They also agreed that either party could apply to a Pennsylvania state or federal court for interim or emergent relief “in the event of an emergent issue.” (Id.) In or around January 2024, Balanced Bridge commenced an arbitration action against the SCM with AAA on the question of the SCM’s efforts to collect an award.
Citing the contractual provision for jurisdiction in a federal court for an emergent issue, the SCM has moved here for a stay of that arbitration.
The SCM contends that the arbitration proceeding should be stayed based upon demands he expects Balanced Bridge to make of him in his pursuit of a monetary award under this Settlement.2 He also fears that Balanced Bridge will use the arbitration process to rewrite the terms of their Funding Agreement, suggesting 2 The SCM had not received a monetary award as of the time he filed his motion to stay the arbitration proceeding.
that Balanced Bridge is attempting “to control or curtail” his rights in the process by which he prepares and submits a claim under the Settlement.
AND NOW, this 11TH day of March, 2024, it is ORDERED that the Motion to Stay Arbitration in AAA Case No. 01-23-0004-8971 (ECF No. 12375) is DENIED.

Memorandum Opinion, the funds currently withheld for counsel fees and costs for the above- referenced Settlement Class Member from the Monetary Award approved on September 6, 2022 are APPORTIONED as follows: 1.
Of the remaining funds currently withheld by the Claims Administrator for distribution of counsel fee at present, as well as the 5% portion of R.B.’s Monetary Award that is currently withheld in the Attorneys’ Fees Qualified Settlement Fund pursuant to the Court’s June 27, 2018 Order Regarding Withholdings for Common Benefit Fund (Doc. No. 10104), to the extent any of these funds are later released for payment to individual attorneys: a. 10/22nds is allocated to Pope McGlamry PC as attorney’s fees; and b.
IT IS FURTHER ORDERED that the Claims Administrator disburse the withheld funds in accordance with this allocation, the provisions of the Settlement Agreement, and all Court Orders regarding implementation.
