`Sections 1, 2, and 45 Refusal: APPLIED-FOR MARK IS GENERIC
`
`Registration was initially refused under Trademark Act Section 2(e)(1) because the applied-for mark is
`merely descriptive of applicant’s goods. 15 U.S.C. §1052(e)(1). Applicant amended the application to
`add a claim of acquired distinctiveness under Section 2(f). 15 U.S.C. §1052(f).
`
`The proposed mark is LEMON BAR.  The identified goods are "NON-MEDICATED SOAPS FOR
`THE FACE, SKIN, AND BODY."
`
`The refusal of registration under  Trademark Act Sections 1, 2,  and 45  continues to be final because the
`applied-for mark is generic for applicant’s goods. 15 U.S.C. §§1051, 1052, 1127; see TMEP
`§§1209.01(c) et seq., 1209.02(a)(ii). Thus, applicant’s claim of acquired distinctiveness under Section
`2(f) is insufficient to overcome the refusal because “generic terms cannot be rescued by proof of
`distinctiveness or secondary meaning no matter how voluminous the proffered evidence may be.”
`Royal Crown Co. v. Coca-Cola Co., 892 F.3d 1358, 1365, 127 USPQ2d 1041, 1045 (Fed. Cir. 2018)
`(quoting In re Northland Aluminum Prods., 777 F.2d 1556, 1558, 227 USPQ2d 961, 962 (Fed. Cir.
`1985)); see TMEP §1212.02(i).

` term is generic if its primary significance to the relevant public is the class or category of goods or
`services with which it is used. See USPTO v. Booking.com B.V., 140 S. Ct. 2298, 2304, 2020 USPQ2d
`10729, at *5 (2020); Princeton Vanguard, LLC v. Frito-Lay N. Am., Inc., 786 F.3d 960, 965, 114
`USPQ2d 1827, 1830 (Fed. Cir. 2015) (quoting H. Marvin Ginn Corp. v. Int’l Ass’n of Fire Chiefs, Inc.,
`782 F.2d 987, 989-90, 228 USPQ 528, 530 (Fed. Cir. 1986)); TMEP §1209.01(c)(i). Determining
`whether a term is generic requires a two-step inquiry:
`
`(1)        What is the genus of goods and/or services at issue?
`(2)       
`Does the relevant public understand the term primarily to refer to that genus of goods and/or
`services?
`
`In re Cordua Rests., Inc., 823 F.3d 594, 599, 118 USPQ2d 1632, 1634 (Fed. Cir. 2016) (citing H.
`Marvin Ginn Corp. v. Int’l Ass’n of Fire Chiefs, Inc., 782 F.2d at 990, 228 USPQ at 530); TMEP
`§1209.01(c)(i).

`Regarding the first part of the inquiry, the genus of the goods and/or services may be defined by an
`applicant’s identification of goods and/or services. See In re Cordua Rests., Inc., 823 F.3d at 602, 118
`USPQ2d at 1636 (citing Magic Wand Inc. v. RDB Inc., 940 F.2d 638, 640, 19 USPQ2d 1551, 1552
`(Fed. Cir. 1991)); see also In re 1800Mattress.com IP, LLC, 586 F.3d 1359, 1361, 1363, 92 USPQ2d
`1682, 1682, 1684 (Fed. Cir. 2009).
`

`In this case, the application identifies the goods as "NON-MEDICATED SOAPS FOR THE FACE,
`SKIN, AND BODY," which adequately defines the genus at issue.
`
`Regarding the second part of the inquiry, the relevant public is the purchasing or consuming public for
`the identified goods. Loglan Inst. Inc. v. Logical Language Grp., Inc., 962 F.2d 1038, 1041, 22
`USPQ2d 1531, 1533 (Fed. Cir. 1992) (quoting Magic Wand Inc. v. RDB Inc., 940 F.2d at 640, 19
`USPQ2d at 1553). In this case, the relevant public comprises  ordinary consumers who purchase
`applicant’s goods, because there are no restrictions or limitations to the channels of trade or classes of
`consumers.
`
`The attached evidence shows that the wording “lemon bar” in the applied-for mark means bar soap that
`has a lemon-type fragrance  and thus the relevant public would understand this designation to refer
`primarily to that genus of goods rather than a trademark used to indicate the source of applicant's

