`MOTION TO ADJUDICATE GUILT
`
`COMES NOW, THE STATE OF TEXAS, by and through the undersigned Assistant District Attorney and shows
`the Court heretofore on 6th day of September, 2018, the Defendant herein entered a plea of Guilty for the
`State Jail Felony offense of UNAUTHORIZED USE OF VEHICLE, and the Court after hearing the evidence
`introduced thereon and finding that it substantiates the Defendant’s guilt, deferred entering an adjudication of
`guilt and placed the Defendant under the terms and conditions of Community Supervision for a period of g
`Years in accordance with Section 5 of Article 42.12 of the Texas Code of Criminal Procedure.
`
`Further, the State would show that the Court ordered the Defendant herein to abide by certain conditions of
`Community Supervision during the term of Community Supervision and among the conditions of Community
`Supervision ordered by the Court were the following conditions of Community Supervision.

`The State would further show the said Defendant did then and there violate terms and conditions of
`Community Supervision by: Committing an offense against the State of Texas, to-wit; on or about April
`22, 2019, in Harris County, State of Texas, Juan Johnson, hereafter styled the Defendant, did then and

`unlawfully
`commit
`the
`criminal
`offense
`of AGG ROBBERY — DEADLY WEAPON.
`
`The State would further show the said Defendant did then and there violate terms and conditions of
`Community Supervision by: Failing to report to the Community Supervision Officer, to-wit; the Defendant
`failed to report as directed for the months of November 2018, December 2018, February 2019, and
`March 2019.
`
`11. The State would further show the said Defendant did then and there violate terms and conditions of
`
`Community Supervision by: Failing to submit to an assessment through HCCSCD Assessment Unit as
`directed on the following dates: October 24, 2018.
`
`14. The State would further show the said Defendant did then and there violate terms and conditions of
`
`Community Supervision by: Possessing, shipping, transporting, receiving, and purchasing a
`firearm/ammunition on April 24, 2019.
`
`15.1 The State would further show the said Defendant did then and there violate terms and conditions of
`
`Community Supervision by: Failing to pay supervision fee as directed by the Court and is $300.00 in
`arrears as of 04/24/19.
`
`15.2 The State would further show the said Defendant did then and there violate terms and conditions of
`
`Community Supervision by: Failing to pay Client Identification Card fee as directed by the Court and is
`$12.50 in arrears as of 04/24/19.
`
`15.3 The State would further show the said Defendant did then and there violate terms and conditions of
`
`Community Supervision by: Failing to pay Assessment fee as directed by the Court and is $100.00 in
`arrears as of 04/24/19.
`
`15.4 The State would further show the said Defendant did then and there violate terms and conditions of
`Community Supervision by: Failing to pay Court Costs as directed by the Court and is $210.00 in arrears

`The State would further show the said Defendant did then and there violate terms and conditions of
`Community Supervision by: Failing to pay Crime Stoppers of Houston fee as directed by the Court and is
`$50.00 in arrears as of 04/24/19.

`The State would further show the said Defendant did then and there violate terms and conditions of
`Community Supervision by: Failing to pay restitution as directed by the Court and is $700.00 in arrears
`as of 04/24/19. The defendant has never made a payment.
`
`The State would further show the said Defendant did then and there violate terms and conditions of
`
`Community Supervision by: Failing to pay a drug testing fee as directed by the Court and is $50.00 in
`arrears as of 04/24/19.

`WHEREFORE, THE STATE PRAYS that Alias Capias issue and upon arrest that a hearing be given the
`Defendant and that on the final hearing an adjudication of guilt be entered.
