`1. An obligation in tort for infringement of an intellectual property right is deemed to be a
`legal relationship as referred to in Article 843a-
`2. ln proceedings pursuant to Section 843a the submission of other evidence under the
`control of the other party may also be demanded.
`3. The court shall reject the claim in so far as the protection of confidential information is
`not guaranteed. Section 843a (4) shall not apply.

`The following persons may appear as patent attorneys before the Office: persons
`registered as patent attorneys Ín the register specified in Section 23a; persons
`registered as attorneys before a district court in terms of Section 1 of the Attorney's
`Act; and persons who are registered as attorneys within the meaning of Article 1 of
`the National Attorneys Ordinance or section 1 of the BES Attorneys Act before the
`Common Court of Justice of Aruba, Curacao and Sint Maarten and of Bonaire, Sint
`Eustatius and Saba.

`The Director of the Office may demand inspection of the authenticated deed of the
`administration of his oath as an attorney before admitting him as an attorney before
`the Office.

`3. ln special circumstances, the Director of the Office may also allow others than those
`mentioned in paragraph 1 to act as attorneys before the Office, if they do not make
`such appearances their profession or if they are authorized to act as a patent
`attorney in a Member State of the European Union or in another state that is a party
`to the Agreement on the European Economic Area and they only appear before the
`Office in occasional cases.

`4. Unless otherwise under or pursuant to the law, a patent attorney or an individual working
`under such attorney's supervision, is obligated to observe confidentiality regarding all
`that of which the attorney becomes aware pursuant to his activities. This obligation
`remains in force after termination of the relevant activities.

`
`1. The District Court of The Hague has exclusive jurisdiction at the first instance for:
`
`a. claims to establish the absence of legal effect, annulment, establishíng a loss of
`legal effect or laying claim to patents, as defined in sections 10,75,77 and78
`respectively;
`
`b. claims laying claim to European patent applications;
`
`c. claims for the award of a license as defined in section 85.1 ;
`
`d. claims to establish a payment as defined in sections 58, 59 and 60.

`2. The District Court of The Hague and the interim relief judge at that Court have
`exclusive jurisdiction in the first instance in the Netherlands for:

`certain actions he has undertaken are not in breach of a patent.

`a. A Member will observe complete confidentiality in relation to information of a
`confidential nature that the Member knows or reasonably ought to know is
`confidential and that he has received in his capacity as a patent attorney, unless the
`Member is absolved of his duty of confidentiality.
`A Member is automatically relieved of his duty of confidentiality if the confidential
`information is published.
`At all times, a Member will devote the requisite time and attention to the work
`entrusted to him by a Client and will perform that work with the requisite expertise. A
`Member will keep the Client appraised of the progress of the case.
`ln principle, a Member need not serve the interests of a Client in cases that are not
`connected to the work entrusted by the Client to that Member as a patent attorney.
`lf a Member is unwilling to accept instructions or if he wishes to terminate his
`services relating to an ongoing matter, he will notify the Client of this immediately. ln
`the latter situation, the Member will take such steps as are required to ensure that the
`Client does not suffer any detriment.
`A Member is obliged to refuse or return an instruction if acting or continuing to act on
`it would necessarily be in conflict with interests that he is representing or has
`represented for a different Client or on which he has given advise.
`A Member will not take any action against a case being dealt with by the Member or
`another member who is collaboratively associated with the Member, unless the Client
`has given express consent for this in the particular case, or if the Member knows
`nothing about that case and cannot find out about that case except from publicly
`available sources. A Member is not permitted to use any information for such a case
`that originates from the Client and that is not in the public domain.
`A Member will decline any instruction that is in conflict with his own interests. lf, in
`such a situation, performing the instruction cannot be deferred without the potential
`for detriment to the Client, the Member shall accept the instruction and perform it as
`far as is immediately required to prevent the potential detriment; thereafter the
`Member will renounce the mandate in the case.
`A Member will not acquire any financial interest in any industrial property right if this
`would give rise to a potential conflict between his professional duties and that
`interest.
`A Member will send to his Client a clear and detailed bill for services rendered.

