4/4/2024197ORDER granting in part Defendant Correa's Motion to Sever (Doc. 189). Defendant Correa moves to sever her case from co-defendant Eckstein, vacate the trial date, and set this case for a status conference in mid-July 2024. On April 2, the Court accepted Eckstein's change of plea. Defendant Correa is the only remaining defendant in the case, and she is currently in the custody of Western District of Missouri for changes pending in that district. Via email, the parties agree that the motion to sever is now moot and the motion should be treated as a motion to vacate the trial date and set a status conference. Therefore, the Court grants in part and denies in part the motion. The Court denies the motion to sever as moot. The Court grants the motion to vacate the trial date and set a status conference. All trial deadlines and the hearing set in the Trial Order (Doc. 165) are vacated. The Court sets a Status Conference for July 23, 2024 at 9:00 a.m. in KC Courtroom 463 before District Judge Holly L. Teeter. Out of an abundance of caution, the Court also excludes the period of time between today and July 23, 2024 as excludable time under the Speedy Trial Act. Defendant Correa is currently outside the custody of the district, which has delayed the resolution of her case. Defendant Correa via email agrees to this exclusion of time. Signed by District Judge Holly L. Teeter on 4/4/2024. (This is a TEXT ENTRY ONLY. There is no.pdf document associated with this entry.) (md) (Entered: 04/04/2024)

5/18/2023121 ORDER regarding Motion for Release Pending Trial 120 . The court construes this as a motion to reopen detention pursuant to 18 U.S.C. § 3142(f)(2). The government's response to the motion must be filed no later than May 24, 2023. The parties should assume the court will decide the motion based on their written submissions unless the court believes a hearing would be helpful. Signed by Magistrate Judge Angel D. 5/12/2023119ORDER granting Motion to Continue Status Conference 118 . Defendant Wards, O'Connor, and Veliz-Davila move for a 45 to 60-day continuance of the May 16, 2023 status conference. Counsel notes that four rounds of discovery have been produced consisting of voluminous reports, audio recordings, and video recordings. Counsel need additional time to review and discuss this evidence with Wards, O'Connor, and Veliz-Davila and to work with the government on pretrial and trial scheduling options. Via email, Defendant Correa joins in the request. Via email, Defendant Quinn opposes the motion. Defendant Eckstein has entered his notice of intent to change plea. Defendants Wards, O'Connor, and Veliz-Davila (who are in custody) understands their respective rights under the Speedy Trial Act and understand that by agreeing to this schedule that the speedy trial time will be excluded through the next status conference. Via email, Defendant Correa (who is on release) understands the impact the continuance has on her speedy trial time and consents. Via email, the government does not oppose. The Court is also mindful of the instant charges, the indictment, and the record of this case. For all these reasons, the Court finds under the ends-of-justice provision of the Speedy Trial Act that the ends of justice served by allowing moving defendants and counsel time to accomplish the above tasks outweigh the best interests of the public and moving defendants in a trial beginning by the current speedy trial deadline. The Court continues the status conference to July 18, 2023, at 9:00 a.m. in KC Courtroom 463 before District Judge Holly L. Teeter and excludes the period of time between today and July 18, 2023 as excludable time under the Speedy Trial Act. Defendant Quinn does not join the motion. The Court finds that the time is also excluded under the co-defendant exception. Defendants are all charged in Count 1 of the Indictment with conspiracy to distribute methamphetamine. No motion to sever has been filed or even granted. And given the overlap in the charges, it is more efficient for the Court and the parties to keep this case on the same schedule at this time. But the Court cautions the parties that it will likely require an in-person hearing if another continuance is requested. Signed by District Judge Holly L. Teeter on 5/12/2023. 3/15/2023106ORDER granting Motion to Continue Status Conference 104 . Defendant Wards moves for a continuance of the March 21, 2023 status conference. Counsel needs additional time to review discovery and confer with the government in a good faith effort to resolve this case. Counsel has discussed the necessity of a continuance with Defendant Wards (who is in custody) as well as its impact on her speedy trial rights. Defendant Wards agrees. Via email, the government does not object to this continuance. The Court is also mindful of the instant charges, the indictment, and the record of this case. For all these reasons, the Court finds under the ends-of-justice provision of the Speedy Trial Act that the ends of justice served by allowing Defendant Wards and counsel time to accomplish the above tasks outweigh the best interests of the public and Defendant Wards in a trial beginning by the current speedy trial deadline. The Court continues the status conference to May 16, 2023, at 9:00 a.m. in KC Courtroom 463 before District Judge Holly L. 2/17/202387ORAL MOTION to Withdraw 77 Motion for Release Pending Trial by Ronald Quinn. (mam) (Entered: 02/17/2023)
