Document Belcalis Almanzar v. Latasha Kebe, et al, 22-12512, No. 27 (11th Cir. Mar. 21, 2023)
One is whether the jury had suf- ficient evidence to hold appellants—Latasha Kebe and others—lia- ble for defamation (and other privacy torts) against appellee Belcalis Almanzar (better known as ‘Cardi B’).
When a party fails to invoke these rules in the district court, we “ha[ve] no au- thority to consider [an] appeal from the jury verdict.” Hi Ltd. P’ship v. Winghouse of Fla., Inc., 451 F.3d 1300, 1302 (11th Cir. 2006).
USCA11 Case: 22-12512 Document: 27-1 Date Filed: 03/21/2023 Page: 4 of 5 Opinion of the Court sufficiency of the evidence on appeal, she seems to think that one can preserve that right by making no insufficiency motions at all.
“An appellant’s brief must include an argument containing ‘appellant’s contentions and the reasons for them, with citations to the author- ities and parts of the record on which the appellant relies.’” Singh v. U.S. Atty.
USCA11 Case: 22-12512 Document: 27-1 Date Filed: 03/21/2023 Page: 5 of 5 Opinion of the Court not fully briefed (let alone not presented at all) to the Circuit Court, evaluating its merits would be improper both because the appel- lants may control the issues they raise on appeal, and because the appellee would have no opportunity to respond to it.” Access Now, Inc. v. Sw. Airlines Co., 385 F.3d 1324, 1330 (11th Cir. 2004).

4 R214 is a Transcript of Jury Trial, Volume VII of X. USCA11 Case: 22-12512 Document: 14 Date Filed: 08/29/2022 Page: 16 of 45 via social media to notify her that Jones was lying about living with Plaintiff.
Dr. Blake titled that report Therapeutic Coaching Summary and noted, in the first paragraph, that sessions were conducted to determine barriers that may interfere with Plaintiff achieving her career goals.
Because the evidence showed the Defendants did not act with a reckless disregard for the truth, Plaintiff should not have recovered damages for USCA11 Case: 22-12512 Document: 14 Date Filed: 08/29/2022 Page: 30 of 45 defamation or false light invasion of privacy.
There was no evidence that any of Ms. Kebe’s stories about Plaintiff were fabricated by Ms. Kebe, a product of Ms. Kebe’s imagination, based wholly on an unverified anonymous call, or so inherently improbable that only a reckless person would have put them in circulation.
Emotional distress includes all highly unpleasant mental reactions such as fright, horror, grief, shame, humiliation, embarrassment, anger, chagrin, disappointment, worry, and nausea.