`In response to the refusal, the applicant argues that its product contains lemongrass essential oil, an oil
`that is extracted from the lemongrass plant.  Applicant also states that its soap "has no lemon juice,
`lemon zest, or lemon peel," "does not smell like lemon or lemon juice," and "does not contain lemon
`essential oil."  Applicant's April 26, 2023 Response to Office Action, p. 5.  
`
`The term "lemongrass" is defined and described by various online dictionaries and articles as follows:

` a grass (Cymbopogon citratus) of robust habit native to southern India and Ceylon that is grown
`in tropical regions for its lemon-scented foliage used as a seasoning and that is the source of an

`In contrast to the applicant's argument that the identified goods do not smell like lemon, the applicant's
`website shows the following description of the goods: "Zesty fresh lemon lather smells great and cleans
`deep with bonus antibacterial properties."  The photographs of the applicant's goods also indicate that
`the packaging for the soap shows graphics of lemons and lemongrass.  Please see the attached
`screenshots from the applicant's website, available at  https://www.biggsandfeather.com/collections/bar-
`soaps/products/lemon-bar.  Some online comments submitted by purchasers of the applicant's product
`also indicate the lemon-type fragrance of the soap:

`Therefore, the record indicates thatlemongrass essential oils bear a fragrance similar to that of
`lemons.   The identified goods are bar soaps that have a lemon-type fragrance due to the lemongrass
`essential oils contained in the product. 
`
`
`At issue here is whether the  relevant public understands "LEMON BAR" primarily to refer to a genus
`of goods.
`
`
`Applicant argues that the proposed mark is not generic because there is no soap-related dictionary
`definition for the wording "lemon bar" and that other online sources point to the dessert reference.  The
`fact that a word or term is not found in the dictionary is not controlling on the question of registrability.
`In re Hikari Sales USA, Inc., 2019 USPQ2d 111514, at *8 (TTAB 2019) (citing In re ActiveVideo
`Networks, Inc., 111 USPQ2d 1581, 1603 (TTAB 2014); In re Dairimetics, Ltd., 169 USPQ 572, 573
`(TTAB 1971)); TMEP §1209.03(b); see In re Gould Paper Corp., 834 F.2d 1017, 1018, 5 USPQ2d
`1110, 1111-12 (Fed. Cir. 1987).   
`
`The applicant also argues that it uses the wording "LEMON BAR" as both a compound noun and as a
`modifier for "bar soap."  Applicant asserts that "[i]f a consumer were asked to name her favorite Lemon
`Bar provider that makes soaps, then the consumer would name one of several soap providers that
`provide Lemon Bar soaps or Lemon Bar soap bars or Lemon Bar bar soaps--but it would not be all
`lemon scented soaps in bar form."  Applicant's April 26, 2023 Response to Office Action, p. 8.  In view
`of the cumulative evidence of record, the examining attorney remains unpersuaded by the applicant's
`arguments.  The wording "LEMON BAR" is not only merely descriptive of soap but also names a
`

