Petitioner explains that Picard and Ishihara both teach apparatuses that determine surface topology of an object using a source, a beam splitter, and focusing optics arranged in similar manners to produce light at different focal planes.
a. The Dispute Regarding Whether Picard Teaches “A Module Positioned in the Optical Path and Configured to Generate a Plurality of Incident Light Beams.” Petitioner asserts that Picard’s Nipkow disk 8 and affixed mask 24 each correspond to the “module” recited in claim 17.
Patent Owner argues that (1) Picard and Ishihara “operate in fundamentally different ways” (id. at 36–37) and (2) Petitioner’s “assemblage of discrete elements without addressing why a [person of ordinary skill in the art] would have combined them in the manner proposed has all the hallmarks of impermissible hindsight” (id. at 37–38).
We find that Petitioner’s evidence and arguments show sufficiently, for this stage of the proceeding, that a person of ordinary skill in the art would have been motivated to combine the teachings of Picard and Ishihara with a reasonable expectation of success, notwithstanding Patent Owner’s allegations of fundamental differences between the references.
Patent Owner’s arguments assume, without demonstrating persuasively, that (1) modifying Picard to use telecentric optics like Ishihara’s would involve changing Picard’s system to use a shifting focal plane like Ishihara’s, and (2) that this would defeat a reasonable expectation of success.
