`Pursuant to Federal Rules of Civil Procedure 41(a)(1)(A)(ii) and (c), Plaintiff Surpass
`
`Tech Innovation LLC (“Surpass”), and the Defendants Sharp Corporation, Sharp Electronics
`
`Corporation, and Sharp Electronics Manufacturing Company of America, Inc. (collectively,
`
`“Sharp”); Sony Corporation, Sony Electronics Inc. and Sony Corporation of America
`
`(collectively, “Sony”); Samsung Electronics Co., Ltd. and Samsung Electronics America, Inc.
`
`(collectively, “Samsung”); and VIZIO, Inc. (Delaware Corp.), and VIZIO, Inc. (California
`
`Corp.) (collectively, “VIZIO”), by and through their respective counsel, hereby stipulate as
`
`follows:
`
`1. Surpass’s claims against Sharp and all Sharp products, with respect to U.S. Patent No.
`
`7,420,550 (“the ‘550 Patent”), as set forth in Count II of the Second Amended
`
`Complaint (ECF No. 29), are hereby dismissed with prejudice;
`
`2. Surpass’s claims against (a) Sony, Samsung, and VIZIO based on their use, sale, offer
`
`to sell, or importation of Sharp LCD modules with respect to the ‘550 Patent and (b)
`
`all of the “Accused ‘550 Products” (as defined in Count II of the Second Amended
`
`Complaint), as set forth in Count II of the Second Amended Complaint, are also
`
`
