Dear Judge Liman: Town & Country Linen Corp., et al. v. Ingenious Designs LLC, et al., Civil Action No. 18-cv-5075-LJL – Consent Letter-Motion to Stay Dates and Deadlines This firm represents Defendants Ingenious Designs LLC, Joy Mangano, and HSN, Inc. in the above-referenced action.
We submit this letter-motion to inform the Court that all parties have reached a settlement in principle to completely resolve the action.
To allow the parties time to finalize their settlement in principle, we respectfully request under Civil Individual Rules 1(B)– (D) that all pretrial and trial dates and deadlines be stayed as follows:

Motion for Reconsideration
Plaintiffs respectfully submit that the Opinion misunderstood the damages theory presented at oral argument and erroneously reads the phrase “or other equitable relief” out of Paragraph 7 of the MNDA.
Specifically, Plaintiffs argued that Paragraph 7 of the MNDA provides for Defendants’ apportioned profits as an available equitable remedy and that such calculation would be a proxy for the value of the injunctive relief that was impossible to obtain in this case because “the cat was out of the bag.” Reconsideration is appropriate to correct clear error and prevent manifest injustice.
“Reconsideration is appropriate when the [moving party] identifies an intervening change of controlling law, the availability of new evidence, or the need to correct a clear error or prevent manifest injustice.” Tchatat v. City of New York, No. 14-cv-2385, 2015 WL 6159320, at *1 (S.D.N.Y. Oct. 20, 2015) (internal quotation marks omitted).
Defendants invested heavily in their luggage and CloseDrier with FF products and would have massive inventory sitting in a warehouse waiting to be sold, with potential reorder quantities in manufacture.
Page 25 of the Opinion provides: Finally, at oral argument, Plaintiffs proffered an alternate theory as to why they are entitled to damages in the form of a reasonable royalty or lost profits on a future transaction.

Both Plaintiffs and Defendants believe that there are numerous and significant issues with respect to the other side’s expert witnesses’ reports and testimony which would benefit from a separate Daubert briefing schedule.
Thus, the summary judgment and Daubert motion proceedings may allow the Court to progressively narrow the issues in dispute, which could lead to a more efficient trial phase.
Finally, the Parties anticipate that there will be a significant amount of confidential material in the summary judgment and Daubert submissions that will need to be sealed for demonstrable 1 The Statement of Material Facts under Local Civil Rule 56.1 and any accompanying declarations and exhibits shall not count toward the page limit.