2/17/202386ORDER granting Motions to Continue Status Conference 84 and 85 . Defendant Eckstein moves for a 90-day continuance of the February 21, 2023 status conference. Counsel needs additional time to review discovery. Counsel has consulted with co-defendants' counsel and co-defendants wish to join in the request. Defendants (who are all in custody), through counsel, have been appraised of their speedy trial rights and do not object to the tolling of speedy trial during the requested period. The government does not object to this continuance. The Court is also mindful of the current health situation, the instant charges, the indictment, and the record of this case. For all these reasons, the Court finds under the ends-of-justice provision of the Speedy Trial Act that the ends of justice served by allowing Defendants and counsel time to accomplish the above tasks and by protecting public health and safety outweigh the best interests of the public and Defendants in a trial beginning by the current speedy trial deadline. The Court continues the status conference to May 16, 2023, at 9:00 a.m. in KC Courtroom 463 before District Judge Holly L. Teeter and excludes the period of time between today and May 16, 2023 as excludable time under the Speedy Trial Act. This time is also excludable under the co-defendant exception. Defendants are all charged in Count 1 of the Indictment with conspiracy to distribute methamphetamine. No motion to sever has been filed or even granted. And given the overlap in the charges, it is more efficient for the Court and the parties to keep this case on the same schedule at this time. But the Court may likely require an in-person hearing if another continuance is requested. Signed by District Judge Holly L. Teeter on 2/17/2023. (This is a TEXT ENTRY ONLY. 12/27/202262ORDER granting Motion to Continue Status Conference 61 . Defendant Eckstein moves for a continuance of the January 13, 2023 status conference. Counsel consulted with the government and both parties request the case be continued to February 21 when all his co-defendants are scheduled (See Doc. 51). Counsel has talked with Defendant about this request, and he has no objection. Via email, Counsel confirms that Defendant (who is in custody) was informed about his speedy trial rights, he understands those rights, and agrees to extend his speedy trial deadline through the status conference. The government does not object to this request. The Court is also mindful of the current health situation, the instant charges, the indictment, and the record of this case. For all these reasons, the Court finds under the ends-of-justice provision of the Speedy Trial Act that the ends of justice served by allowing Defendant and counsel time to accomplish the above tasks and by protecting public health and safety outweigh the best interests of the public and Defendant in a trial beginning by the current speedy trial deadline. 11/10/202251ORDER granting Motion to Continue Status Conference 50 . Defendant Quinn moves for an approximate 90-day continuance of the November 15, 2022 status conference. Counsel notes that he has begun the process of going through the discovery with Defendant Quinn, but, because of the volume of discovery in this case, additional time necessary to determine a relevant and workable schedule for motions deadlines and trial. Also, additional discovery from the government is still forthcoming. Defendant Quinn (who is on release and in treatment) has been advised of his right to a speedy trial, has reviewed the provisions of the speedy trial right, and understands that if granted the Court would exclude any time toward Defendant Quinn's speedy trial computation. Defendant Quinn believes it is in his best interest to waive his speedy trial rights. Counsel for co-defendants O'Conner (who is in custody) and Correa (who is on release) has confirmed that their clients have no objection to the continuance, would join the Motion, and have reviewed the applicable speedy trial provisions with their client, and understand and waive the same. Counsel for co-defendant Veliz-Davila (who is in custody) has confirmed that her client does not wish to join to request for continuance and desires to assert his speedy trial rights in this case. Co-defendants Eckstein and Wards have yet to appear. The government does not oppose the requested continuance. The Court is also mindful of the current health situation, the instant charges in the indictment, and the record of this case.
