Having considered all written and oral arguments the Referee recommendsthat the Court enter the following Order.
Consequently Lyft is entitled to obtain records and evidence of preexisting physical and mental injuries in order to explore alternative sources for Plaintiffs’
The Referee previously considered these issues in 2021 and implemented a procedure that counsel report has generally functioned smoothly.
For example,if a plaintiff claims ongoing depression and sleeplessness from the alleged Lyft incident, records of past treatment for an eating disorder might well not be relevant.
Recordsviolative of Plaintiffs’ rights under CCP §2017.220(a) shall not be delivered to Lyft counsel withoutstipulation or noticed motion.
