`This action came for consideration before the court and a jury with District Judge
`James D. Peterson presiding. The issues have been tried and the jury has rendered its verdict.
`
`IT IS ORDERED AND ADJUDGED that judgment is entered in favor of plaintiff
`Oxbo International Corporation against defendant H&S Manufacturing Company, Inc., as
`follows:
`
`1.
`
`dismissing counts IX and X of defendant's amended counterclaims;
`
`2.
`

`
`granting summary judgment in favor of plaintiff on its claims that defendant's
`Tri-Flex Merger infringes claim 44 of U.S. Patent No. 7,310,929; claim 1 of U.S.
`Patent No. 8,166,739; claims 1-10 of U.S. Patent No. 8,863,488; and claims 1-4
`and 6-8 of U.S. Patent No. 8,511,052;
`
`declaring that the asserted claims of the '052 patent are not anticipated or
`obvious on any ground asserted by defendant;
`
`declaring that the asserted claims of the patents-in-suit are not invalid for
`indefiniteness, lack of enablement, or lack of written description under 35
`U.S.C. § 112;
`
`5.
`
`dismissing defendant's equitable defenses;
`
`6.
`
`consistent with the jury's verdict, granting judgment in favor of plaintiff on its
`claim that defendant infringed claim 28 of the '929 patent; finding that plaintiff
`and its licensee marked substantially all products covered by the triple head
`patents during the term of the Kuhn North America, Inc., cross-license; awarding
`a reasonable royalty in the amount of $850,000 for defendant's use of the '929,
`

`'739, '488, and '052 patents; and finding that none of the following claims are
`invalid because they were obvious:
`
`a. claim 44 of the '929 patent;
`b. claim 1 of the '739 patent; or
`c. claims 1, 2, 4, 6, 8 or 10 of the '488 patent; and
`
`7.
`
`entering the following permanent injunction in favor of plaintiff:
`
`H&S, its officers, agents, servants, employees, and attorneys, and those
`persons in active concert or participation with them, including H&S's dealers
`and distributors, who receive actual notice of this injunction, are hereby
`restrained and enjoined, pursuant to 35 U.S.C. § 283 and Fed. R. Civ. P. 65(d),
`from making, using, offering to sell, or selling in the United States the H&S Tri(cid:173)
`Flex windrow mergers and any other product not more than colorably different
`therefrom in relation to the Infringed Claims (the Infringing Products).
`This injunction does not preclude the use, sale, or offer for sale of
`Infringing Products sold by H&S before June 12, 2017. Nor does this injunction
`prevent H&S, its dealers, or distributors from servicing, repairing, and providing
`replacement parts for Tri-Flex mergers sold before June 12, 2017. The Infringing
`Products sold before June 12, 2017, are listed on Attachment A.
`H&S shall promptly provide written notice of this injunction to its officers,
`agents, servants, employees, attorneys, distributors, dealers, and any other
`persons or entities in active concert or participation with it, including its dealers
`and distributors. H&S shall take all necessary and appropriate means to ensure
`that this order is complied with.
`So long as any of the Infringed Claims of the patents are valid and
`enforceable, this injunction shall run as follows:
`

`For the '929, '739, and '488 patents, until their expiration on
`March 31, 2023, or upon their expiration due to the nonpayment of
`applicable maintenance fees.
`
`For the '052 patent, until its expiration on August 15, 2028 or upon
`its expiration due to nonpayment of applicable maintenance fees.
`
`IT IS FURTHER ORDERED AND ADJUDGED that judgment is entered in favor of
`defendant H&S Manufacturing, Inc., as follows:
`

`granting summary judgment as to infringement under the doctrine of equivalents
`of the patents-in-suit;

`consistent with the jury's verdict, finding that defendant's infringement of the
`'929 patent was not willful;
`
`granting judgment as a matter of law that defendant's infringement of the '739,
`'488, and '052 patents was not willful; and
`

`denying plaintiff's motion for enhanced damages under 35 U.S.C. § 284.
`
`IT IS FURTHER ORDERED AND ADJUDGED that judgment is entered in favor of
`third-party defendant Kuhn North America, Inc., as follows:
`
`1.
`
`dismissing counts IX and X of defendant's amended counterclaims.
`
`All remaining claims against Kuhn North America, Inc., were dismissed with
`prejudice, pursuant to stipulation.
`
`The foregoing disposes of all claims by and against all parties.
`
