`EXPEDITED JOINT MOTION TO STAY PENDING FILING
`OF A MOTION TO TERMINATE INVESTIGATION
`
`Complainant Apple Inc. (“Apple” or “Complainant”) and Respondent Motorola Mobility
`
`LLC (“Motorola” or “Respondent”) move to stay the above-identified Investigation for ten days,
`
`up to and including Wednesday, May 28, 2014. Good cause exists to stay the Investigation
`
`because Apple and Google Inc. (“Google”), the parent company of Motorola, have reached an
`
`agreement that resolves the existing dispute between Apple and Motorola that is the subject
`
`matter of this Investigation. Apple and Motorola will therefore be filing a joint motion to
`
`terminate the Investigation, and respectfully request the Administrative Law Judge stay the
`
`current proceedings so that the parties can finalize the joint motion to terminate.
`
`The requested stay will conserve the resources both of the parties and of the Commission.
`
`Similar requests for stays of Section 337 investigations have been granted under such
`
`circumstances. See Certain Amino Fluoro Ketone Compounds, Inv. No. 337-TA-425, Order No.
`
`7 (March 3, 2000); see also Certain SDRAMs, DRAMs, ASICs, RAM And Logic Chips,
`
`Microprocessors, Microcontrollers, Processes for Manufacturing Same and Products
`
`Containing Same, Inv. No. 337-TA-404, Order No. 24 (August 13, 1998); Certain Breath Test
`
`Systems For the Detection of Gastrointestinal Disorders and Components Thereof, Inv. No. 337-
`
`TA-495, Order No. 3 (August 26, 2003).

`
`Pursuant to Ground Rule 3.2, Apple and Motorola provided notice of this motion to the
`
`Commission Investigative Staff (“Staff”). The Staff indicated that it does not oppose this
`
`motion.
`
`Accordingly, Apple and Motorola jointly request stay of this Investigation while the
`
`parties prepare the Joint Motion to Terminate.
`
