5/8/2024ORDER REGARDING DEFENDANT'S MOTION TO DISMISS [ECF No. 24 ] by Judge John W. Holcomb. For the foregoing reasons, the Court hereby ORDERS as follows: BTL's Motion is DENIED without prejudice. The hearing on BTL's Motion currently set for May 10, 2024, is VACATED. The parties are DIRECTED forthwith to engage in another L.R. 7-3 Conference of Counsel regarding the alleged infirmities in the Complaint. InMode is DIRECTED to file an amended pleading, if at all, no later than May 31, 2024. If InMode chooses to file an amended pleading, then it is also DIRECTED to file contemporaneously therewith a Notice of Revisions to Complaint that provides the Court with a redline version that shows the amendments. BTL is DIRECTED to file its response to InMode's operative pleading no later than June 14, 2024. take this opportunity to incorporate the jurisdictional discovery that it conducted, to consider carefully BTL's criticism of its pleading, and to present its best pleaded claims, as the Court will be unlikely to grant further leave to amend. For the foregoing reasons, the Court hereby ORDERS as follows: BTL's Motion is DENIED without prejudice. The hearing on BTL's Motion currently set for May 10, 2024, is VACATED.
