No. 38 ORDER re Parties' 37 Notice of Settlement Offer and Joint Motion for 60-Day Stay

Document United States Securities and Exchange Commission v. Dragonchain Inc et al, 2:22-cv-01145, No. 38 (W.D.Wash. Oct. 29, 2024)
Plaintiff United States Securities and Exchange Commission (“SEC”) and Defendants Dragonchain, Inc., Dragonchain Foundation, The Dragon Company, and Joseph J. Roets (collectively, “Defendants”) (together, with the SEC, “Parties”) hereby notify the Court that as a result of a mediation with an outside mediator that occurred on October 7, Defendants have made a settlement offer that SEC staff members plan to recommend to the SEC’s Commissioners.
Accordingly, the Parties respectfully request a stay of this case for approximately 60 days, until December 20, 2024, so that SEC staff can prepare the necessary recommendation to the SEC’s Commissioners.
If the SEC’s Commissioners vote to accept Defendants’ settlement offer, counsel will file the appropriate proposed papers that would reflect a settlement of all outstanding issues in this litigation by no later than December 20, 2024.
The Parties will submit a joint status report on or before December 20, 2024, if the SEC’s Commissioners reject the proposed settlement.

No. 34 ORDER denying Parties' 33 Joint Motion to Modify Scheduling Order

Document United States Securities and Exchange Commission v. Dragonchain Inc et al, 2:22-cv-01145, No. 34 (W.D.Wash. Jul. 24, 2024)
Before the Court is the Parties’ Joint Motion to Modify Scheduling Order, Dkt. No. 33.
Having considered the motion and the record, the Court finds good cause to extend the deadlines lacking.
The United States filed this case in August 2022, and this latest motion marks the Parties’ third request for an extension.
There is nothing special about settlement discussions—the reason proffered for the current request—to justify yet another extension here.

Document United States Securities and Exchange Commission v. Dragonchain Inc et al, 2:22-cv-01145, No. 31 (W.D.Wash. Mar. 21, 2024)
Motion to Extend TimeGranted
Pursuant to LCR 16(b)(6), Plaintiff Securities and Exchange Commission (“Plaintiff” or “SEC”) and Defendants Dragonchain, Inc., Dragonchain Foundation, The Dragon Company, and Joseph J. Roets (“Defendants”) (collectively, “Parties”), through their undersigned counsel of record, hereby jointly move the Court to modify the Civil Trial Scheduling Order entered on September 7, 2023 (Dkt. 27, “Scheduling Order”).
The Parties have made progress on discovery since the date of the Parties’ September 2023 motion (Dkt. No. 26) to modify the original scheduling order in this case.
In November 2023, the Parties met and conferred by videoconference regarding Defendants’ responses to the SEC’s discovery requests.
However, in February 2024, Defendants’ lawyers advised the SEC that Defendants needed additional time to provide supplementation of Defendants’ responses to the SEC’s requests.
The Parties are attempting to schedule the depositions of the other subpoenaed non-parties for mutually convenient dates and locations.

No. 27 ORDER granting Parties' 26 Joint Motion for Extension of Time

Document United States Securities and Exchange Commission v. Dragonchain Inc et al, 2:22-cv-01145, No. 27 (W.D.Wash. Sep. 7, 2023)
Motion to Extend TimeGranted
Pursuant to LCR 16(b)((6), Plaintiff Securities and Exchange Commission (“Plaintiff” or “SEC”) and Defendants Dragonchain, Inc., Dragonchain Foundation, The Dragon Company, and Joseph J. Roets (“Defendants”) (collectively, “Parties”), through their undersigned counsel of record, hereby jointly move the Court to modify the Civil Trial Scheduling Order entered on January 30, 2023 (Dkt. 20, “Scheduling Order”).
The Parties have met and conferred over their disputes regarding Defendants’ discovery requests and the SEC’s responses thereto.
Defendants have not yet responded to the SEC’s discovery requests and have advised the SEC that Defendants need additional time to respond to the requests, especially given that Defendants’ current counsel needs to ascertain the location of potentially responsive information from Defendants’ former counsel, which represented Defendants during the SEC’s pre- litigation investigation.
The Parties’ proposed schedule modifications adjust the fact discovery period by approximately 180 days (from September 25, 2023 to March 25, 2024), and provide proportional extensions of all subsequent case deadlines, including the trial date.