`
`1. Een ieder, daartoe op wettige wijze opgeroepen, is verplicht getuigenis af te leggen.
`
`2. Van deze verplichting kunnen zich verschonen:
`
`a. de echtgenoot en de vroegere echtgenoot dan wel de geregistreerde
`partner en de vroegere geregistreerde partner van een partij, de bloed- of
`aanverwanten van een partij of van de echtgenoot of van de
`geregistreerde partner van een partij, tot de tweede graad ingesloten, een
`en ander tenzij de partij in hoedanigheid optreedt,
`
`b. zij die tot geheimhouding verplicht zijn uit hoofde van hun ambt, beroep of
`betrekking omtrent hetgeen hun in die hoedanigheid is toevertrouwd.
`
`3. De getuige kan zich verschonen van het beantwoorden van een hem gestelde vraag,
`indien hij daardoor of zichzelf, of een van zijn bloed- of aanveruranten in de rechte lijn
`of in de zijh1n in de tweede of derde graad, of zijn echtgenoot of vroegere echtgenoot
`onderscheidenlijk zijn geregistreerde partner of vroegere geregistreerde partner aan
`het gevaar van een strafrechtelijke veroordeling ter zake van een misdrijf zou
`blootstellen.

`Artikel 843a
`1. Hij die daarbij rechtmatig belang heeft, kan op zijn kosten inzage, afschrift of
`uittreksel vorderen van bepaalde bescheiden aangaande een rechtsbetrekking
`waarin hij of zijn rechtsvoorgangers partij zijn, van degene die deze bescheiden te
`zrjner beschikking of onder zijn berusting heeft. Onder bescheiden worden mede
`verstaan: op een gegevensdrager aangebrachte gegevens.
`
`2. De rechter bepaalt zo nodig de wijze waarop inzage, afschrift of uittrekselzal
`worden verschaft.
`
`3. Hr1 die uit hoofde van zijn ambt, beroep of betrekking tot geheimhouding verplicht is,
`is niet gehouden aan deze vordering te voldoen, indien de bescheiden uitsluitend
`uit dien hoofde te zijner beschikking staan of onder zijn berusting zijn.
`
`4. Degene die de bescheiden te zijner beschikking of onder zijn berusting heeft, is niet
`gehouden aan deze vordering te voldoen, indien daarvoor gewichtige redenen zijn,

`alsmede indien redelijkenruijs aangenomen kan worden dat een behoorlijke

`Een verbintenis uit onrechtmatige daad wegens inbreuk op een recht van
`intellectuele eigendom geldt als een rechtsbetrekking als bedoeld in artÍkel 843a.
`
`ln de procedure op de voet van artikel 843a kan ook overlegging gevorderd worden
`van ander bewijsmateriaal dat zich in de macht van de wederpartij bevindt.
`
`De rechter wijst de vordering af voor zover de bescherming van vertrouwelijke
`informatie niet is gewaarborgd. Artikel 843a, vierde lid, is niet van toepassing.

`
`1. Voor het bureau kunnen als gemachtigde slechts optreden personen die als
`octrooigemachtigde zijn ingeschreven in het register, bedoeld in artikel 23a,
`personen die op grond van artikel 1 van de Advocatenwet als advocaat zijn
`ingeschreven bij een rechtbank en personen die op grond van artikel 1 van de
`Advocatenlandsverordening of artikel 1 van de Advocatenwet BES als advocaat zijn
`ingeschreven bij het Gemeenschappelijk Hof van Justitie van Aruba, Curagao en Sint
`Maarten en van Bonaire, Sint Eustatius en Saba.
`
`2. De directeur van het bureau kan van een advocaat inzage vorderen van de
`geviseerde akte van zijn beëdiging als advocaat voordat hij hem als gemachtigde
`voor het bureau toelaat.
`
`3. De directeur van het bureau kan in bijzondere gevallen ook anderen dan de
`personen, bedoeld in het eerste lid, toestaan als gemachtigde voor het bureau op te
`treden, indien zijvan een dergelijk optreden niet hun beroep maken of indien zij in
`een lidstaat van de Europese Unie of in een andere staat die partij is bij de
`Overeenkomst betreffende de Europese Economische Ruimte bevoegd zijn om als
`gemachtigde in octrooizaken op te treden en zij slechts in incidentele gevallen als
`gemachtigde voor het bureau optreden.
`
`4. Tenzij bij of krachtens wet anders is bepaald, is een octrooigemachtigde of een
`persoon die onder zijn verantwoordelijkheid werkzaam is, verplicht tot
`geheimhouding van al hetgeen waarvan hr1 uit hoofde van ziinwerl<zaamheden als
`zodanig kennis neemt. Deze verplichting blijft bestaan na beëindiging van de
`desbetreffende werkzaam heden.
`
`Artikel 80
`
`1. De rechtbank Den Haag is in eerste aanleg uitsluitend bevoegd voor:
`
`a. vorderingen tot vaststelling van ontbreken van rechtsgevolg, vernietiging,
`vaststelling van een verlies van rechtsgevolg of opeising van octrooien, bedoeld
`in onderscheidenlijk de artikelen 10,75,77 en78',
`
`b. vorderingen tot opeising van Europese octrooiaanvragen;

