2/14/2024MINUTE ENTRY ORDER FOR TELEPHONIC STATUS CONFERENCE held on 2/14/2024, before Magistrate Judge Hanly A. Ingram: On the call, the parties orally moved to continue all existing deadlines for approximately one month. According to the parties, they have an informal agreement to extend their February 12 deadline for written discovery responses to February 19. They anticipate having exchanged all written discovery by February 19. But they seek a continuation of the hearing (and all other deadlines) as a prophylactic matter to avoid potential deadline problems in the future and to tailor future discovery to the substance of the written responses. The parties anticipate needing five depositions, none of which are currently scheduled. And some deponents (and relevant documents) are in other countries. Concerning these depositions, available dates, with time zone complications, need to be determined. Counsel stated the existing deadlines could be met, but they would prefer a one-month extension. There are no current discovery disputes. Ingram: According to Petitioners counsel, the Court has discretion regarding the timing and extent of discovery and regarding the extent to which the Rules of Evidence will apply at the eventual hearing on this action under the Hague Convention on the Civil Aspects of International Child Abduction. Petitioner intends to utilize an expert on the laws of Norway. Petitioners counsel requested a hearing in the first quarter of 2024, preferably January.According to Respondent, there are child custody matters pending in Norway and in Whitley County, Kentucky. Respondent says the childs birth mother is Russian, and there may be evidence in this case in France, Morocco, Russia, and Norway. Respondents position is that full discovery under Rules 16 and 26 should be conducted, culminating in a hearing in July 2024.According to counsel, the parties and any experts will need to be deposed.
