`This matter was assigned for arbitration pursuant to C.G.S. §52-549(u) and was heard

`by the undersigned Arbitrator at Hartford Superior Court on October 26, 2018. After
`
`hearing the evidence presented, and reviewing the exhibits submitted, the following
`
`facts are found:

`PLEADINGS
`
`The two count complaint alleges negligence in the operation of a motor vehicle which
`
`struck the motorcycle operated by the plaintiff on April 27, 2017. Count one is against
`
`the operator and count two against the owner.
`
`FACTS
`
`The vehicles were traveling side by side when the Defendant drifted from the left
`
`lane, striking the Plaintiff who was in the right lane.
`
`LIABILITY
`
`For purposes of these proceedinggzliagilfifis fiat thméd and the defendants

`are liable for the injuries to the plaintiff.

`INJURY
`
`Plaintiff went by ambulance to Hartford Hospital. He suffered lacerations and al
`
`left
`
`elbow injury. He developed lumbar pain that radiated into his leg.
`
`DAMAGES
`
`Plaintiffs damages exceed the limitation of $50,000.00 in the arbitration program. His
`
`medical specials alone are $37,962.86.
`
`The parties agree that damages exceed
`
`$50,000.00 and that under that circumstances it would be inappropriate to enter an
`
`award in this proceeding.
