`POST-TRIAL BRIEFING EXHIBITS

`WHEREAS the time for filing Defendants’ post-trial motions under Rule 50 and Rule 59
`
`and any other of Defendants’ post-trial motions is April 5, 2024 (D.I. 709);
`
`WHEREAS the CERT Defendants (“CERT”) plan to file post-trial motions on April 5,
`
`2024 (“Anticipated CERT Motions”) which Plaintiffs Midwest Energy Emissions Corp. and MES
`
`Inc. (collectively, “ME2C”) will oppose;
`
`WHEREAS the Parties have discussed the logistics of filing exhibits and trial transcripts,
`
`and agree that it would be most convenient for the Court if the Parties jointly submit all exhibits
`
`referenced in the briefing for the Anticipated CERT Motions in a joint appendix that would be
`
`filed at the conclusion of briefing;
`
`IT IS HEREBY STIPULATED AND AGREED by the Parties through their undersigned
`
`counsel, subject to the approval of the Court, that the exhibits and trial transcripts referenced in
`
`the Parties’ briefs regarding the Anticipated CERT Motions will be filed together in a joint
`
`appendix at the conclusion of briefing.
