`Het geding
`
`Bij exploot van 16juni 2017 is Philips in hoger beroep gekomen van een door de
`rechtbank Den Haag tussen partijen gewezen vonnis van 22 maart 2017. Bij
`memorie van grieven met producties (MvG) heeft Philips 26 grieven aangevoerd. Bij
`incidentele eis tot inzage ex artikel 843a Rv, alsmede memorie van antwoord in
`principaal appel, tevens houdende memorie van grieven in incidenteel appel alsmede
`vermeerdering van eis, met producties (MvA), heeft Asus de grieven bestreden en in
`incidenteel appel twee grieven aangevoerd. Daarop heeft Philips een conclusie van
`antwoord in het incident ex artikel 843a Rv, met productie (CvA mc), genomen.
`Mede naar aanleiding van de door partijen gevoerde correspondentie heeft het hof bij
`tussenarrest van 20 februari 2018 een comparitie van partijen gelast teneinde de
`verdere procesgang te bespreken. Deze comparitie is gehouden op 18mei2018, bij
`welke gelegenheid Philips een akte heeft ingediend en een productie heeft
`overgelegd. Nadien heeft Philips een memorie na comparitie, tevens houdende
`exceptie van onbevoegdheid en memorie van antwoord in het incidenteel appel, met

`producties (MnC) genomen enAsus een antwoordmemorie na comparitie, tevens
`wijziging van eis in reconventie, met producties (AMnC). Daarna hebben beide
`partijen bij akte nog nadere prodttcties ingediend.
`
`Asus heeft (in de AMnC) bezwaar gemaakt tegen de op het ‘clippingmechanisme’
`gebaseerde stellingen van Philips (vgl. 4.57 e.v. hierna), zoals kenbaar uit het op 19
`juLi 2018 gewezen vonnis in de parallelle Engelse procedure (zie 2.35), omdat dit in
`strijd zou komen met de goede procesorde en met de twee-conclusieregel. Het hof
`heeft ter zitting, voorafgaand aan de pleidooien, beslist dat het bezwaar niet wordt
`gehonoreerd. Bedoeld standpunt van Philips (dat door de Engelse rechter is gevolgd)
`heeft zij in onderhavige procedure reeds bij MvG, als subsidiair standpunt,
`voldoende kenbaar en gemotiveerd aangevoerd (in grief 15 met voetnoten 18 en 19).
`Nadere onderbouwing van dat standpunt in latere processtukken en tijdens pleidooi,
`waarbij Asus voldoende gelegenheid heeft gehad daarop te reageren, hetgeen zij ook
`heeft gedaan, is derhalve toegetaten.
`
`Philips heeft bezwaar gemaakt tegen bepaalde onderdelen van de AMnC omdat deze
`in strijd zouden komen met de twee-conctusieregel. Op deze bezwaren zal, voor
`zover nodig, hierna bij de beoordeling worden beslist.
`
`Partijen hebben 7 februari 2019 (over de geldigheid van en inbretik op het octrooi)
`en op 11 februari 2019 (over het Frand-verweer) de zaak doen bepleiten, Philips door
`mr. B.J. van den Broek en mr. G. Theutvs, advocaten te Amsterdam; Astis door mr.
`Maas voornoemd en mrs. 1. Werts en B. Nijhof, kantoorgenoten, aan beide zijden
`aan de hand van overgelegde pleitnotities (respectievelijk PA-octrooi en PA-f rand).
`Ten slotte hebben partijen arrest gevraagd.
`

`De feiten
`

`
`Philips houdt zich bezig met de ontwikkeling en verkoop van producten op diverse

`terreinen en beschikt over een uitgebreide octrooiportefeuille, waaronder op het terrein van
`de (draadloze) communicatie.
`
`Het Asus concern houdt zich (onder meer) bezig met de verkoop van
`2.2
`computerproducten en producten voor draadloze communicatie, waaronder diverse
`prodttcten met 3G (UMTS)- en 4G (LTE)-ftinctionaliteit zoals smartphones en laptops, onder
`meer in Nederland.
`
`het octrooi
`
`Philips is houdster van het Europese octrooi 1 623 511 (hierna: het octrooi of EP
`2.3
`511) met de titel “Communication System”, verleend op 7 maart 2007 op een aanvraag van
`20 april 2004, met een beroep op prioriteitsdatum 3 mei 2003 van GB 03 10289. Het octrooi
`kent 44 conclusies, waarvan de onafhankelijke conclusie 1 en de daarvan afhankelijke
`concttisies 2 tot en met 22 zien op een radiostation, onafhankelijke conclusie 23 op een
`radiocommunicatiesysteem en onafhankelijke conclusie 24 en de daarvan afhankelijke
`conclusies 25 tot en met 44 betrekking hebben op een werkwijze. Conclusies 1, 9, 10, 12, 23,
`24, 32, 33 en 35 van EP 511 luiden in de oorspronkelijke Engelse taal:

