`number of selected member); transmitting messages including a location of the first
`
`device to the respective second devices (fig. 4, pp0033, track members' location,

`ppOO7O, receive location information each member, and tracking ¡n real time,

`ppOO6O), wherein response messages include location information of the respective
`
`second devices (fig. 4, pp0033, track members' location, ppOO7O, receive location

`interactive display of the first device, an interactive map comprising a plurality of user

`selectable symbols corresponding to the plurality of second devices, wherein the

`symbols are positioned on the map at respective positions corresponding to the

`interaction with the interactive map selecting one or more of the user-selectable

`communicate or interact over the internet (pp0046). However, Melen fails to explicitly
`
`teach initiating discovery of an Internet Protocol address by using the contact
`
`information to send, to the second devices, respective Short Message Service (SMS)
`
`messages including information for facilitating Internet Protocol (IP) based
`
`communication between the first device and the respective second devices; receiving
`
`respective P-based responses to the SMS messages.
`
`In an analogous field of endeavor, Engstrom teaches initiating discovery of an
`
`Internet Protocol address by using the contact information to send, to the second
`
`devices, respective Short Message Service (SMS) messages including information for
`
`facilitating Internet Protocol (IP) based communication between the first device and the
`
`respective second devices (fig. i , communication between devices, fig. 3b, ppOO4O,
`
`text message include an IP address, pp0045, replying the message in a different
`
`format, pp0059); receiving respective IP-based responses to the SMS messages (fig.
`
`3b, and pp0045, replying the message (SMS) in a different format (Email)). Thus it
`
`would have been obvious to one of ordinary skill in the art at time invention was made to
`
`combine the teachings of Melen with the teachings of Engstrom to achieve the goal of
`
`efficiently and reliably providing advanced features for communication among users in a
`
`communication system (Engstrom, pp0003).

`comprises a text message, an image, a video, or a command to cause the second

`devices corresponding to the selected symbols to convert text to speech (Engstrom,

`fig. 3b, ppOO4O, text message include an IP address, pp0045, replying the
`
`message in a different format).

`As to claims 4, 14, and 24, Melen in view of Engstrom teaches wherein the SMS
`
`messages include an Internet Protocol (IP) address of the first device; and the IF-based
`
`responses include respective addresses of the second devices (fig. i , communication
`
`between devices, fig. 3b, ppOO4O, text message include an IP address, pp0045,
`
`replying the message in a different format, pp0059).

`As to claims 5, 15, and 25, Melen teaches further comprising: sending
`
`geographic location information of the first device to one or more of the second devices
`
`based on time and/or movement (fig. 5, #506, and pp0069, ppOO7O, receive location
`
`information each member, and tracking in real time).

`As to claims 6, 16, and 26, Melen teaches further comprising: receiving second
`
`user selection of one or more of the symbols (pp0063, touch and select icon); and
`
`receiving user input assigning the one or more second devices corresponding to the
`
`second selected one or more symbols to a sub-net (pp0007, select users of vehicle
`
`navigation systems with which to interact, and define a group).

`make a call, pp0007, and pp0077).

`As to claims 8, 18, and 28, Melen teaches further comprising: identifying user
`
`interaction with the display specifying a new symbol and a location of the new symbol
`
`(fig. 4, display #310, car icon 3 on the display); presenting the new symbol on the
`
`map at the specified location (fig. 4, display #310, car ¡con 3 on the display); and
`
`sending the new symbol and the location to the second devices wherein each of the
`
`second devices is configured to present the new symbol on an interactive map at the
`
`specified location (fig. 4, displaying icons and the location of other vehicle
`
`navigation system in the group, fig. lA, #126, #128, #130, communication or
`
`interaction between users, pp0046).

`As to claims 31 , 37, and 43, Melen in view of Engstrom teaches wherein the

`device is a cellular phone or a personal digital assistant (FDA) (pp0027, cellular

`As to claims 34, 40, and 46, Melen in view of Engstrom teaches further

`comprising: receiving user selection of the sub-net; and causing the one or more
`
`second devices of the sub-net to place a call, make a verbal announcement, convert
`
`textto speech, vibrate, or increase sound levels (fig. 4, fig. 5, #511, and pp0063,
`
`touch and select car, and make a call, pp0007, select users of vehicle navigation
`
`systems with which to interact, and define a group and pp0077).

