`USENIX began organizing and sponsoring the USENIX Annual

`Technical Conference (the “Conference”) in 1995, and continues to organize and

`sponsor the Conference. The Conference is an annual public event hosted by
`
`USENIX for practitioners, developers and researchers to meet, engage in
`
`computing tutorials, and present their research work in areas around the topic of
`
`computing systems. The annual conference provides a forum for the presentation
`
`and discussion of recent research in computing systems and related technologies.
`

`As part of the production team, I worked on the USENIX website,
`
`particularly for the 2008 Conference, and on the printed proceedings, particularly
`
`for the 2008 Conference.

`2. Call for Papers for the Conference

`Since 1995, as a matter of general practice, USENIX information, call
`
`for papers, and announcements have been posted on the public USENIX website,
`
`i.e., www.usenix.org. The USENIX website could be viewed by practitioners,
`
`developers, researchers, and any other interested member of the general public.
`

`Before the 2008 USENIX Annual Technical Conference (the “2008
`
`Conference”), the USENIX website posted a call for submission of papers
`
`regarding any topic in and related to the area of computing systems. The call for
`
`papers resulted in 176 paper submissions from practitioners, developers, and
`
`researchers from all over the world, months before the 2008 Conference. The
`
`submitted papers were reviewed, and 34 papers were accepted for publication and
`
`presentation at the 2008 Conference.
`

`Attached as Appendix A is a true and accurate USENIX website
`
`snapshot from the WaybackMachine that evidences that at least as of July 16,

`Since 1995, as a matter of general practice, Conferences have been
`
`advertised publicly on the USENIX website, i.e., www.usenix.org, which are a part
`
`of my job duties. In addition to the public advertising for the 2008 Conference on
`
`the USENIX website, advertising emails were circulated to users inviting them to
`
`submit to and attend the 2008 Conference. Anyone who wanted to attend,
`
`including any interested member of the general public, could register and pay the
`
`registration fee. The registration fee ranged from $275 before June 6, 2008 for one
`
`day of technical sessions to $1,985 after June 6, 2008 for three days of training.
`

`11. As a matter of general practice, before each Conference, the selected
`
`papers were bound in a book of papers, which was a part of my job duties. The
`
`2008 Conference was no different, and in accordance with this general practice, the
`
`2008 Conference selected papers were bound in a book, which I will refer to as the
`
`2008 Conference Proceedings Book.
`
`12. During the 2008 Conference, and in accordance with general practice,
`
`each attendee was provided a physical copy of the 2008 Conference Proceedings
`
`Book. Although the 2008 Conference Proceedings Book was copyrighted, the
`
`papers were not subject to any confidentiality restriction and the 2008 Conference
`
`Proceedings Book could be freely shared by attendees with other interested persons
`
`of skill that had not attended the meetings.
`
`13. CSCO-1009 is a true and correct copy of selected pages from the
`
`2008 Conference Proceedings Book that were given to attendees of the 2008
`

`Conference. CSCO-1009 includes the paper by Nitin Agrawal, Vijayan
`
`Prabhakaran, Ted Wobber, John D. Davis, Mark Manasse, and Rina Panigrahy,
`
`entitled “Design Tradeoffs for SSD Performance,” (the “Agrawal Paper”).  I
`
`understand that CSCO-1009 will be submitted with a Petition for inter partes
`
`review in the above noted proceeding.

`14. Attached as Appendix D is a true and accurate USENIX website

`issue of Login contained the 2008 USENIX Annual Technical Conference Report

`(Appendix E). Subscribers to Login would have received the October 2008,

`summary of the presentation of the Agrawal Paper, indicating that the Agrawal
`
`Paper was indeed presented at the 2008 Conference.

`5. Public Distribution of Papers After 2008 Conference

`In accordance with the general practice, prior to the 2008 Conference ,
`
`a 2008 Conference program was created that included details pertaining as to when
`
`each paper was presented. I then posted the 2008 Conference program on the
`
`USENIX website.
`

`Furthermore, in accordance with general practice, the papers that were
`
`going to be presented were uploaded to the USENIX website prior to the beginning
`
`of the 2008 Conference, where they were available to the registered attendees only.
`
`The presented papers (which were included in the 2008 Conference Proceedings
`
`Book) were uploaded to the USENIX website. The presented papers were publicly
`
`available on the first day of the technical program, June 25, 2008. It was also
`
`general practice to make the papers freely available on the USENIX website to the
`
`interested general public without a password or payment of a fee after the
`
`conference concluded.

`Therefore, the Agrawal Paper was publicly available as of June 25,
`
`2008. Further, the Agrawal Paper was also made publicly available on the
`
`USENIX website after the conference had concluded.

`II. CSCO-1007 Muthitacharoen
`
`6. Fifth Symposium on Operating Systems Design and Implementation
`
`(OSDI ‘02)
`
`20. USENIX began organizing and sponsoring the Symposium on
`
`Operating Systems Design and Implementation (the “Symposium”) in 1994, and
`
`continues to organize and sponsor the Symposium. The Symposium is a bi-annual
`
`public event hosted by USENIX for practitioners, developers and researchers to
`
`meet, engage in computing tutorials, and present their research work in areas
`
`around the topics of design, implementation, and implications of operating systems
`
`software. The Symposium provides a forum for the presentation and discussion,
`
`by collaborators from industry and academia, to present highly original ideas, new
`
`approaches, and groundbreaking results in current operating systems software
`
`research and practice. Attendees include research scientists, software engineers,
`
`architects, directors, engineers, students, and professors.
`
`7. Call for Papers for OSDI ‘02
`

`Since 1994, as a matter of general practice, USENIX information, call

`22. Before the Fifth Symposium on Operating Systems Design and

`Implementation (“OSDI ‘02”), the USENIX website posted a call for submission

`of papers regarding any topic in and related to the area of computing systems. The

`call for papers resulted in well over 150 paper submissions from practitioners,
`
`developers, and researchers from all over the world, months before OSDI ‘02. The
`
`submitted papers were reviewed, and 27 papers were accepted for publication and
`
`presentation at OSDI ‘02.
