THIS MATTERcoming on regularly for hearing on the 17" day of December, 2021, the Petitioner being represented by Russell A. Knight of Smith Alling, P.S., the Court having previously entered an Order Fixing Time for a hearing on this Petition, and said order prescribed the mannerin which notice of these proceedings was to be served on each ownerofproperty abutting Ohop Lake, the Director of Ecology and the Director of Fish and Wildlife, and the Court having considered the evidence offered by the Petitioner throughits attorney, Russell A. Knight at the hearing, and the Court having entered its Findings of Fact and Conclusions of Law in favor of the Petitioner, and otherwise being fully advised in the premises, NOW, THEREFORE,it is hereby ORDERED that Ohop Lake ImprovementClub, Inc., shall act as the representative of the abutting property owners of Ohop Lake, and enterinto the contracts, and otherwise perform the actions herein authorized on behalf of the abutting property owners of Ohop Lake; it is further * 2 3 4 a u w 6 eo m t
ORDEREDthat Ohop Lake ImprovementClub,Inc., on behalf of the abutting property owners on Ohop Lake shall employ a qualified aquatic weed control expert to undertake the treatment, or other weed control techniques and measures, of Ohop Laketo suppress weed and algae growth and that of other objectionable matter in Ohop Lake by use of Environmental Protective Agency registered materials, close the Lake as directed by the label requirements of the materials used, and to employ such engineering and scientific consultants as are selected by the Board of Directors of the Petitioner for scientific and engineering studies necessary and convenientto effect solutions to weed and algae problems on the Lake, andto treat and study Ohop Lake, and for the Petitioner to take such other actions or weed control techniques or measures as are necessary or useful in the furtherance of the preservation of the uses of Ohop Lake subject to the Washington State Department of Ecology’s right to control pollution; it is further | ORDEREDthat the cost of such treatment, the costs and expenses of bringing this Petition and the other actions herein authorized, and the proper compensationofpublic officials for their services shall be apportioned amongthe persons whose property abuts on Ohop Lake, in proportion to the lineal feet owned by each, which sum shall constitute a lien against the real property, and shall be paid to the County Treasurer, and by him placed in a special fund known as the “Ohop Lake Weed Removal Fund,” said amounts owing by the abutting property owners to be due, delinquent, and carry the sameinterest and penalties as the amounts due for general taxes; it is further ORDEREDthatthe Treasurer of Pierce County shall collect the sum of $10,448.00, by levy of an assessment against the property owners abutting Ohop Lake as hereinabovestated, oo eI ig ro ty
