On September 24, 2021, the Court sentenced Mr. Siniscalchi to three years of probation. When Mr. Siniscalchi was arraigned, he was released on a $150,00 personal recognizance bond secured by $20,000 cash or property. $20,000 cash was posted by his parents. Accordingly, since Mr. Siniscalchi's criminal case is now closed, we respectfully request that the Court exonerate the personal recognizance bond and the cash posted as security. 8/5/2020ORDER as to Joseph Meli, James Siniscalchi: Given the ongoing public health situation and the limited number of courtrooms that could safely be used for jury trials in the coming months, the judges of this District recently adopted a plan to determine which criminal cases, if any, should be tried in the coming months and when. Under the plan, the Court has until August 21, 2020, to submit a request with respect to any case that it wishes to try before the end of the calendar year. (Even then, there is no guarantee under the plan that the Court would get its choice of date(s). And, of course, it is unclear whether any jury trials will be feasible given, among other things, the difficulties inherent in impaneling jurors at this time.) No later than August 13, 2020, the parties shall file a joint letter indicating their views on (1) whether this case should or must be tried before the end of the calendar year or whether trial should be adjourned to 2021; (2) whether and when the Court should hold a conference to discuss the matter; and (3) if applicable, whether time should be excluded under the Speedy Trial Act until the next court appearance. If either party believes that there is a need for a conference in the short term, counsel should indicate their views on whether the Court can, consistent with the Constitution, the Federal Rules of Criminal Procedure, the CARES Act, and any other applicable law, conduct the conference by telephone or video and, if applicable, whether the Defendants consent to appearing in that manner and/or to waiving their appearances altogether. In addition, counsel for Defendant Joseph Meli, shall identify the facility in which he is being held and Defendant James Siniscalchi shall indicate whether he is capable of participating in a telephone or video conference. 3/26/2020ORDER as to (19-Cr-480-1) Joseph Meli. On March 23, 2020, Defendant Joseph Meli's parents made a request for bail on their son's behalf. Citing the ongoing public health crisis and Mr. Meli's pre-existing health conditions, his parents requested that he be released from the Manhattan Detention Center (the "MDC") and temporarily placed on home confinement. The Court directed the Government to respond. On March 24, the Government opposed the bail request on the grounds that "even if Meli is bailed by this Court, he must nonetheless remain confined in BOP custody" because he is currently serving a 78 months' sentence in connection with a separate and prior case. See United States v. Simmons et al., No. 17-cr-127 (KMW) (S.D.N.Y.). Although the Court would have given very serious consideration to Mr. Meli's bail application, particularly in light of the public health crisis, the Court agrees with the Government that any decision made by this Court would not render him eligible for release. Mr. Meli is currently detained at the MDC on a writ from Otisville, where he is serving his sentence imposed in the Simmons case. Granting him bail in this matter would thus not change the fact that he is still serving that sentence.
