`'Patent appticants may submit their application to the Office without engaging an authorized
`representative. Nevertheless, because the patent procedure is complicated and experience in dealing
`with patent applications is essential for that procedure to succeed, specialists, namely patent attorneys
`and attorneys specialized in patent law, are called in to assist in many cases. The register of patent
`attorneys can be consulted to find patent attorneys. (...) Lawyers who are not listed in the register of
`patent attorneys can be asked to demonstrate that they are registered as attorneys with a court in the
`Netherlands. (... ) The third paragraph mentions an exception to the rule that only patent attorneys and

`seldom used in practice. Under the current provisions of the Dutch Patents Act (R4ksoctrooiwet),

`was some uncertainty about the meaning of the distinction between an authorized representative and

`Netherlands lndustrial Property Office (State of the Netherlands) et al. involving a dispute about the
`interpretation of Section 29P ol the Dutch PatentsActand Section 52 of the Dutch PatentsAct í995.
`To avoid interpretation problems in the Íuture, the expression 'authorized representative of an
`applicant before the Office' is now consistently used as a general term, meaning a patent attorney or
`an attorney who may act before the Office in accordance with Section 23b. The term 'patent attorney'
`is only used for persons listed in the register of patent attorneys, as referred to in Section 23a.'

`ln the section that was originally proposed, acting as an authorized representative was limited
`to representing the applicant. What that boiled down to was that persons other than the
`applicant could be represented by anyone and everyone. That situation has been corrected as
`a result of an Amendment proposed by Member Hindriks. The explanatory memorandum to the
`amendment read as follows:

`'The purpose of this amendment under which anyone who wishes to be represented before the Office
`and before the Patent Office (OcÍrooiraad) and not just the applicant, is to provide protection in all

`patent attorneys. The complexity of the subject matter, the procedure to be followed and the
`substantial financial interests involved in patent procedures make it necessary to provide expert
`guidance to users, applicants for patents and persons entitled to them. There is every reason to
`ensure that expert guidance is provided for those having to deal with complicated subject matter,
`patent procedures and substantial financial interests before the Office. There is no justification for an
`arrangement in which an applicant is only allowed to engage an officially authorized representative
`while a patentee may be represented by anyone, even though the procedures involved are in fact the
`same and the interests are even greater. The list of persons other than patent applicants who may
`apply to the Office and who may engage an authorized representative to do so is headed by a
`patentee, e.g. in a request for the restoration of rights (Section 23 of the Dutch Patents Act 1995) or in
`a response to a request for advice as to the validity of his patent (Section 85 of the Dutch Patents Act
`1995), and an applicant in a request for protection of a topography of a semiconductor. The same
`applies to applications to the Patent Office (Octrooiraad) (Section 18A of the Dutch Patents Act). In
`opposition proceedings, according to the proposed amendment, an applicant may only engage an
`officially authorized representative, whereas the opposing party may engage anyone to represent him.
`There is no rationale for this discrepancy. Expertise and accountability of the representation of both
`parties is of absolute importance.'

`Article 59 of the EEC Treaty requires not only the elimination of all discrimination against
`a person providing services on the grounds of his nationality, but also the abolition of any
`restriction, even if it applies without distinction to national providers of services and to
`those of other Member States, when it is liable to prohibit or otherwise impede the
`activities of a provider of services established in another Member State where he lawfully
`provides similar services. In particular, a Member State may not make the provision of
`services in its territory subject to compliance with all the conditions required for
`establishment and thereby deprive of all practical effectiveness the provisions of the
`Treaty whose object is, precisely, to guarantee the freedom to provide services. Such a
`restriction is all the less permissible where, unlike the situation governed by the third
`paragraph of Article 60 of the EEC Treaty, the service is supplied without its being
`necessary for the person providing it to visit the territory of the Member State where it is
`provided.
`Having regard to the particular characteristics of the provisions of services in certain
`sectors of activity, specific requirements imposed on the provider, which result from the
`application of rules governing those types of activities, cannot be regarded as
`incompatible with the Treaty. However, as a fundamental principle of the Treaty, the
`freedom to provide services may be limited only by provisions which are justified by
`imperative reasons relating to the public interest and which apply to all persons or
`undertakings pursuing an activity in the State of destination, in so far as that interest is not
`protected by the rules to which the person providing the services is subject in the Member
`State in which he is established. In particular, those requirements must be objectively
`necessary in order to ensure compliance with professional rules and to guarantee the
`protection of the recipient of services and they must not exceed what is necessary to
`attain those objectives.
`Article 59 of the EEC Treaty precludes provisions of a Member State which prohibit a
`company established in another Member State from providing patent-owners in the
`territory of the first State with a service for monitoring those patents and renewing them by
`payment of the requisite fees, on the ground that, by virtue of those provisions, such

