`1. This application is not granted a patent because applicant

`used transceiver node as a distinguishing factor or
`
`apparatus, however, in the relevant art there is no such thing
`
`as transceiver node that is different from a node with
`
`transceiver or with the replacement of transceiver,
`
`transmitter and receiver, a transceiver is part and parcel of a
`
`communication node and combines a transmitter and a
`
`receiver processors within a communication node and in
`
`some communication nodes transceiver is known as
`
`transmitting and receiving processors or simply transmitter
`
`and receiver. During the examination transceiver node is
`
`taken to mean a transceiver that combines transmitter and
`
`receiver processors, and since the parent application also
`
`claim transceiver node in claim 1, the phrase transceiver
`
`node is not unique for the instant application.

`2. The nonstatutory double patenting rejection is based on a
`
`judicially created doctrine grounded in public policy (a policy
`
`reflected in the statute) so as to prevent the unjustified or
`
`improper timewise extension of the “right to exclude” granted
`
`by a patent and to prevent possible harassment by multiple
`
`assignees. A nonstatutory double patenting rejection is
`
`appropriate where the conflicting claims are not identical, but
`
`at least one examined application claim is not patentably
`
`distinct from the reference claim(s) because the examined

`application claim is either anticipated by, or would have been
