`

`
`
`Appeal from the United States Patent and Trademark Office,
`Patent Trial and Appeal Board in No. IPR2018-01028.
`
`
`
`JOINT MOTION TO DISMISS APPEAL 20-1352 AND
`WITHDRAW LG ELECTRONICS INC. AS PARTY
`
`
`
`
`
`
`
`

`

`Case: 20-1306 Document: 71 Page: 3 Filed: 11/02/2020
`
`Appellant Uniloc 2017 LLC (“Uniloc”) and Cross-Appellant LG Electronics
`
`Inc. (“LGE”) jointly move under Federal Circuit Rule 27 and Federal Rules of
`
`Appellate Procedure 27 and 42(b) to: (1) dismiss LGE’s cross-appeal in 20-1352,
`
`and (2) withdraw LGE from the remaining consolidated appeals to which it is a
`
`party, including 20-1306 and 20-1317.
`
`No party opposes this motion. Counsel for Uniloc has conferred with counsel
`
`for Cross-Appellant Apple Inc., Appellees HTC Corp. and HTC America, Inc., and
`
`Intervenor. Each has indicated that they do not oppose and will not file a response.
`
`Dismissal of LGE’s cross-appeal and withdrawal of LGE from these
`
`consolidated appeals is appropriate because Uniloc and LGE have reached a
`
`settlement agreement resolving disputes between them, and LGE has agreed not
`
`to participate in these appeals. Uniloc and LGE agree that each shall bear its own
`
`costs and fees in the present appeals.
`
`In light of the foregoing, Appeal No. 20-1352 should be dismissed, LGE
`
`should be removed as a party to the remaining appeals, and the case should be re-
`
`captioned accordingly.
