`JOINT NOTICE REGARDING DKT. 61, WILLOW’S MOTION TO DISMISS ELVIE’S
`COUNTERCLAIM FOR TRADE DRESS INFRINGEMENT (COUNT 21)

`Plaintiff Willow Innovations, Inc. (“Willow”) and Defendant Chiaro Technology Ltd.
`
`(“Elvie”) submit this Joint Notice Regarding Dkt. 61 to inform the Court that Willow’s Motion to
`
`Dismiss is not moot in view of Elvie’s Answer, Defenses, and Counterclaims to Willow’s Second
`
`Amended Complaint (Dkt. 68).
`
`Elvie served an amended Answer on April 15, 2024, adding a counterclaim for trade dress
`
`infringement. Dkt. 60, Count 21. On April 30, Willow filed a Motion to Dismiss Elvie’s
`
`counterclaim for trade dress infringement. Dkt. 61. Elvie filed a response on May 14 (Dkt. 62),
`
`and Willow filed a reply on May 21 (Dkt. 63). Willow’s Motion to Dismiss is now fully briefed.
`
`On June 21, Willow filed a Second Amended Complaint adding claims for False
`
`Advertising and Unfair Competition. Dkt. 64 ¶¶ 177-204. Elvie filed its Answer, Defenses, and
`
`Counterclaims on July 8 only to address the newly added claims for False Advertising and Unfair
`
`Competition. Dkt. 68. Accordingly, Elvie’s counterclaim for trade dress infringement (Count 21)
`
`restated the same allegations from its prior Answer (Dkt. 60). See id. ¶¶ 49-70, 195-199.
`
`Therefore, Willow’s Motion to Dismiss (Dkt. 61) and Elvie’s response (Dkt. 62) are not mooted
`
`
`

`by Elvie’s Answer and Counterclaims to Willow’s Second Amended Complaint, and Willow’s

`Motion to Dismiss remains ripe for resolution by the Court.