`category of soap.
`
`In assessing the genericness of a phrase, the evidence of record must show that the composite mark,
`when viewed as a whole, would be perceived by the relevant purchasing public as generic when used in
`connection with the relevant goods and/or services. See In re Dial-A-Mattress Operating Corp., 240
`F.3d 1341, 1345-46, 57 USPQ2d 1807, 1810-11 (Fed. Cir. 2001) (quoting In re Am. Fertility Soc’y, 188
`F.3d 1341, 1348-49, 51 USPQ2d 1832, 1837 (Fed. Cir. 1999)); Alcatraz Media, Inc. v. Chesapeake
`Marine Tours Inc., 107 USPQ2d 1750, 1760 (TTAB 2013); TMEP §1209.01(c)(i).
`
`The evidence of record shows that "LEMON BAR" does not point uniquely and unmistakably to
`applicant as the only source of soap with a lemon-type fragrance.  The composite mark, when viewed
`as a whole, would be perceived by the relevant purchasing public as  a  category of soap with a lemon-
`type fragrance.   The proposed mark does not distinguish applicant's soap from those of others. 
`Accordingly, the refusal under  Trademark Act  Sections 1, 2,  and 45  continues to be final.
`
`Section 2(e)(1) Refusal:  APPLIED-FOR MARK IS MERELY DESCRIPTIVE
`
`In the alternative, if the applied-for mark is ultimately determined not to be generic by an appellate
`tribunal, then the refusal of registration based on the applied-for mark being merely descriptive of
`applicant’s goods continues to be final for the reasons specified in the previous Office actions.
`Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.   The
`identified goods are bars of soap that have a lemon-type fragrance.
`
`In addition, applicant’s claim of acquired distinctiveness in the response is a concession that the mark
`sought to be registered is merely descriptive of applicant’s goods. In re Virtual Indep. Paralegals, LLC,
`2019 USPQ2d 111512, at *9 (TTAB 2019) (citing Cold War Museum, Inc. v. Cold War Air Museum,
`Inc., 586 F.3d 1352, 1358, 92 USPQ2d 1626, 1629 (Fed. Cir. 2009); Yamaha Int’l Corp. v. Hoshino
`Gakki Co., 840 F.2d 1572, 1577, 6 USPQ2d 1001, 1005 (Fed. Cir. 1988); In re Am. Furniture
`Warehouse Co., 126 USPQ2d 1400, 1403 (TTAB 2018)).
`
`Denial of Applicant's Section 2(f) Claim :  APPLICANT’S EVIDENCE OF ACQUIRED
`DISTINCTIVENESS IS INSUFFICIENT
`
`With respect to applicant’s claim of acquired distinctiveness, the following evidence was provided in
`support of such claim:
`1.
`Applicant's claim that the mark has been in use in connection with the identified goods for 14
`years since 2009;
`Sales figures for the soap sold under the proposed mark;
`One magazine article (Dyett, Linda. "The 14 Bath and Body Products a Veteran Beauty Writer
`Uses Almost Every Day
`and Night." The Strategist, November 12, 2019.
`https://nymag.com/strategist/article/best-bath-and-body-products-mature-skin.html (accessed by
`applicant on September 20, 2022)) and excerpt from April 2023 Giant Savory magazine; and
`Excerpts from customer reviews posted on applicant's website 
`

`If the applied-for mark is ultimately determined to be merely descriptive and not generic, the Section
`2(f) evidence based on applicant's use of the mark for 14 years is insufficient to show acquired
`distinctiveness because the attached evidence demonstrates that the applied-for mark is highly
`