`In het incident:
`
`4.202 De door Asus gevorderde inzage in en/of afschrift van licentieovereenkomsten die
`Philips heeft gesloten met of aangeboden aan andere partijen met betrekking tot de UMIS /
`LIE portfolio, zat worden afgewezen. Asus heeft die inzage gevorderd om te kunnen
`vaststellen of het door Philips gedane licentie-aanbod en eventueel in de toekomst volgende
`aanbiedingen al dan niet discriminerend zijn.
`
`4.203 Het onderdeel ‘non-discriminatory’ uit ‘Frand’ ziet er alleen op dat vergelijkbare
`gevallen gelijk worden behandeld. Asus onderkent dit ook met haar standptint dat de door
`Philips aangeboden standaard licentieovereenkomst gegeven haar bijzondere positie voor
`Asus niet passend zou zijn en dat zij daarom aanspraak zou hebben gemaakt op andere dan
`de standaardvoorwaarden.
`
`4.204 Of sprake is van vergelijkbare gevallen hangt af van diverse omstandigheden die niet
`uit de bepalingen van een overeenkomst af te leiden zijn, waarop Philips terecht heeft
`gewezen (110 CvA mc) en door Asus, mede in het licht van haar voornoemde standpunt,
`onvoldoende gemotiveerd is bestreden. Haar vordering tot inzage in en/of afschrift van alle
`licentie-overeenkomsten die Philips met betrekking tot de UMTS/LTE portfolio heeft
`gesloten met of aangeboden aan derden, is daarom onvoldoende gespecificeerd en komt neer
`op een ongeoorloofde fishing expedition. Asus heeft daarom reeds om die reden
`onvoldoende rechtmatig belang bij toewijzing van haar incidentele vordering.
`
`4.205 Naar het oordeel van het hof kan niet worden aangenomen dat daarover anders moet
`worden geoordeeld indien de inzagevordering geacht zou kunnen worden (mede) te zijn
`gebaseerd op artikel $44 Rv e.v., welke regeling ziet op zaken waarin inzage, afschrift of
`uittreksel van bescheiden als bedoeld in artikel $43a Rv wordt gevorderd wegens een inbreuk
`op het mededingingsrecht. Daarbij merkt het hof overigens op dat er geen aanleiding bestaat
`te veronderstellen dat die regeling inderdaad toepasselijk zou zijn, nu uit hetgeen is
`overwogen volgt dat naar het oordeel van het hof van misbruik van machtspositie door
`Philips geen sprake is of in de toekomst zal zijn (als zij al een machtspositie zou hebben)
`gegeven het gebrek aan een frand-benadering aan de zijde Asus.
`
`4.206 Voor zover Asus aan haar inzagevordering ten grondslag heeft gelegd dat uit de door
`haar gestelde, uit r.o. 63 van het Huawei / ZTE arrest afgeleide, substantiëringsplicht
`voortvloeit dat Philips verplicht zou zijn in de door haar met derden afgesloten
`licentieovereenkomsten inzage te geven, wordt dat reeds afgewezen omdat — zoals ook
`hiervoor overwogen — het bestaan van een dergelijke substantiëringsplicht niet kan worden
`aangenomen. Dat een dergelijke verplichting zou voortvloeien uit een EISI-verklaring volgt
`niet uit die verklaring en Asus heeft evenmin voldoende onderbouwd op grond waarvan dat
`anderszins uit de ETSI-regels zoti zijn af te leiden.
`
`4.207 Tenslotte kan voor toewijzing van de inzagevordering evenmin grondslag worden
`gevonden in het door Asus gevorderde wereldwijde handhavingsverbod en gebod om te
`goeder trouw door te onderhandelen met Asus (vgl. par. 367 AMnC). Deze vorderingen
`worden — op andere grond dan waarvoor inzage is gevorderd (zie 4.202 hiervoor) —
`afgewezen (zie 4.199 e.v. hiervoor), zodat daaraan evenmin belang bij inzage kan worden
`ontleend.
`