`De MvT uit de Rijkswet van 13 juni 2002, Stb. 2003, 366, vermeldt o.m.:
`“Aanvragers van een octrooi kunnen zonder tussenkomst van een gemachtigde hun aanvraag indienen bij het bureau.
`Omdat de octrooiprocedure evenwel gecompliceerd is en ervaring met de behandeling van octrooiaanvragen onontbeerlijk
`is voor een goed verloop van die procedure, wordt in een groot aantal gevallen de hulp ingeroepen van specialisten,
`namelijk octrooigemachtigden en in het octrooirecht gespecialiseerde advocaten. (…) Wie octrooigemachtigden zijn, kan in
`het register van octrooigemachtigden worden nagegaan. Van advocaten die in beginsel niet in dat register voorkomen, kan
`worden verlangd dat zij aantonen als advocaat ingeschreven te staan bij een rechtbank in Nederland. (…) Het derde lid
`geeft een uitzondering op de regel dat alleen octrooigemachtigden en advocaten als gemachtigde van een aanvrager voor
`het bureau kunnen optreden. (…) In de praktijk wordt zij slechts zeer zelden benut. Onder de huidige bepalingen van de
`ROW, ROW 1995 en het OgR bestond enige onzekerheid omtrent de betekenis van het onderscheid tussen een
`gemachtigde en een octrooigemachtigde. Bij arrest van 6 maart 1997 van het Gerechtshof ’s Gravenhage (rolnr. 95/0696),
`in de zaak Orde van Octrooigemachtigden c.s. tegen Bureau voor de Industriële Eigendom (Staat der Nederlanden) c.s. is
`daarop antwoord gegeven in een geschil omtrent de uitleg van de artikelen 29P ROW en 52 ROW 1995. Om
`interpretatieproblemen voor de toekomst te voorkomen, wordt thans consequent de uitdrukking ‘gemachtigde van een
`aanvrager voor het bureau’ gebruikt als algemene term, waarmee wordt bedoeld een octrooigemachtigde of een advocaat
`die overeenkomstig artikel 23b voor het bureau kan optreden. De term ‘octrooigemachtigde’ wordt alleen gebezigd voor
`diegenen die zijn ingeschreven in het register van octrooigemachtigden, bedoeld in artikel 23a.”

`Het oorspronkelijke voorgestelde artikel beperkte het optreden als gemachtigde tot het vertegenwoordigen van de
`aanvrager. Hetgeen er op neer komt dat andere dan de aanvrager zich door een ieder mogen laten vertegenwoordigen. Als
`gevolg van een Amendement van het lid Hindriks is deze situatie rechtgezet. De toelichting bij het amendement luidt als
`volgt:
`“Dit amendement strekt ertoe om een ieder die zich voor het bureau en voor de octrooiraad willen laten vertegenwoordigen,
`en niet slechts de aanvrager, in alle situaties te blijven beschermen door deze vertegenwoordiging slechts open te stellen
`voor octrooigemachtigden en andere in de wet genoemde deskundige gemachtigde. De gecompliceerdheid van de materie,
`de te volgen procedure en de grote financiële belangen die met octrooiprocedures gemoeid zijn maken voor de gebruikers,
`aanvragers van en rechthebbende op octrooien, deskundige begeleiding noodzakelijk. Er is alle reden om voor degenen die
`ten overstaan van het bureau met gecompliceerde materie, octrooi-procedures en grote financiële belangen worden
`geconfronteerd, een deskundige begeleiding te verzekeren. Er is geen rechtvaardiging voor een regeling waarbij men als
`aanvrager slechts een als zodanig toegelaten gemachtigde zou kunnen gebruiken en als octrooihouder, waarbij de
`procedures feitelijk dezelfde zijn en er sprake is van nog groter belangen, zich door een ieder zou kunnen laten
`vertegenwoordigen. De belangrijkste andere personen dan een aanvrager om octrooi, die zich tot het bureau kunnen richten

