Set forth by Section every statute, regulations, ordinance, rule, order and requirement of the Federal, State, County, Village, Town or City government of any and all of their departments, divisions and bureau it is alleged was violated by Defendant.
Serve upon and deliver to the attorney for Defendant(s), copies of all graphic, numerical, symbolic, digital, film, video, computer generated, computer enhanced or otherwise produced electronically and/or digitally, photographic or pictorial representations regarding any procedures, treatments, admissions, office visits, injuries, scene of the accident or the vehicles or instrumentalities involved, disabilities, medical or diagnostic procedures or tests, performed by or on behalf of the Plaintiff(s) herein or by any facility regarding the claims of the Plaintiff(s) herein.
Any person who knowingly and willfully obtains workers' compensation records which contain individually identifiable information under false pretenses or otherwise violates this section shall be guilty of a class A misdemeanor and shall be subject upon conviction, to a fine of not more than one thousand dollars.
In connection with any such proposed application, the attorney general is authorized to take proof and make a determination of the relevant facts and to issue subpoenas in accordance with the civil practice law and rules.

That on 10/20/2023 deponent delivered to and left at the office of the Secretary of State of New York a true copy of the Summons and Verified Complaint bearing Index Number and Date of Filing, Notice of Electronic Filing together with the Statutory Fee of Ten ($10.00) dollars which commencecf the action against June M. Pompei a/the Defendant in the above named action, whose place of residence is not within the State of New York.
Following the service upon the Secretary of State, deponent on 10/20/2023 mailed a copy of Summons and Verified Complaint bearing Index Number and Date of Filing, Notice of Electronic Filing to the defendant whose place of residence is outside the state of New York.
That annexed hereto is a Proof of Mailing Certificate, presented and hand canceled by the United States Post Office as evidence thereof.

AFFIDAVIT

Deponent was unable with due diligence to find defendant/respondent/recipient or a person of suitable age and discretion thereat having attempted service at said address on the following dates and times; 10/14/2023 11:05 AM, 10/16/20231:15PM, 10/17/2023 11:50 AM
On 10/18/2023, after delivery of process was effected, deponent enclosed an additional true and attested copy of same in postpaid envelope addressed to the defendant/respondent/recipient at defendant/respondent/recipient last known place of residence in an official depository and by First Class Mail, under the exclusive care of the United States Postal Service within New York State.
The envelope bore the Legend "Personal & Confidential" and did not indicate on the outside thereof, by return address or otherwise, that the communication was from an attorney or concerned an action against the defendant/respondent/recipient.
I certify that the foregoing statements made by me are true, correct and my free act and deed.
I am aware that if any of the foregoing statements made by me are willfully false, I am subject to punishment.
