`A request for continued examination under 37 CFR i .114, including the fee set
`
`forth n 37 CFR i .1 7(e), was filed in this application after final rejection. Since this
`
`application is eligible for continued examination under 37 CFR i .114, and the fee set
`
`forth n 37 CFR 1.17(e) has been timely paid, thefinalityofthe previous Office action
`
`has been withdrawn pursuant to 37 0FR i .1 14. Applicant's submission filed on
`
`08/05/2010 has been entered.

`Response to Arguments
`
`Applicant's arguments with respect to claims 2-6 have been considered but are
`
`moot in view of the new ground(s) of rejection.
`
`However, the Examiner further reviewed the Applicant's amendment and
`
`arguments which have been found not persuasive.
`
`In regards to the claims, the Applicant amended the claimed limitations to
`
`recite at least in part '. . .commanding and involuntarily forcing any other network
`
`participants. . " Therefore, argued that the prior art reference (Crowley) fails to teach the
`
`claimed limitations.

`In response the Examiner respectfully disagrees with Applicant's
`
`amendments and arguments. First, the Applicant did not point to at least a section or
`
`specific paragraphs and/or lines that clearly described the newly added and/or amended
`
`claimed limitations. However, after careful review of the Applicant's specification on file,
`
`the Examiner found nothing that mention and/or at least indicate "commanding and
`
`involuntarily forcing any other network participants" throughout the specification.
`
`Therefore, this newly added claimed limitation encompasses new matter which will be
`
`addressed in detail below.
`
`Finally, for the sake of examination, the amended limitation as present above is
`
`unclear with respect to the subject matter of this invention. However given the amended
`
`claimed limitation its' broadest reasonable interpretation, the claimed limitation is fairly
`
`characterized as "commanding and involuntarily forcing any other network
`
`participants" (sending command messages to another user or device, and in response
`
`receiving certain information about the device
`
`Claim Rejections - 35 USC § 112
`
`The following is a quotation of the first paragraph of 35 U.S.C. i 12:

`The specification shall contain a written description of the invention, and of the manner and
`process of making and using it, in such full, clear, concise, and exact terms as to enable any person
`skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the
`same and shall set forth the best mode contemplated by the inventor of carrying out his invention,

`Claims 2-6, are rejected under 35 U.S.C. 1 1 2, first paragraph, as failing to

`comply with the written description requirement. The claim(s) contains subject matter

`had possession of the claimed invention.

`In regards to claim 2, includes at least in part "commanding and involuntarily
`
`forcing any other network participants" which have not been clearly described
`
`and/or defined in the specification to be readily understood by one ofordinary skill in the
`
`art. Therefore, this newly added claimed limitation encompasses new matter which is
`
`not mentioned and/or clearly defined in the original specification on file.
`
`For the sake of examination, the amended limitation as present above is unclear
`
`with respect to the subject matter of this invention. However given the amended claimed
`
`limitation its' broadest reasonable interpretation, the claimed limitation is fairly
`
`characterized as "commanding and involuntarily forcing any other network
`
`participants" (parents keeping track of family member by sending command messages
`
`to another user or device, and in response receiving certain information about the user
`
`and/or device).
`
`In regards to claims 3-6, are rejected at least for similar reasons as discussed
`
`above.

`
`The following is a quotation of 35 U.S.C. I 03(a) which forms the basis for all
`
`obviousness rejections set forth in this Office action:
`
`(a) A patent may not be obtained though the invention is not identically disclosed or described
`as set forth in section 102 ofthis title, ifthe differences between the subject matter soughtto be
`patented and the prior art are such that the subject matter as a whole would have been obvious at the
`time the invention was made to a person having ordinary skill in the art to which said subject matter
`pertains. Patentability shall not be negatived by the manner in which the invention was made.

`Claims 2-6, are rejected under 35 U.S.C. 103(a) as being unpatentable over
`
`Crowley et al. (US Patent No. 7593740) in view of Zhovnirovsky et al. (US Publication
`
`No. 20060030339).
`
`As to claim 2, Crowley teaches a method of communicating among a group of
`
`participants each having a PDA or Smart cell phone (mobile devices 94 - figure 6, col.
`
`11 lines 41-67), an associated GPS (col. 8 lines 37-46) and Advanced Communications
`
`Software allowing all cell phone users to exchange data through a server (computer
`
`system 82 -figure 6, col. 12 lines 1-11) comprising the step ofestablishing a network of
`
`participants who exchange and display identity, location, status and, optionally, personal
`
`data (col. 4 line 65 - col. 5 line 1 7) and to receive data from all active network
`
`participants on the network (col. 7 lines I 2-43). However, Crowley fails to explicitly
`
`teach establishing a polling network of said participants and commanding and
`
`involuntarily forcing any other network participants whose phone numbers have been
`
`previously entered in a database on each phone or on the server to commence
`
`reporting on the network.
`
`But, Zhovnirovsky teaches establishing a polling network of said participants (pg.
`
`I , pp0006) and commanding and involuntarily forcing any other network participants
`
`(parent sends command tracking child's phone) whose phone numbers have been
`
`previously entered in a database on each phone or on the server to commence
`
`reporting on the network (reporting phone location name) (pg. 1 , ppOOlO, and ppO011).
`
`Thus it would have been obvious to one of ordinary skill in the art at time invention was
`

