Upon the Affidavit of Peter Steensen, sworn to on April 26, 2012, the Affidavit of Natasha Leshanski, sworn to on April 26, 2012, the Affirmation of David A. Wolf, Esq, of Steven Landy & Associates, PLLC, attorneys of record for the Defendant 133 East 65“] Street Associates LLC, affinned on Aprii 27, 2012, the exhibits annexed thereto, and upon all the pleadings and proceedings heretofore had herein, LET the Plaintiff PK Restaurant, LLC or their attorneys Show cause at Part 63, Room 311, of this Court to be held at the courthouse located at 71 Thomas Street, New York, New York on the day of May, 2012, at 9:30 am in the forenoon of that day, or as soon thereafter as counsel may ' be heard, why an order should not be granted and entered:
pursuant to CPLR 2221, granting the Defendants leave to renew and reargue their opposition to the Plaintiff’s motion for a mandatory preliminary injunction restoring the Plaintiff to possession of the subject premises; and
upon granting of the motion for leave to renew and/or reargue, pursuant to CPLR 2221, vacating the Court’s April 25, 2012 Decision which granted Plaintiff’ s motion for a mandatory preliminary injunction restoring the Plaintiff to possession of the subject premises; and (iii) upon renewal and reargument, denying the Plaintiff‘s motion in its entirety.
SUFFICIENT CAUSE APPEARING THEREFOR, it is hereby ORDERED, that pending the hearing on this motion, all efforts by the Plaintiff to enforce the Court’s April 25, 2012 order and to reenter possession of the subject premises are hereby stayed.
ORDERED, that Plaintiff’s opposition papers, if any, shall be served by personal delivery upon moving Defendant’s counsel at least two business days in advance of the return date of this motion.
