`NO. 7,088,233
`
`On November22, 2022, the Court entered an orderclarifying that its
`September 2, 2022 Order (Dkt. 166) operated to sever into a new action the claims
`in this action relating to U.S. Patent No. 7,088,233 (the “’233 Patent”). See Dkt.
`174. This Order provides further instructions for the Clerk of Court regarding the
`direction to assign a new case numberand docketto the claims in 19-06301-AB-
`KSxcase relating to the ’233 Patent. The Clerk is directed to open a separate civil
`action listing the same case caption andparties as in 19-06301-AB-KSx, which
`shall be assigned to the same judge to whomthis case is assigned. Nofiling fee
`for opening a new action is due. After the new case is opened, the Clerk is
`directed to file a copy of Dkt. 174 from this case, as well as a copy ofthis Order,
`on the docket of the new case. After those filings are completed, the Court will
`issue an orderdirecting the parties to re-file the existing operative pleadings in the
`new case.
