10/24/2023SECOND REVISED PRETRIAL SCHEDULING ORDER as to Jamaul Karrim Aziz. The parties are hereby notified that jury selection and trial in this action are scheduled to begin on May 1, 2024 at 09:30 a.m. Accordingly, the deadlines for pretrial submissions are as follows: 1. Rule 404(b) evidence (if any) shall be disclosed by no later than March 1, 2024. The government shall fully comply with the notice requirements set forth in Rule 404(b)(3), and supplement that disclosure with citation to caselaw authority for the proposed use. 2. The Government's 16(a)(1)(G) expert witness disclosures shall be made no later than March 1, 2024. 3. Motions in limine, including any government motion to admit or motion to oppose the use of Rule 404(b) evidence, shall be filed by March 29, 2024. Opposition shall be filed by April 5, 2024. No replies will be permitted. 4. Proposed voir dire, requests to charge with exact citation to authority, and a proposed verdict sheet shall be filed by March 29, 2024. The parties are directed to meet and confer and agree to the extent possible on the proposed charge. If the defendant disagrees on the charge, it should set forth its proposed charge immediately below the government's proposed charge (with citation to authority) so that the Court has one proposed charge. Counsel are also directed to meet and confer concerning proposed voir dire questions and prepare one document setting forth the questions agreed to by the parties and additional questions, if any, that the parties cannot agree to. Counsel for the parties shall also confer and provide to the Court a joint, concise written statement describing the case in an impartial, easily understood manner, for the Court to read to the jury panel prior to voir dire. 5. 3500 material and Giglio material, if any, shall be produced by March 15, 2024, with courtesy copies produced to the Court contemporaneously. 6. Marked government case-in-chief exhibits shall be produced by March 15, 2024, with courtesy copies produced to the Court contemporaneously. The government's exhibits shall be marked by numbers and defendant's exhibits by letters. Any objections to the government's case-in-chief exhibits shall be served and filed by March 29, 2024. 7. To the extent electronic media is to be used, counsel shall confer with the Courtroom Deputy and A/V Department to ensure the technology is working properly in advance of trial. 8. Counsel shall provide to the Court, not exchange, witness lists no later than March 29, 2024. The witness lists shall provide a brief description and the purpose of each witness to be offered. Counsel has a continuing obligation to supplement upon learning of any additional witnesses. 9. Counsel shall confer to agree on any stipulations of fact to be read into the record. The Court strongly encourages those stipulations to be reduced to writing, signed by counsel and the defendant, and submitted to the Court no later than three business days prior to trial. 10. Should the defendant choose to enter a plea of guilty, a Notice of Intent shall be filed at least two business days prior to the final pretrial conference and a copy of the plea agreement, if any, must be immediately provided to the Court by email. 11. Counsel should not expect the Court to hold bench conferences during trial to consider legal issues or evidentiary rulings that could have been raised before trial without a showing that counsel could not, by the exercise of due diligence, have anticipated them prior to trial. 12. The final pretrial conference is scheduled for April 11, 2024 at 2:30 p.m., Courtroom 520. 13. Jury selection and trial are scheduled to begin May 1, 2024 at 09:30 a.m. 14. For the foregoing reasons, the Court adopts the Report in its entirety, and Defendant's motion to dismiss the indictment (Doc. 127) is DENIED. 2/8/2023ORDER as to Jamaul Karrim Aziz. On January 23, 2023, Magistrate Judge Davison issued a Report and Recommendation, recommending that defendant's motion to dismiss the indictment be denied. (Doc. 140). Written objections were due, pursuant to Fed. R. Crim. P. 59, by February 6, 2023. On January 24, 2023, after the Court received a document from defendant pro se entitled "Defendant's Objection to Magistrate Judge's Report & Recommendation to Deny Motion to Dismiss Indictment," the Court issued an order rejecting the pro se filing as defendant is represented by counsel, and advised that it will not consider the pro se objections. (Doc. 141). The Court advised in that order it would take no action on defendant's submission and that all communications with the Court must be made through defense counsel. (Id.). On January 26, 2023, the parties appeared before the Court for a status conference. Defense counsel orally advised the Court that he adopted his client's pro se objections. After affording Aziz a further opportunity to consult with counsel, the Court GRANTED Aziz's unopposed motion to withdraw his guilty plea. 3/30/2021ORDER as to Jamaul Karrim Aziz: The Court has reviewed Defendant's request for discovery (Doc. 30) and the Government's response thereto (Doc. 32). Defendant's requested discovery to probe the credibility and reliability of Lisa Ferdico, his co-defendant's mother, citing due process concerns in connection with a pretrial bail hearing, is not supported by relevant authority. Rather, "a detention hearing is not to serve as a mini-trial... or as a discovery tool for the defendant." United States v. Martir, 782 F.2d 1141, 1145 (2d Cir. 1986). Indeed, "[a] pretrial detention hearing... is neither a discovery device for the defense nor a trial on the merits. The process that is due is only that which is required by and proportionate to the purpose of the proceeding. That purpose includes neither a reprise of all the evidence presented before the grand jury... nor the right to confront non-testifying government witnesses." United States v. Smith, 79 F.3d 1208, 1210 (D.C. Cir. 1996). The Government has produced the materials relied upon in seeking the Defendant's remand and filed its submission on the public docket. Additionally, the Defendant has been provided adequate procedural safeguards: he is represented by appointed counsel, has the ability to testify, has the right to proffer the testimony of others on his own behalf, and has the right to otherwise provide evidence on his own behalf. See 18 U.S.C. § 3142(f). Accordingly, the discovery requested by Defendant in connection with a pretrial bail hearing is denied.
