`Pursuant to Ground Rule 8, Respondent Motorola Mobility, Inc. ("Motorola")

`respectfully submits this Pre-Hearing Statement.
`
`I.
`
`WITNESSES
`
`Pursuant to Ground Rule 8(b), attached as Exhibit A is a list of the names of all witnesses
`
`that Motorola expects to call to appear and testify live at the hearing, based on its current
`
`understanding of Apple's case-in-chief, in the order they are expected to testify (witnesses who
`
`may appear by deposition only are not listed). Motorola lists its own witnesses as well as certain
`
`third party witnesses whom Motorola may call at the hearing. Motorola understands that Apple
`
`will list its own witnesses in its prehearing statement. Motorola reserves the right to call and
`
`question any witness called by Apple. The address and area of expertise, and a synopsis of
`
`expected testimony, is also included for each witness named in Exhibit A.
`
`Pursuant to Ground Rule 8(j), attached as Exhibit B is Motorola's current estimates of the
`
`date and approximate length of appearance for the live witnesses at the hearing. The sequence
`
`and duration for Apple witnesses are based on Motorola's best estimate given the information
`
`available at this time, and may not necessarily reflect the final sequence and time estimates
`
`submitted by Apple in its Pre-Hearing Statement. Although time estimates are listed as "cross"
`
`and "redirect" in light of the submission of direct testimony through witness statements, the
`
`estimates include information about the parties' current estimates for time for adverse direct. The
`
`sequence and duration of the witnesses' testimony may also change depending on the parties'
`
`continued discussions.
`
`Because Motorola cannot anticipate all the rebuttal witnesses that it may call at the
`
`hearing, Motorola reserves its right to amend this witness list, including the addition and/or
`
`removal of witnesses, and the modification of the order and/or estimated length of testimony in
`
`which the witnesses may be called to testify, if events during the hearing so require.

`EXHIBITS
`
`Pursuant to Ground Rule 8(c), attached as Exhibit C is the current list of Respondent's
`
`exhibits that Motorola may seek to introduce at the hearing. Motorola understands that Apple
`
`will submit the preliminary joint exhibit list with its prehearing statement. Pursuant to the
`
`amended procedural schedule (Order No. 9), the parties will submit final prehearing direct and
`
`rebuttal exhibits, including joint exhibits, by September 12, 2011. Motorola expressly reserves
`
`its right to identify additional exhibits and to withdraw exhibits from its own list. Motorola also
`
`expressly reserves its right to use exhibits identified on any exhibit list submitted by any party,
`
`newly produced information, and any additional documents. The parties will continue to revise
`
`the Joint Exhibit List.

`Pursuant to Ground Rule 8(d), the parties met and conferred regarding stipulations.

`The parties have agreed to enter a stipulation, for purposes of this Investigation only, that
`
`the document produced by Motorola bearing Bates number MOTO-APPLE-

`0006037953_102692, (RX-351) is a true and correct copy of Apurva Mahendra Desai,
`
`Interpretation of Tactile Data from an FSR Pressure Pad Transducer Using Image Processing
`
`Techniques, Master's Thesis, Simon Fraser University, Canada (Nov. 1994), and it was publicly
`
`available prior to January 24, 1997.

`IV. CLAIM CONSTRUCTION
`
`Motorola's positions on claim construction, pursuant to Ground Rule 8(e), are stated in

`the Pre-Hearing Brief filed concurrently with the Office of the Secretary. Motorola is prepared
`
`to address claim construction issues at the hearing pursuant to any instructions by the ALJ.

`In its Pre-Hearing Brief filed concurrently herewith, Motorola has set forth in detail the

`issues to be considered at the hearing, and Motorola's contentions thereon, pursuant to Ground
`
`Rule 8(f).

`VII. PROPOSED AGENDA FOR THE PRE-HEARING CONFERENCE
`
`Pursuant to Ground Rule 8(i), Motorola proposes the following agenda for the pre-
`
`hearing conference scheduled for September 23, 2011:
