`Ancora timely filed its Court-ordered report/surreply to TCL’s motion to dismiss. See
`
`Docket No. 42; see also Docket No. 41 (April 9, 2020 Minute Order, directing filing of same).
`
`Ancora states that the parties conducted a telephonic meet and confer on April 13, 2020, and
`
`“[b]ased on this conference, the parties believe that all issues raised in TCL ’s motion have been
`
`resolve .” Docket No. 42 at l (emphasis in original). Ancora also responds to each of the
`
`questions posed in the Court’s April 9, 2020 Minute Order and explains why it believes them to
`
`be resolved either by Ancora’s proposed second amended complaint or its recently-served
`
`infringement contentions. See generally id; see also Docket No. 42—1 (proposed second amended
`
`complaint).
`
`Having reviewed the parties’ submissions, and given Ancora’s representation that the
`parties have resolved all issues relating to TCL’s motion to dismiss, the Court DENIES TCL’s
`motion to dismiss mocket No. 37) AS MOOT. The Court finds that good cause warrants
`permitting Ancora to amend its operative pleading to memorialize the parties’ agreement. The
`Court ORDERS Ancora to file its proposed second amended complaint mocket No. 42-1) as the
`operative pleading in this case by April 23, 2020. The hearing on TCL’s motion to dismiss set for
`Monday, April 20, 2020 is VACATED.
