For the reasons stated on the record, the DPPs’ motion for disbursement of funds is granted.
There is no need to give the class notice of the motion in light of the relatively small size of the funds at issue.
At the hearing, the DPPs provided additional information in support of the request for disbursement – e.g., explaining that Dr. Lamb’s office spent more than 300 hours on distribution- related work due to issues related to complexities in the assignments of interests and the different groups of drug claims at issue.
Finally, at the hearing, the DPPs provided some explanation as to why there was a delay in the distribution of funds (which were held in an interest-bearing account).

Having considered the Direct Purchaser Class Plaintiffs’ Motion to Disburse BMS Settlement Funds for BMS Settlement Administration Expenses, filed by KPH Healthcare Services, Inc. a/k/a Kinney Drugs, Inc., on behalf of itself and the BMS DPP Settlement Class, the Court GRANTS the motion and ORDERS the Escrow Agent, Computershare Trust Company, N.A., to disburse from the BMS Settlement Fund:
to reimburse Dr. Lamb for expenses incurred in administering the BMS Settlement, in the amount of $131,721.50; and to reimburse KCC for expenses incurred in administering the BMS Settlement, in an amount not to exceed $30,669.89.
