`Defendant LG Display Co., Ltd. (“LG Display”) provides the following Initial Disclosures

`pursuant to the Order Governing Proceedings (Docket No. 50), and in satisfaction of Federal Rule of

`Civil Procedure 26(a)(1). LG Display makes these disclosures based on the information that is
`
`presently available. LG Display reserves the right to supplement or amend these disclosures

`based on further investigation and discovery conducted in this case, the Court’s claim

`construction, and any other reasons impacting the accuracy and completeness of these disclosures.

`cited references, and the state of the art. Contact information for those individuals may be listed
`
`on the respective reference identifying those individuals.

`LG Display reserves the right to supplement or update the above list in view of subsequent
`
`investigation, new or amended pleadings, further discovery, further clarification of Plaintiff’s
`
`claims, or otherwise.

`II.
`
`RULE 26(A)(1)(A)(II): DESCRIPTION OF DOCUMENTS

`Based on information presently available, LG Display provides the following description

`accused products do not practice any claim of the patents-in-suit;

` The patents-in-suit and their prosecution histories;

` Documents related to the ownership and licensing of the patents-in-suit and related
`
`technology;
`
` Plaintiff’s documents concerning its decision to sue and any purported basis
`
`therefore;
`
` Plaintiff’s documents relating to its claim for damages;
`
` Plaintiff’s documents relating to its or others’ licensing of patents, know-how, and
`
`other intellectual property comparable to the patents-in-suit;
`
` Documents related to the sale, offer for sale, or other public disclosure of the subject
`
`matter of the patents-in-suit; and
`
` Prior art and other documents sufficient to establish that each asserted claim of the

`The foregoing documents are located at the offices of LG Display, at the offices of Latham
`
`& Watkins LLP, 505 Montgomery Street, Suite 2000, San Francisco, CA 94111; or are anticipated
`
`to be in the possession of Plaintiff or third parties. LG Display’s search for documents that it may
`
`use to support its claims or defenses is continuing. LG Display reserves the right to supplement
`
`this disclosure under Fed. R. Civ. P. 26(e).
`
`LG Display’s disclosure of these categories of documents is not an admission that any such
`
`documents are in fact relevant to any claim or defense in this action.
`
`LG Display reserves the right to supplement this list of documents in view of subsequent
`
`investigation, new or amended pleadings, further discovery, further clarification of Plaintiff’s
`
`claims, or otherwise.
`
`III. RULE 26(A)(1)(A)(III): COMPUTATION OF DAMAGES
`
`No damages are properly due or owing to Solas for any alleged patent infringement by LG
`
`Display. At this time, LG Display has incurred and continues to incur attorneys’ fees and expenses
`
`on a monthly basis in defense against this meritless litigation. Upon prevailing in this litigation,
`
`LG Display will seek its attorneys’ fees, costs, and expenses.
`
`LG Display also reserves its right to supplement this disclosure and to provide additional
`
`information regarding damages at a later time after taking discovery of Plaintiff.
`
`IV. RULE 26(A)(1)(A)(IV): INSURANCE AGREEMENTS
`
`LG Display is not presently aware of any insurance agreements described in Fed. R. Civ.
`
`P. 26(a)(1)(A)(iv).
