`
`NORTHERN DISTRICT OF CALIFORNIA
`
`SAN JOSE DIVISION
`
`SYNOPSYS, INC.,
`
`Plaintiff,
`
`v.
`
`REAL INTENT, INC.,
`
`Defendant.
`
`Case No. 5:20-cv-02819-EJD
`
`ORDER RE COPYRIGHTABILITY
`HEARING; DENYING MOTION TO
`SEAL
`
`
`Re: ECF Nos. 179, 180, 181
`
`
`
`
`
`Before the Court is Defendant Real Intent, Inc.’s request for the Court to hold a
`
`copyrightability hearing, which Plaintiff Synopsys, Inc. opposes. Real Intent made its request at
`
`the Trial Setting Conference held on May 4, 2023, and the Court called for additional briefing.
`
`ECF No. 173. Having considered the parties’ arguments at hearing and in their briefs (ECF Nos.
`
`180, 181), the Court finds that a copyrightability hearing is not warranted and DENIES Real
`
`Intent’s request. Closer to trial, the Court will decide on the best procedure for addressing
`
`copyrightability, with the input of the parties.
`
`The Court also DENIES Synopsys’s motion to seal its brief regarding the propriety of a
`
`copyrightability hearing (ECF No. 179), because Synopsys sought to seal information designated
`
`as confidential by Real Intent, but Real Intent does not oppose unsealing (ECF No. 186).
`
`Accordingly, the Clerk is directed to unseal ECF No. 179-2.
`
`IT IS SO ORDERED.
