`On March 13, 2023, the Board issued notice of default in this opposition

`of opposition by the deadline set in the institution order. On June 7, 2023, the parties

`filed a joint motion to set aside the notice of default and on July 7, 2023,1 Applicant
`
`filed a proposed amendment to application Serial No. 97130909, with Opposer’s
`
`consent, and Opposer’s withdrawal without prejudice of the opposition, contingent
`
`upon entry of the amendment.2

`By the proposed amendment, Applicant seeks to amend the identification of goods
`
`in International Class 5 as follows (strike through wording proposed to be deleted):

`dismissed without prejudice.3