`4.208 De vragen of sprake is van een rechtsbetrekking in de zin van artikel 843a Rv en of
`is voldaan aan de overige voorwaarden voor toewijzing van een vordering tot inzage, kunnen
`derhalve onbeantwoord blijven.
`
`In incidenteel appel
`
`4.209 Uit hetgeen hiervoor is overwogen ten aanzien van het incident — namelijk dat de
`inzagevordering dient te worden afgewezen met veroordeling van Asus in de 1019h Rv
`proceskosten — volgt dat de grieven in incidenteel appel niet kunnen slagen.
`
`Proceskosten
`
`4.210 Asus zal als de in hoofdzaak in het ongelijk gestelde partij worden veroordeeld in de
`proceskosten van Philips, zowel in eerste aanleg als in appel, zowel in principaal appel in
`conventie en in reconventie als in incidenteel appel, als ook in het incident. Partijen hebben
`omtrent de hoogte van de proceskosten overeenstemming bereikt in die zin dat deze in eerste
`aanleg Euro 320.000,- bedragen en in hoger beroep Euro 600.000,-. Gelet op de aard en
`omvang van deze procedtire ziet liet hof geen aanleiding deze ambtshalve te matigen.
`

`De beslissing
`
`Het hof, in liet principaal appel in conventie en in reconventie, in het incident en in liet
`incidenteel appel
`

`verbiedt Asus om in Nederland inbreuk te maken op de conclusies van Europees
`octrooi EP 1 623 5 Ii zoals die lctiden volgens het tweede huipverzoek;
`
`beveelt Astis om binnen twee weken na betekening van dit arrest aan Philips
`schriftelijke opgave te verstrekken van alle afnemers (niet zijnde particulieren) aan
`wie Asus in of vanuit Nederland producten heeft verkocht, verhutird, afgeleverd
`en/of daartoe heeft aangeboden, die vallen onder de beschermingsomvang van
`Europees octrooi EP 1 623 511 volgens de conclusies van het tweede hulpverzoek;
`
`beveelt Asus om binnen twee weken na betekening van dit arrest aan ieder van de
`onder 5.2 bedoelde afnemers een aangetekende brief te zenden met uitsluitend de
`navolgende inhoud en zonder bijschrift:
`
`“Wij zijn verplicht u te informeren dat liet Gerechtshof Den Haag bij arrest
`van 7 mei 2019 heeft beslist dat de door ons op de markt gebrachte UMTS
`producten met HSUPA-functionaliteit inbreuk maken op de conclusies van
`Europees octrooi EP 1 623 511 van Koninklijke Philips N.V. zoals die luiden
`volgens het tweede htilpverzoek en dat deze producten derhalve niet langer
`mogen worden aangeboden, verkocht of geleverd, dan wel gebruikt of in
`voorraad worden gehouden. Wij verzoeken u hierbij om deze producten niet
`langer aan te bieden (op uw website, in brochures e.d.) en alle exemplaren
`van deze producten die zich onder u bevinden aan ons te retourneren. Wij
`zullen dan onmiddellijk de aankoopprjs en alle kosten in verband met de
`retournering van de producten aan u vergoeden.