`c. vorderingen tot verlening van een licentie als bedoeld in artikel 58, eerste lid;

`2. De rechtbank Den Haag en de voorzieningenrechter van die rechtbank zijn in eerste
`aanleg in Nederland uitsluitend bevoegd voor:
`
`a. vorderingen, bedoeld in de artikelen 70, 71,72 en 73;
`
`b. vorderingen welke worden ingesteld door een ander dan de octrooihouder ten
`einde te doen vaststellen dat bepaalde door hem verrichte handelingen niet
`strijdig zijn met een octrooi.

`Bij de behandeling ter zitting van geschillen bedoeld in artikel 80 mogen
`octrooigemachtigden het woord voeren onverminderd de verantwoordelijkheid van de
`advocaat.

`4. Relatie tot Cliënten
`
`a. Een Lid betracht volstrekte geheimhouding over informatie van vertrouwelijke aard
`waarvan het Lid de vedrouwehlkheid kent of redelijkerwijze behoort te kennen en die
`het in zijn hoedanigheid van octrooigemachtigde heeft ontvangen, tenzij het Lid van
`zijn geheimhoudingsplicht is ontslagen.
`b. Een Lid wordt automatisch ontheven van zijn geheimhoudingsplicht als de geheime
`informatie is gepubliceerd.
`c. Een Líd besteedt te allen tijde de vereiste zorg en aandacht aan het werk dat hem is
`toevertrouwd door een Cliënt en voert dit werk met de vereiste deskundigheid uit.
`Een Lid houdt de Cliënt op de hoogte van de stand van zaken.
`d. ln principe hoeft een Lid niet de belangen van een Cliënt te dienen in zaken die geen
`verband houden met het werk dat aan het Lid als octrooigemachtigde door de Cliënt
`is toevertrouwd.
`e. lndien een Lid een opdracht niet wil aanvaarden of indien het zijn dienstverlening
`inzake een lopende opdracht wil beëindigen, deelt het dit onverwijld aan de Client
`mede. ln het laatste geval treft het Lid de nodige maatregelen om de Cliënt in staat te
`stellen nadeel te vermijden.
`f. Een Lid is verplicht een opdracht te weigeren of terug te geven indien de
`behandeling of voortzetting daarvan noodzakelijkenruijs conflicteert met belangen die
`het voor een andere Cliënt behartigt of heeft behartigd of waarover het heeft
`geadviseerd.
`g Een Lid onderneemt geen actie tegen een zaak die behandeld wordt of behandeld is
`door het Lid of een Lid uit een samenwerkingsverband van het Lid, tenzij de Cliënt in
`deze zaak daarvoor uitdrukkelijk toestemming geeft, of het Lid geen kennis heeft van
`deze zaak en daarvan ook geen kennis kan nemen anders dan uit openbaar
`toegankelijke bronnen. Het is het Lid ook niet toegestaan om bij deze actie gebruik te
`maken van,van deze Cliënt afkomstige, niet openbare informatie.
`h. Een Lid weigert een opdracht die conflicteert met zijn eigen belangen. lndien in een
`dergelijk geval het uitvoeren van de opdracht niet kan worden uitgesteld zonder
`mogelijke schade voor de Cliënt, aanvaardt een Lid de opdracht en voert het deze uit
`voor zover dit onmiddellijk vereist is om de mogelijke schade te voorkomen; daarna
`legt het Lid de volmacht in deze zaak neer.
`i. Een Lid venruerft geen financieel belang in enig industrieel eigendomsrecht indien dit
`aanleiding geeft tot een conflict tussen de beroepsplicht en dit belang.
`j. Een Lid zal zijn Cliënt een duidelijke en gespecificeerde factuur sturen voor verrichte
`diensten.