`
`the goal of efficiently, reliably, and accurately keeping track of loved ones and acquiring
`
`desired information at any convenient time without asking and/or disturbing the user in a
`
`communication system.
`
`As to claim 3, Crowley teaches providing an all report network where each
`
`network participant starts reporting on the network upon activation and commences to
`
`receive data from all active network participants on the network (col. 5 lines 25-43,
`
`wherein Crowley discloses logging into the system). However, Crowley fails to teach
`
`and once activated, forcing network participants to display the data from all other
`
`network participants.
`
`But, Zhovnirovsky teaches and once activated, forcing network participants to
`
`display the data from all other network participants (pg. 1, pp0006, ppOOlO, and
`
`ppOOl I ). Thus it would have been obvious to one of ordinary skill in the art at time
`
`invention was made to combine the teaching of Crowley with the teachings of
`
`Zhovnirovsky to achieve the goal of efficiently, reliably, and accurately keeping track of
`
`loved ones and acquiring desired information at any convenient time without asking
`
`and/or disturbing the user in a communication system.
`
`As to claim 4, Crowley teaches providing a common interest network where
`
`each network participant reports to all others who have identified themselves as having
`
`a common interest or are members of a particular type of organization (col. 7 line 12 -
`
`col. 8 line 3). However, Crowley fails to teach forcing all network participants to display
`
`the other network participants' data.

`network participants' data (pg. 1 , pp0006, ppOOl O, and ppOOl i ). Thus it would have
`
`been obvious to one of ordinary skill in the art at time invention was made to combine
`
`the teaching of Crowley with the teachings of Zhovnirovsky to achieve the goal of
`
`efficiently, reliably, and accurately keeping track of loved ones and acquiring desired
`
`information at any convenient time without asking and/or disturbing the user in a
`
`communication system.
`
`As to claim 5, Crowley teaches providing a friends and family network such that
`
`each network participant only exchanges data with those friends and family members
`
`whose phone numbers or IP addresses have been previously entered in a database on
`
`each phone or on the server (col. 7 line 12 - col. 8 line 3). However, Crowley fails to
`
`teach and upon the participants sending its data to the server, forcing all others who
`
`have activated the ACS software to display the network participants' data.
`
`But, Zhovnirovsky teaches and upon the participants sending its data to the
`
`server, forcing all others who have activated the ACS software to display the network
`
`participants' data (pg. 1 , pp0006, ppOOl O, and ppOOl i ). Thus it would have been
`
`obvious to one of ordinary skill in the art at time invention was made to combine the
`
`teaching of Crowley with the teachings of Zhovnirovsky to achieve the goal of efficiently,
`
`reliably, and accurately keeping track of loved ones and acquiring desired information at
`
`any convenient time without asking and/or disturbing the user in a communication
`
`system.

`and data communications among a group of participants each desiring to establish a
`
`social contact with a heretofore unknown person for dating or other purposes that
`
`includes the use of a network of ACS software program enabled PDA or Smart cell
`
`phones (mobile devices 94 -figure 6, col. 11 lines 41-67) having a GPS (col. 8 lines 37-
`
`46) and 800 number bridging application software and a server (computer system 82 -
`
`figure 6, col. 12 lines 1-1 1 ) with ACS software program whose function is to establish a
`
`network of the cell phones comprising the steps of: a. providing a network of
`
`participants each having a specific cell phone with the appropriate communication
`
`software for establishing dating contacts using the cell phone (col. 4 line 65 - col. 5 line
`
`17); al. providing a serverwith ACS software program establishing a network of said
`
`participants cell phones for establishing dating contacts (fig. 3, #40 and fig. 6); b.
`
`locating and communicating with other network participants who wish to be joined in the
`
`dating process using the cell phones (col. 8 lines 37-46); c. providing in each cell phone
`
`a menu for entering personal data of the cell phone user including personality
`
`information such as but not limited to: dating name (which need not be the person's real
`
`name), age, sex, race, marital status and interest areas, each ofwhich may have its
`
`own assigned symbol type and/or color (col. 4 line 65 - col. 5 line 17 and col. 5 line 65
`
`- col. 6 line 19); d. providing each cell phone a menu for entering personal dating
`
`selection criteria of the type of person desired including but not limited to such
`
`information as age, sex, race, interest area, and marital status (col. 4 line 65 - col. 5
`
`line 17 and col. 5 line 65 - col. 6 line 19); e. causing the operator's symbol to appear

`other participants in the network dating group (col. 9 lines 4-19); f having members of
`
`the network participants transmit location and personal information to other network
`
`participants for display on each of the cell phone participant's display screens (col. 9
`
`lines 4-19); g. providing a selection process whereby each user can choose to display
`
`only those symbols that meet his or her dating criteria (col. 5 lines 25-43, wherein the
`
`user can select which other user to communicate with); h. placing totally anonymous
`
`voice calls (col. 8, lines 4-20, and col. 9, lines 4-19) or sending anonymous data
`
`between the two parties by touching their symbol on the screen and selecting the
`
`appropriate soft switch whereby the parties may converse vocally (col. 8, lines 4-20, and
`
`col. 9, lines 4-19) by cell phone (col. 5 lines 25-43) messages, photographs, video or;
`
`and i. blocking messages voice calls, messages, photographs, video or from
`
`designated parties (col. 8, lines 4-20, and col. 9, lines 4-19, and col. 6 lines 35-58).
`
`However, Crowley fails to teach forcing other members with ACS software to receive
`
`and process the data.