`beveelt Asus om binnen twee weken na betekening van dit arrest vorenbedoelde
`producten die nog in voorraad zijn, alsmede de teruggezonden producten (binnen
`twee weken na ontvangst hiervan), en voorts alle brochures en andere
`promotiemiddelen voor die producten te vernietigen, en aan Philips binnen drie
`tveken na de vernietiging deugdelijk bewijs te verschaffen dat die vernietiging
`volledig en tijdig heeft plaats gevonden;
`
`beveelt Asus om aan Philips per overtreding van het in 5.1 bedoelde verbod en voor
`iedere niet (gehele c.q. deugdelijke) nakoming van de in 5.2 t/m 5.4 en 5.7 bedoelde
`bevelen aan PhiLips een dwangsom te betalen van Euro 50.000,-- (vijftig duizend
`Euro) dan wel, ter ketize van Philips, aan Philips een dwangsom te betalen van Euro
`25.000,-- (vijf-en-twintig duizend Euro) per betrokken product, of per dag, een
`gedeelte van een dag voor een gehele gerekend, dat de inbretik op de conclusies van
`Europees octrooi EP 1 623 511 zoals die luiden volgens het ttveede hulpverzoek in
`Nederland na de betekening van dit arrest zal voortduren, of de in 5.2 t/m 5.4 en 5.7
`bedoelde bevelen na de betekening van dit arrest niet geheel en deugdelijk worden
`nagekomen, waarbij de dwangsommen verschuldigd zijn per niet (geheel en
`deugdelijk) nagekomen verbod of bevel en waarbij Astis hoofdelijk aansprakelijk is
`voor betaling van de dwangsommen;
`
`veroordeelt Asus hoofdelijk om aan Philips te vergoeden de schade die zij heeft
`geleden en nog verder zal lijden ten gevolge van inbreuken van Asus op de
`conclttsies van Europees octrooi EP 1 623 511 zoals die luiden volgens het tweede
`huipverzoek, een en ander op te maken bij staat en te vereffenen zoals voorzien in de
`wet, vermeerderd met de wettelijke rente vanaf een in de schadestaatprocedure vast
`te stellen dag, tot aan de dag der algehele voldoening en/of, zulks ter keuze van
`Philips, de door Asus met de hier aan de orde zijnde handelingen genoten winsten
`aan Philips af te dragen, eveneens vermeerderd met de wettelijke rente vanaf een in
`de schadestaatprocedtire vast te stellen dag, tot aan de dag der algehele voldoening;
`
`veroordeelt Asus omtrent de winsten binnen vier weken na betekening van dit arrest
`rekening en verantwoording af te leggen door aan Philips een verklaring te
`verschaffen waaruit de hoogte blijkt van de als gevolg van de inbreukmakende
`activiteiten behaalde winsten van Astis, welke verklaring vergezeld dient te gaan van
`een votledige opgave van:
`a) het aantal vervaardigde inbrecikmakende producten, gestaafd met alle daarop
`betrekking hebbende bescheiden;
`b) de hoeveelheid en inkoopprjs van de aan Asus afgeleverde inbreukmakende
`producten, gestaafd met alle daarop betrekking hebbende bescheiden, waaronder
`facturen;
`c) de hoeveelheid en verkoopprijs van de verkochte of anderszins geleverde
`inbreukmakende producten, gestaafd met alle daarop betrekking hebbende
`bescheiden, waaronder facturen;
`d) de hoeveelheid van de ten tijde van de betekening van het ten deze te wijzen
`vonnis nog in voorraad zijnde inbreukmakende producten, gestaafd met alle
`desbetreffende bewijsstukken;

`vernietigt EP 1 623 511 voor zover dit meer inhoudt dan de conclusies volgens het
`tweede hulpverzoek;

`1.1. By virtue of a writ dated 16 June 2017, Philips instituted an appeal against a
`judgment of 22 March 2017 that the District Court of The Hague rendered between
`the parties. By virtue of a statement of appeal with exhibits (Appeal), Philips
`advanced 26 grounds for appeal. By virtue of a motion for access by virtue of
`Article 843a DCCP, also containing statement of defence in the appeal on the
`main issue, also containing statement of appeal in the cross-appeal and an
`increase in the claim, with exhibits (Defence on Appeal), Asus challenged the
`grounds for appeal and advanced two grounds for appeal in the cross-appeal.
`In response, Philips filed a statement of defence in the motion by virtue of Article
`843a DCCP, with one exhibit (Defence in the Motion). In part in response to the
`correspondence conducted by the parties, in an interlocutory ruling dated 20
`February 2018, the Court of Appeal ordered a personal appearance of the parties
`in order to discuss the further course of the proceedings. This personal