`descriptive of applicant’s goods. The common use by other soap companies shows that "LEMON
`BAR"does not point uniquely and unmistakably to applicant as the only source of soap with a lemon-
`type fragrance.  See In re MetPath Inc., 1 USPQ2d 1750, 1751-52 (TTAB 1986); TMEP §1212.06. An
`applicant’s evidentiary burden of showing acquired distinctiveness increases with the level of
`descriptiveness of the mark sought to be registered. Royal Crown Co. v. Coca-Cola Co., 892 F.3d 1358,
`1365, 127 USPQ2d 1041, 1045 (Fed. Cir. 2018) (citing In re Steelbuilding.com, 415 F.3d 1293, 1300,
`75 USPQ2d 1420, 1424 (Fed. Cir. 2005)). Where an applicant’s proposed mark is highly descriptive of
`the applicant’s goods and/or services, as in this case, the applicant’s burden of establishing acquired
`distinctiveness under Section 2(f) is commensurately high and requires more evidence. See In re GJ &
`AM, LLC, 2021 USPQ2d 617, at *37-38 (TTAB 2021) (citing In re Steelbuilding.com, 415 F.3d at
`1300, 75 USPQ2d at 1424; In re Bongrain Int’l (Am.) Corp., 894 F.2d 1316, 13 USPQ2d 1727, 1729
`(Fed. Cir. 1990); In re Greenliant Sys. Ltd., 97 USPQ2d 1078, 1085 (TTAB 2010)).
`
`Applicant's sales figures for its goods are also not dispositive of that claim. See 15 U.S.C. §1052(f).
`Applicant’s sales figures may demonstrate the commercial success of applicant’s goods, but not that
`relevant consumers view the matter as a mark for these goods. See In re Boston Beer Co., 198 F.3d
`1370, 1371-73, 53 USPQ2d 1056, 1057-58 (Fed. Cir. 1999); In re Busch Entm’t Corp., 60 USPQ2d
`1130, 1132-34 (TTAB 2000).   Without additional evidence showing how applicant is educating the
`public to associate the proposed mark with a single source, this evidence is not probative. TMEP
`§1212.06(b) (citing In re Redken Labs., Inc., 170 USPQ 526, 529 (TTAB 1971) (holding Section 2(f)
`evidence insufficient to establish acquired distinctiveness notwithstanding long use of the mark and
`significant promotion and sponsorship expenses, where advertising and promotional material showed
`only descriptive usage of applied-for mark)); see In re OEP Enters., Inc., 2019 USPQ2d 309323, at *25
`(TTAB 2019) (holding Section 2(f) evidence including significant sales and advertising figures
`deficient in part because “[a]pplicant’s consumer facing advertisements, like its ones to the trade, do
`little more than show the products, and they do not establish that consumers associate the features of
`the applied-for trade dress mark with [a]pplicant”).
`
`In the article from The Strategist and excerpt from Giant Savory, the applicant's goods are referred to as
`Biggs & Featherbelle Lemon Bar and Biggs & Featherbelle Handmade Bar Soap, respectively.  These
`two examples of unsolicited media coverage do not necessarily establish that the wording "LEMON
`BAR" alone and without the accompanying brand name "Biggs & Featherbelle," has acquired
`distinctiveness in the minds of the consumers.  Evidence that only shows the proposed mark used in
`conjunction with other wording may be insufficient to show that the mark has acquired distinctiveness. 
`See In re Mogen David Wine Corp., 372 F.2d 539, 542, 152 USPQ 593, 595-96 (C.C.P.A. 1967)
`(holding evidence of a bottle design failed to prove secondary meaning where advertising depicting the
`bottle design always featured applicant’s word mark); In re Franklin Cnty. Hist. Soc’y, 104 USPQ2d
`1085, 1093 (TTAB 2012) (noting none of applicant’s evidence showed use of the proposed mark
`"CENTER OF SCIENCE AND INDUSTRY" without the acronym "COSI," while other evidence only
`used the acronym to refer to applicant’s services).   
`
`The applicant's screenshots of its product on its own website and those of Amazon.com,
`martinsfoods.com, kroger.com, harristeeter.com, giantfood.com, and Facebook, are also insufficient as
`evidence of acquired distinctiveness because these are consumer-facing advertisements that only show
`the products and do not establish that consumersassociate the proposed mark with a single source  of
`soap with a lemon-type fragrance.  Nor does t he fact that applicant maintains a Facebook company
`page and has over 4,700 followers necessarily demonstrate that a substantial portion of the consuming
`public associates the proposed mark with a single source.  At most, the applicant's evidence points to
`applicant's efforts in promoting its products.
`

`Furthermore, the five excerpts of customer reviews posted on applicant's website are insubstantial in
`number and still demonstrate descriptive use of the wording "LEMON BAR."  The customers' use of
`"your lemon bar soap" and "your lemon bar" implies that there are other companies that produce
`similar soaps with a lemon-type scent.  The applicant has not provided evidence that a  substantial
`portion of the consuming public associates the proposed mark with a single source.
`
`Therefore, the denial of applicant's Section 2(f) claim of acquired distinctiveness continues to be final. 
`
`
`
`If applicant has already filed an appeal with the Trademark Trial and Appeal Board, the Board will
`be notified to resume the appeal.   See TMEP §715.04(a).  
`
`If applicant has not filed an appeal and time remains in the response period for the final Office
`action, applicant has the remainder of that time to (1) file another request for reconsideration that
`complies with and/or overcomes any outstanding final requirement(s) and/or refusal(s), and/or (2) file a
`notice of appeal to the Board.  TMEP §715.03(a)(ii)(B).
