing, operation, control, and/or maintenance of the Van was a breach of Rodriguez’s duty of care owed to the plaintiff.
As a result of the foregoing, the plaintiff has been damaged in an amount that exceeds the jurisdictional limits of all lower courts to be determined by a jury at the time of trial.
U-Haul is vicariously liable to the plaintiff for the aforementioned collision, personal injuries and property damage she sustained as a result of Rodriguez’s negligent, careless, and/or reckless operation of the Van in furtherance of his employment, agency, representation, and/or servitude with U-Haul.
On and before December 22, 2023, U-Haul supervised and directed Rodriguez in a manner that caused her performance of her duties and responsibilities to be dangerous, hazardous and unreasonably unsafe to the public, including without limitation to the plaintiff.
U-Haul’s negligent, careless, and reckless rental of its defective, unsafe, and unreasonably dangerous Van to Rodriguez was a breach of U-Haul’s duty of care to the plaintiff.
