2/10/2025AMENDED AND CORRECTED ORDER REGULATING VOIR DIRE as to Charlie Javice, Olivier Amar. The Court proposes to follow the following protocol for jury selection. Voir dire will take place over the course of two days, February 18 and February 19, 2025. February 18 will be focused on whether the jurors are able to sit for the length of the trial. Each juror will be questioned separately and asked if there are extraordinary circumstances which prevent them from sitting for four to six weeks. I will introduce them to the question by presenting a brief summary of the facts of the case:...[*** See this Amended And Corrected Order Regulating Voir Dire ***]... On February 19, the jurors who can sit will be subject to voir dire. There will be a jury of twelve and four alternate jurors. An array of thirty-six jurors will be seated, each to be replaced if and as they are excused from serving. To the first twenty-eight jurors of the array, defendants will have ten peremptory challenges, and the government, six, to select a jury of twelve. If insufficient jurors are stricken to yield a jury of twelve, the Court will excuse the jurors necessary to achieve that number, in downward sequence from juror number twenty-eight. For the next four jurors to sit as alternates, the defendants will have two peremptories and the government will have two peremptories, to choose four alternates. Similarly, if more than four alternates remain, the Court will excuse jurors in downward sequence from juror number thirty six until four alternates are selected. 1/28/2025ORDER REGULATING VOIR DIRE as to Charlie Javice, Olivier Amar. The Court proposes to follow the following protocol for jury selection, subject to comments by counsel, and orders counsel to meet and confer, and advise the Court on any changes at the February 4, 2025 conference. Voir dire will take place over the course of two days, February 18 and February 19, 2025. If not excused, jurors will be released for the day and told to return the following day, February 19, at 10:00 a.m., to the courtroom designated for the trial, not the jury room. On February 19, the jurors who can sit will be subject to voir dire. There will be a jmy of twelve and four alternate jurors. An array of thirty-six jurors will be seated, each to be replaced if and as they are excused from serving. To the first twenty-eight jurors of the array, defendants will have ten peremptory challenges, and the government, six, to select a jury of twelve. For the next four jurors to sit as alternates, the defendants will have two peremptories and the government will have two peremptories, to choose four alternates. 1/23/2025ORDER AND OPINION DENYING MOTION TO SEVER as to Charlie Javice, Olivier Amar. Defendants Charlie Javice and Olivier Amar are charged with several crimes arising out of a scheme to fraudulently misrepresent information about their company, TAPD, Inc., d/b/a Frank ("Frank") to potential acquiring companies. Defendant Javice was the founder and Chief Executive Officer of Frank, and Defendant Amar the Chief Growth Officer. The Superseding Indictment alleges the following facts. From about June 2021 through November 2022, Defendants Javice and Amar together agreed to and then did submit false and fraudulent statements and representations about Frank and its user data to two banks, including JP Morgan Chase Bank, N.A. ("JPMC"), in order to induce those banks to acquire Frank, thereby defrauding the banks out of millions of dollars. JPMC ultimately acquired Frank for $175 million. The Government intends to argue that the Defendants worked closely together in furtherance of a joint scheme in which they solicited fabricated data and then falsely represented to JPMC and other potential acquirers that Frank had 4.25 million users when in fact it had 300,000 users. Defendant Javice now moves to sever her trial from that of Defendant Amar, arguing that severance is required under Fed. R. Crim. P. 14(a) in order to preserve her right to a fair trial. 9/24/2024ORDER REGULATING PROCEEDINGS as to Charlie Javice, Olivier Amar. On September 6, 2024, Defendants filed a motion to compel production of the remaining documents on the privilege log supplied by JPMorgan Chase Bank, N.A. The motion rested on the grounds that my rulings on privilege in an August 6, 2024 hearing and subsequent August 8, 2024 Order should be applied not only to the subset sample of 2,300 documents that I ordered at that time, but to all remaining documents listed on the privilege log, and alleged that JPMorgan Chase had improperly withheld non-privileged documents. In the alternative, the motion rested on the grounds that JPMorgan Chase had waived privilege as to all documents. Except as granted below, Defendants' motion to compel is denied. I hold that the privilege log was made in good faith, the revisions to the log were made pursuant to court order without indication of bad faith, and JPMorgan Chase has not waived its privilege. Of the remaining unproduced approximately 20,000 documents, about 5,000 relate to the Rule 17 subpoenas by Defendants, and about 15,000 relate to grand jury subpoenas. The Court does not enforce grand jury subpoenas in the context of a Rule 17 motion to quash. See In re Grand Jury Subpoena Dated Feb. 23, 2024, No. 24-MC-104, 2024 WL 1363711, at *4 (S.D.N.Y. Mar. 29, 2024); In re Grand Jury Proceedings, 486 F.2d 85, 89-90 (3d Cir. 1973). Pursuant to the parties' conferral and agreement, I hold that JPMorgan Chase is to re-review the approximately 5,000 documents on the privilege log that are responsive to Defendants' Rule 17 subpoena, and produce all relevant, non-privileged documents, with certain exceptions: 1. Documents that are duplicative, as established by a