`Pursuant to 35 U.S.C. § 327(b) and 37 C.F.R. § 42.74(c), Petitioners Miltenyi
`
`Biomedicine GmbH and Miltenyi Biotec Inc. and Patent Owner The Trustees of the
`
`University of Pennsylvania (collectively, “Parties”) jointly move for authorization
`
`to file their Settlement and License Agreement (“Agreement”) and its respective
`
`exhibit, Confidential Exhibit 2083—as referenced in the concurrently filed Joint
`
`Motion to Terminate Proceeding, Paper No. 28—as business confidential
`
`information, which shall be kept separate from the file of the involved patent, and
`
`made available only to Federal Government agencies on written request, or to any
`
`person on a showing of good cause. The terms of the Agreement (submitted as
`
`Confidential Exhibit 2083) require the Parties to treat the Agreement as confidential
`
`information and prohibits disclosure to third parties, and the terms of the Agreement
`
`reflect sensitive and proprietary information of both Parties. In view of the terms of
`
`the Agreement, and the Parties’ joint request to file it confidentially, the Settlement
`
`and License Agreement has been filed for access by the “Board and Parties Only.”
`
`The Parties further request that should such a petition be filed, the Parties be given
`
`the opportunity to comment on the request before a decision is made with respect to
`
`whether it should be granted or denied.
`
`CONCLUSION
`
`For the foregoing reasons, the Parties respectfully request that the Board treat
`
`the Agreement as business confidential information and make it available only
`
