`The consequence of the criterion that a question need not be answered by anyone with a right to refuse to give evidence, as
`long as the judge entertains a reasonable doubt as to whether an answer could be given truthfully without disclosing what
`should not be disclosed, is that the court's opinion on this point is of secondary importance. The risk associated with this is
`that finding the truth is also subordinated to the individual interests of the person having a right to refuse to give evidence in
`those cases where the judge deems it not to be justified if he could be apprised of all the circumstances of the case pertaining
`to reliance upon the right to refuse to give evidence. The exceptional nature of the right to refuse to give evidence is not
`properly observed if legal professional privilege can be used to conceal what should in fact be disclosed.
`Vranken argued that the judge must investigate more proactively whether someone with a right to refuse to give evidence can
`hold back certain information. He felt that a different judge than the one hearing the witness testimony could be apprised of the
`information that the person having the right to refuse to give evidence was unwilling to provide. lf that other judge held that this
`inÍormation did not have to be disclosed, the witness examination could then be continued before the judge to whom the plea
`of the right to refuse to give evidence had been made, as he would not be aware at that point of the substance of that
`information.luThis approach has not yet gained any traction for reliance on a witness's right to refuse to give evidence. A
`similar approach has however been accepted in case law for cases where a party is unwilling to introduce certain

`ln practice, the question of the scope of reliance on legal proíessional privilege arises fairly regularly. For three categories of
`persons having the right to refuse to give evidence, this has led to case law providing more detailed instructions for assessing
`this scope; they are a tax officer, an attorney-at-law and a civil law notary. We will discuss these criteria below.

`Het criterium dat een vraag door een functioneel verschoningsgerechtigde niet hoeft te worden beantwoord zolang de
`rechter aan redelijke twijfel onderhevig acht of de beantwoording naar waarheid zou kunnen geschieden zonder dat
`geopenbaard wordt wat verborgen dient te blijven, heeft tot gevolg dat het rechterlijk oordeel op dit punt een marginaal
`karakter heeft. Het risico daarvan is dat de waarheidsvinding ook ondergeschikt wordt gemaakt aan het individuele belang
`van een verschoningsgerechtigde in gevallen waarin de rechter dat niet gerechtvaardigd zou achten als hij zou kunnen
`kennisnemen van alle omstandigheden van het geval rondom het beroep op het verschoningsrecht. Aan het
`uitzonderingskarakter van het verschoningsrecht wordt geen recht gedaan als een functioneel verschoningsrecht zou
`kunnen worden gebruikt om verborgen te houden wat behoort te worden geopenbaard.
`Vranken heeft bepleit dat de rechter actiever moet kunnen beoordelen of een verschoningsgerechtigde bepaalde informatie
`mag achterhouden. Hij heeft geopperd dat daartoe een andere rechter dan de rechter die de getuigen hoort, zou kunnen
`kennisnemen van de informatie waarover de verschoningsrechtigde niet wil verklaren. Oordeelt de andere rechter dat die
`informatie niet behoeft te worden geopenbaard, dan kan het getuigenverhoor worden voortgezet ten overstaan van de
`rechter voor wie het beroep op het verschoningsrecht is gedaan. Deze is dan immers niet bekend geraakt met de inhoud
`van die informatie.[1] Deze benadering heeft bij het beroep op een verschoningsrecht van een getuige nog geen ingang
`gevonden. Wel is een soortgelijke benadering in de rechtspraak aanvaard voor gevallen waarin een partij bepaalde
`informatie niet in het geding wil brengen.[2] Wetsvoorstel 34059 beoogt die benadering te codificeren in art. 22 Rv.[3]
`In de praktijk rijst met enige regelmaat de vraag naar de reikwijdte van een beroep op een functioneel verschoningsrecht.
`Voor drie categorieën verschoningsgerechtigden heeft dat geresulteerd in rechtspraak waarin nadere aanwijzingen zijn
`gegeven ter beoordeling van de reikwijdte, te weten voor een belastingambtenaar, een advocaat en een notaris. Deze
`criteria komen hierna aan de orde.