protocol to be agreed upon by the parties, will not be re-reviewed; 2. Attachments that are not relevant to this matter will not be produced; and 3. Portions of email threads that are not relevant to this matter or that are duplicative will not be produced. Rolling production is to be made over the course of seven weeks, with 14+% to be produced each week. Production is to begin on October 2, 2024 and end on November 20, 2024. The schedule leading to trial is as follows: Defendants are to identify the documents to be used in support of an advice of counsel defense by December 7, 2024. The Government is to provide its preliminary exhibit list, witness list, and Jencks Act material by December 16, 2024. Defendants are to provide their preliminary exhibit list, witness list, and Rule 26.2 material by January 6, 2025. Motions in limine, requests to charge, and proposed voir dire are due by January 13, 2025. Oppositions to motions in limine are due by January 27, 2025. 4/4/2024ORDER DENYING DEFENDANT AMAR'S MOTION FOR EXCHANGE OF PROPERTY as to Charlie Javice, Olivier Amar. Defendant Olivier Amar seeks to modify the conditions of the forfeiture of his bank account, restrained post-indictment by the government for allegedly containing illegally obtained money. He asks to substitute a $250,000 equity interest in his home on Long Island, for $250,000 of the funds restrained by the government pursuant to the Superseding Indictment filed on July 17, 2023, so that he can satisfy outstanding obligations and care for his family. He states that he has been unable to secure steady employment or a home equity line of credit because of his pending criminal charges. The government opposes on two grounds, the absence of statutory jurisdiction of the court, and prejudice to the government from an unequal exchange, exchanging a property encumbered by a mortgage, a contractor's lien, a bailbondsman's security, and his wife's joint interest, for cash. Unlike the statute governing pre-indictment property preservation, the applicable statute does not authorize me to reevaluate a post-indictment restraint because of a defendant's need. Compare 21 U.S.C. 853(e)(1)(B) (court has post-indictment authority to order the restraint of assets if the property "would, in the event of conviction, be subject to forfeiture under this section"); with 21 U.S.C. § 853(e)(1)(A) (court has pre-indictment authority to order the restraint of assets where "the need to preserve the availability of the property... outweighs the hardship on any party against whom the order is to be entered"). There is one exception to preserve a defendant's Sixth Amendment right to be defended by counsel; where a defendant seeks restrained assets in order to pay the counsel of his choice. See United States v. Bonventre, 720 F.3d 126, 130-32 (2d Cir. 2013). Even if I had discretion and authority, I would decline to grant defendant's motion. As the government persuasively demonstrates, the risks inherent in the realization of the $250,000 interest in Defendant's illiquid and encumbered property prejudices the interest of the government. 1/19/2024THIRD ORDER REGULATING PROCEEDINGS as to Charlie Javice, Olivier Amar. On January 17, 2024 and January 18, 2024, I heard arguments and made rulings regarding non-party JP Morgan Chase's (JPMC) motion to quash Defendants' Rule 17(c) subpoenas. I also set dates for further pretrial proceedings. 1. JPMC is to produce all documents in the possession or control of the custodians identified in Exhibit B to the transcript of argument, in all forms of media, responsive to the following categories related to its acquisition of TAPD, Inc., d/b/a Frank ("Frank"): overseeing and conducting due diligence prior to the acquisition date and, post the acquisition date, analyzing, assessing, and using Frank's customer list for the following business purposes: marketing based on or concerning Frank's user base, existing partnerships, and post-acquisition discussions regarding pre-acquisition valuation. See generally Jan. 17, 2024 Tr. at 20:1228:13. 2. JPMC shall file by March 29, 2024 a complete and comprehensive privilege log consistent with the requirements of Local Rule 26.2. Defendants shall submit its objections directly to JPMC by April 30, 2024, and enter into conversations with JPMC to resolve issues of privilege. JPMC shall file a modified privilege log, reflecting the results of such conversations, by May 16, 2024. The Court will hear privilege challenges, via a privilege sampling procedure outlined in the transcript, on May 30, 2024 at 2:30 pm. 3. Defendants shall disclose any affirmative defenses by February 12, 2024. 4. Defendants shall file any pretrial motions pursuant to Fed. Crim. P. R. 12 by April 5, 2024. Opposition briefs shall be filed by May 3, 2024. Reply briefs shall be filed by May 20, 2024. The motions will be heard and resolved on May 30, 2024 at 2:30 p.m. 5. The parties shall exchange expert disclosures by June 15, 2024, and supplemental expert disclosures by July 15, 2024. 6. The government shall file its preliminary exhibit list, witness list, and all other required disclosures by September 13, 2024. 7. Defendants shall disclose its preliminary exhibit list by September 30, 2024. 8. Motions in limine, jury charge proposals, and voir dire proposals shall be filed by September 27, 2024. 9. Briefs in opposition to the motions in limine shall be filed by October 9, 2024. 10. All disputed matters will be heard at the Final Pre-Trial Conference to be held, as previously set, on October 15, 2024 at 11 a.m. CONCLUSION. JPMC's motion to quash is granted and denied as reflected above and in the transcript of argument. The Clerk is instructed to terminate the open motion at ECF No. 73.