`As to claims 36, 42, and 48, Melen in view of Engstrom teaches wherein the

`data sent to the one or more second devices causes at least one of the second devices

`to place a phone call to the first device (fig. 4, fig. 5, #51 1 , and pp0063, touch and

`sends the SMS messages and receives the IP-based responses via a cellular

`communications network (Engstrom, fig. 1, fig. 3b, and pp0045, replying the

`message (SMS) in a different format (Email)).

`As to claim 52, Melen in view of Engstrom teaches further comprising identifying
`
`second user interaction with the interactive map selecting a particular user-selectable
`
`symbol corresponding to a particular second device and user interaction with the display
`
`specifying an action and, based thereon, initiating a data call with the particular second
`
`device (fig. 4, fig. 5, #51 1 , and pp0063, touch and select car, and make a call,
`
`pp0007, and pp0077).

`As to claim 53, Melen in view of Engstrom teaches similar limitations as
`
`discussed in the method of claim 1 above.

`Claims 2, 1 2, 22, and 51 , are rejected under pre-AIA 35 U.S.C. i 03(a) as being

`As to claims 2, 12, and 22, Melen in view of Engstrom teaches the limitations of

`the independent claims as discussed above. Melen further teaches further comprising:

`presenting another symbol on the interactive map (fig. 4, display#310, car icon 3 on
`
`the display) and associated with a telephone number (fig. 4, pp0033, track members'
`
`location and pp0045, telephone number of selected member); and receiving user
`
`selection of the other symbol and, based thereon, initiating a telephone call to the
`
`telephone number associated with the symbol (fig. 4, fig. 5, #511, and pp0063, touch
`
`and select car, and make a call). However, Melen fails to teach that the symbol is
`
`corresponding to a fixed location.
`
`In an analogous field of endeavor, Steenstra teaches the symbol is
`
`corresponding to a fixed location (fig. 5, pp0026). Thus it would have been obvious to
`
`one of ordinary skill in the art before the effective filing data of the claimed invention to
`
`combine the teachings of Melen and Engstrom with the teachings Streenstra to achieve
`
`the goal of efficiently and reliably creating and maintaining location based service social
`
`network in a communication system (Streenstra, pp0006).
`
`As to claim 51 , Melen in view of Engstrom and Streenstra teaches further
`
`comprising identifying user interaction with the display specifying category data
`
`associated with the new symbol (Melen, fig. 4, displaying icons and the location of
`

`males or females).

`Claims 33, 35, 39, 41 45, and 47, are rejected under pre-AIA 35 U.S.C. 103(a)
`
`as being unpatentable over Melen (US Publication No. 20040148090) in view of
`
`Engstrom et al. (US Publication No. 200401 37884) and further in view of Breed (US
`
`Publication No. 20100052945).
`
`As to claims 35, 41 , and 47, Melen in view of Engstrom teaches the limitations
`
`of the independent claims as discussed above. However, they failed to explicitly teach
`
`wherein the data sent to the one or more second devices causes at least one of the
`
`second devices to play an audio message announcing an emergency.
`
`In an analogous field of endeavor, Breed teaches wherein the data sent to the
`
`one or more second devices causes at least one of the second devices to play an audio
`
`message announcing an emergency (pp0172, pp0366, and pp0469, emergency
`
`vehicles can make themselves known to all vehicles in their vicinity and all such
`
`vehicles can then take appropriate action to allow passage of the emergency
`
`vehicle and relay accident or hazard information, pp0416 voice message). Thus it
`
`would have been obvious to one of ordinary skill in the art before the effective filing data
`

`teachings Breed to achieve the goal of efficiently and reliably improving the accuracy
`
`with which a given vehicle precisely knows its position, by comparing GPS signals from
`
`one vehicle to another, the relative location of two vehicles can again be very accurately
`
`determined within centimeters. This of course is particularly important for collision
`
`avoidance (Breed, pp0414).
`
`As to claims 33, 39, and 45, Melen in view of Engstrom teaches the limitations
`
`of the independent claims as discussed above. Breed further teaches wherein the video
`
`comprises a video clip or a video transmission (Breed, pp0127, pp0456, sending
`
`video).