`appearance was held on 18 May 2018. On this occasion, Philips filed a document
`and submitted one exhibit. Subsequently, Philips filed a statement on appeal after
`appearance, also containing a motion for the court to decline jurisdiction and
`transfer the case and statement of defence in the cross-appeal, with exhibits
`(Statement after Appearance) and Asus filed a response on appeal after
`appearance, also containing a change in the counterclaim, with exhibits
`(Response after Appearance). Following this, both parties filed a document to
`submit additional exhibits.
`
`1.2. Asus objected (in the Response after Appearance) to Philips’ arguments based on
`the ‘clipping mechanism’ (see par. 4.57 and following below), as apparent from the
`judgment rendered on 19 July 2018 in the parallel English proceedings (see par.
`2.35), because this is allegedly in breach of due process and the two-statement
`rule. At the hearing, prior to the pleadings, the Court of Appeal decided that the
`objection would not be honoured. Philips already sufficiently clearly advanced and
`substantiated its point of view referred to above (which the English judge followed)
`in the Appeal in these proceedings, as an alternative point of view (in ground for
`appeal 15 with footnotes 18 and 19). Thus, further substantiating this point of view
`in later case documents and during the oral pleadings, whereby Asus had
`sufficient opportunity to respond to this and, in fact, did respond to this, is allowed.
`
`1.3. Philips objected to certain parts of the Response after Appearance, because these
`are allegedly in breach of the two-statement rule. In as far as necessary, these
`objections will be decided on in the assessment below.
`
`The parties had the case argued on 7 February 2019 (regarding the validity and
`infringement of the patent) and on 11 February 2019 (regarding the Frand
`defence), Philips by B.J. van den Broek, LL.M. and G. Theuws, LL.M., attorneys in
`Amsterdam; Asus by attorney Maas mentioned above and by I. Werts, LL.M. and
`B. Nijhof, LL.M., colleagues, on both sides based on submitted pleading notes
`(hereinafter referred to as the PA Patent and the PA Frand, respectively). Finally,
`the parties requested that the Court of Appeal render a ruling.

`2.1. Philips’ activities include the development and sale of products in various areas. It
`has an extensive patent portfolio, including in the field of (wireless) communication.
`
`The activities of the Asus Group (inter alia) include the sale of computer products

`and products for wireless communication, including various products with 3G (UMTS) and
`4G (LTE) functionality, such as smartphones and laptops, inter alia in the Netherlands.
`

`2.3. Philips is the holder of European patent 1 623 511 (hereinafter: the patent or EP
`511) entitled “Communication System”, granted on 7 March 2007 by virtue of an
`application dated 20 April 2004, claiming 3 May 2003 of GB 03 10289 as the priority date.
`The patent has 44 claims: independent claim 1 and claims 2 to 22 depending on claim 1
`pertain to a radio station; independent claim 23 pertains to a radio communication system;
`independent claim 24 and claims 25 to 44 depending on claim 24 pertain to a process.

`par. 700 of the Defence on Appeal). In view of the findings in respect of this Frand
`defence – in particular the fact that especially on the part of Asus the actual willingness to
`enter into a licence agreement on Frand terms and to conduct negotiations in this regard
`in good faith is absent – those facts and arguments cannot support the claims in
`counterclaim.
`
`4.201 Thus, the Court of Appeal does not have to rule on the objection that Philips made
`based on the two-statement rule and the principles of due process against the alternative
`claim that was only initiated in the Response on Appeal.
`

`4.202 The access to and/or copy of licence agreements that Philips concluded with or
`offered to other parties regarding the UMTS / LTE portfolio demanded by Asus will be
`dismissed. Asus demanded this access to determine whether or not the licence offer that
`Philips made and any subsequent offers in the future are non-discriminatory.
`
`4.203 The ‘non-discriminatory’ part from ‘Frand’ only pertains to identical cases being
`dealt with identically. Asus also acknowledges this with its point of view that given Asus’
`special position, the standard licence agreement that Philips offered is allegedly
`inappropriate for Asus and that for this reason, it demanded conditions other than the
`standard conditions.
`
`4.204 Whether identical cases are involved depends on various circumstances that
`cannot be inferred from the provisions of an agreement, which Philips rightfully pointed out
`(par. 110 of the Defence in the motion), against which Asus did not advance a sufficiently
`substantiated challenge, in part in light of its point of view mentioned above. Asus claim
`for access to and/or a copy of all licence agreements that Philips concluded with or
`offered to third parties with regard to the UMTS/LTE portfolio has therefore been
`insufficiently specified and constitutes an unauthorized fishing expedition. For this reason
`alone, Asus has insufficient legal interest in its claim in the motion being awarded.
`
`4.205 The Court of Appeal is of the opinion that it cannot be assumed that this should be
`decided on otherwise if the claim for access could be deemed to have been based (in
`part) on Article 844 DCCP and following, which rules pertain to cases in which access to
`or a copy of or extract from documents referred to in Article 843a DCCP is demanded on
`account of infringement of competition law. In this context, the Court of Appeal notes that
`there is no reason to assume that those rules indeed apply, given that it follows from the
`findings that the Court of Appeal believes that no abuse of a dominant position by Philips
`is involved or will be involved in the future (even assuming Philips has a dominant
`position), given the lack of a Frand approach on the part of Asus.
`
`4.206 To the extent that Asus based its claim for access on the fact that it follows from
`the substantiation duty alleged by Asus, derived from par. 63 of the Huawei / ZTE ruling,
`that Philips is required to make the licence agreements that it concluded with third parties
`available for inspection, this is already dismissed because – as also found above – the
`existence of such a substantiation duty cannot be assumed. The fact that such an
`obligation results from an ETSI declaration does not follow from this declaration, nor has
`Asus sufficiently substantiated the basis on which this can allegedly be inferred otherwise
`from the ETSI rules.

