`Pursuant to 37 C.F.R. § 1.26, Petitioner respectfully requests a refund of the
`

`post-institution fees paid with its petition for inter partes review.
`
`On September 24, 2016, Petitioner filed a petition for inter partes review of
`
`claims 1–3, 5–9, 12–14,17–21, and 24–26 of U.S. Patent No. RE39,470. See Paper
`
`2. Accompanying the petition was a payment of $24,600, which was calculated
`
`based on a $9,000 request fee (for up to 20 claims), a $14,000 post-institution fee
`
`(for up to 15 claims), and a $1,600 excess post-institution claims fee (based on four
`
`excess claims). The Board denied institution on all 19 claims on April 4, 2017.
`

`
`Accordingly, Petitioner respectfully requests a refund of $15,600 for the
`
`post-institution fee and the excess post-institution claims fee based on four
`
`additional claims, to be applied to Deposit Account Number 50-0369.