`en zich derhalve door een gemachtigde kunnen laten vertegenwoordigen, zijn een octrooihouder, bijvoorbeeld wanneer
`deze herstel in de vorige toestand verzoekt (art. 23 ROW 1995) of reageert op een verzoek om advies over de geldigheid
`van zijn octrooi (art. 85 ROW 1995) en een aanvrager om bescherming voor een topografie van een halfgeleider. Voor het
`optreden voor de Octrooiraad (artikel 18A ROW) geldt hetzelfde. In een oppositieprocedure zou volgens de voorgestelde
`wijziging een aanvrager zich alleen door een erkend gemachtigde kunnen laten vertegenwoordigen, terwijl de opposant elke
`persoon voor zich kan laten optreden. De ratio achter dit verschil ontbreekt. Deskundigheid en aanspreekbaarheid van de
`vertegenwoordiging van beide partijen is onverminderd belangrijk.”

`Hieruit valt af te leiden dat taken van de octrooigemachtigde ruimer worden beschouwd dan alleen het verlenen van bijstand
`bij het opstellen en indienen van een octrooiaanvrage.

`“Samenvatting:
`1.
`Artikel 59 EEG-Verdrag verlangt niet alleen de afschaffing van iedere discriminatie van de dienstverrichter op
`grond van diens nationaliteit, maar tevens de opheffing van iedere beperking — ook indien deze zonder
`onderscheid geldt voor binnenlandse dienstverrichters en dienstverrichters uit andere Lid-Staten — die de
`werkzaamheden van de dienstverrichter die in een andere Lid-Staat is gevestigd en aldaar rechtmatig
`gelijksoortige diensten verricht, verbiedt of anderszins belemmert. Met name mag een Lid-Staat de verrichting
`van diensten op zijn grondgebied niet afhankelijk stellen van de inachtneming van alle voorwaarden die voor
`vestiging gelden, omdat hij daarmee de verdragsbepalingen die het vrij verrichten van diensten moeten
`verzekeren, ieder nuttig effect zou ontnemen. Een dergelijke beperking is te minder toelaatbaar wanneer de
`dienst, anders dan in de in artikel 60, laatste alinea, EEG-Verdrag bedoelde situatie, wordt verricht zonder dat de
`dienstverrichter zich hoeft te begeven naar het grondgebied van de Lid-Staat waarin de dienst wordt verricht.
`Gelet op de bijzondere aard van de dienstverrichting op het gebied van bepaalde werkzaamheden, kunnen
`specifieke eisen die aan de dienstverrichter worden gesteld op grond dat de toepassing van de voor de
`betrokken werkzaamheden geldende regels zulks vereist, niet onverenigbaar met het Verdrag worden geacht.
`Als grondbeginsel van het Verdrag kan het vrij verrichten van diensten echter slechts worden beperkt door
`regelingen die hun rechtvaardiging vinden in dwingende redenen van algemeen belang en die gelden voor
`iedere persoon of onderneming die op het grondgebied van de Lid-Staat van ontvangst werkzaam is, voor zover
`dit belang niet wordt gewaarborgd door de regels waaraan de dienstverrichter is onderworpen in de Lid-Staat
`waar hij is gevestigd. De gestelde eisen moeten in het bijzonder objectief noodzakelijk zijn om de naleving van
`de beroepsregels en de bescherming van de ontvanger van de dienst te waarborgen, en mogen niet verder gaan
`dan ter bereiking van deze doelstellingen noodzakelijk is.
`Artikel 59 EEG-Verdrag verzet zich tegen een nationale wettelijke regeling die het een in een andere Lid-Staat
`gevestigde vennootschap verbiedt, ten behoeve van octrooihouders in het binnenland diensten op het gebied
`van de bewaking en de instandhouding van octrooien te verrichten door betaling van de verschuldigde taksen,
`op grond dat die werkzaamheid ingevolge die nationale regeling is voorbehouden aan personen die over een
`bijzondere beroepskwalificatie beschikken, zoals octrooigemachtigden.”
