Admitted that the real property located at 15330 NW 29th Court, Miami, Florida 33054 (the “Property”), should be partitioned pursuant to §64, Fla. Stat., denied that sales proceeds from the sale, after payment of costs, expenses, and taxes (if any), be divided pro rata between the Petitioner and the Respondent.
This Honorable Court Order an accounting to be made between Petitioner, Respondent, and Third Party;
Third Party holds a one-third (1/3) fee simple ownership interest in the Property as described in Counts II and III of Respondent’s Counterpetition for Dissolution of Marriage filed on June 18, 2024.
Under Florida law, a co-tenant who pays necessary expenses associated with jointly owned property—such as mortgage payments, taxes, insurance, or maintenance—is entitled to contribution or credit for the non-paying co-tenant’s proportionate share of those expenditures upon partition or sale of the property.
Third party is obligated to pay the undersigned counsel reasonable attorneys’ fees for services rendered in this action, and pursuant to § 64.081, Fla. Stat. each party is bound to pay a share of the costs, including attorney’s fees commensurate with the services rendered and of benefit to the partition.

COMES NOW, the Third Party, JEFRY J. SANTOS CLAROS (“Third Party”), by and through the undersigned counsel, and pursuant to Florida Rule of Civil Procedure 1.070(j), moves this Court to dismiss the Counter Petition for insufficient service of process on the grounds that the Respondent failed to serve the Third Party within the required 120-day period after filing the Counter Petition.
Under Florida Rule of Civil Procedure 1.070(j), the Respondent was required to serve the Third Party within 120 days from the date of filing, which would have been no later than October 16, 2024.
Due to the untimely service, the Respondent has failed to properly commence this action within the time allowed by law, and therefore, dismissal is warranted.
Because service was untimely and Respondent has failed to show good cause for the delay, the Complaint should be dismissed without prejudice pursuant to Rule 1.070(j).
WHEREFORE, Third Party, JEFRY J. SANTOS CLAROS, respectfully requests that this Honorable Court: A. Grant this Motion to Dismiss and dismiss the Respondent’s Counter Petition for Partition and Joinder-Indispensable Party for insufficient service of process pursuant to Florida Rule of Civil Procedure 1.070(j); B.