`4.207 Finally, the worldwide enforcement prohibition and order to continue the
`negotiations with Asus in good faith (see par. 367 of the Response on Appeal) claimed by
`Asus do not offer any basis to award the claim for access, either. These claims are
`dismissed – based on a ground other than the one for which access is claimed (see par.
`4.202 above) – (see par. 4.199 and following above), so that no interest in access can be
`derived from this, either.
`
`4.208 Thus, the questions regarding whether a legal relationship in the sense of Article
`843a DCCP is involved and regarding whether the other conditions for awarding a claim
`for access have been satisfied do not have to be answered.
`
`In the cross-appeal
`
`4.209 It follows from the above findings regarding the motion – i.e. that the claim for
`access should be dismissed with an order for Asus to pay the costs of the proceedings by
`virtue of Article 1019h DCCP – that the grounds for appeal in the cross-appeal cannot
`succeed.
`
`Costs of the proceedings
`
`4.210 As the party ruled against in the main action, Asus will be ordered to pay Philips’
`costs of the proceedings, both in the first instance and on appeal, both in the appeal on
`the main issue in claim and in counterclaim and in the cross appeal, as well as in the
`motion. The parties have reached agreement regarding the amount of the costs of the
`proceedings in the sense that these amount to EUR 320,000.00 in the first instance and
`EUR 600,000.00 in the appeal. In view of the nature and scope of these proceedings, the
`Court of Appeal does not see any reason to moderate these costs ex officio.

`Netherlands and/or made an offer to this effect regarding products that fall under
`the extent of the protection that is conferred by European patent EP 1 623 511
`according to the claims of the second auxiliary request, within two weeks after this
`ruling has been served;

`orders Asus to send each of the buyers referred to in par. 5.2 a registered letter,
`exclusively containing the following text and without any additions, within two

`orders Asus to destroy the products referred to above that are still kept in stock, as
`well as the returned products (within two weeks after they are received), and
`further all brochures and other promotional materials for those products, and,
`within three weeks after the destruction, to provide Philips proper proof of the fact
`that this destruction was performed completely and in time, within two weeks after
`this ruling has been served;
`
`orders Asus to pay Philips a penalty of EUR 50,000.00 (fifty thousand Euros) for
`each violation of the prohibition referred to in par. 5.1 and for each failure to (fully
`or properly) comply with the orders referred to in par. 5.2 to 5.4 and 5.7, or, at
`Philips’ option, to pay Philips a penalty of EUR 25,000.00 (twenty-five thousand
`euros) for each product involved, or for each day, in which part of a day is
`calculated as a whole day, that the infringement of the claims of European Patent
`EP 1 623 511 as these read according to the second auxiliary request in the
`Netherlands continues after this ruling has been served, or the orders referred to in
`par. 5.2 to 5.4 and 5.7 are not fully and properly complied with after this ruling has

`suffered and may suffer in the future as the result of Asus’ infringements of the
`claims of European patent EP 1 623 511 as these read according to the second
`auxiliary request, all this to be assessed by the court and to be settled as provided
`by law, plus the statutory interest as of a date to be determined in the follow-up
`proceedings for determining damages, until the date of payment in full and/or, at
`Philips’ option, to surrender the profits that Asus enjoyed with the practices at
`issue here to Philips, plus the statutory interest as of a date to be determined in the
`follow-up proceedings for determining damages, until the date of payment in full;

`orders Asus to render an account regarding the profits by providing Philips a
`statement demonstrating the amount of the profits realized by Asus as a result of
`the infringing activities, within four weeks after this ruling has been served. This
`statement must be accompanied by a complete specification of:
`a) the number of infringing products produced, supported by all relevant
`documents;
`b) the number and purchase price of the infringing products supplied to Asus,
`supported by all relevant documents, including invoices;
`c) the number and sales price of the infringing products sold or otherwise
`delivered, supported by all relevant documents, including invoices;
`d) the number of the infringing products still in stock at the time the ruling to be
`rendered in this matter is served, supported by all relevant evidence;
