`The trademark examining attorney bas searched the Office's database of registered and pending marks
`and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). lMEP
`§704.02; see 15 U.S.C. §1052(d).

`MARK DIFFERS ON DRAWING AND SPECIMEN
`
`The mark on the specimen disagrees with the mark on the drawing. In this case, the specimen displays the
`mark as VITAL FORCE MINERALS; and the drawing shows the mark as VITAL FORCE with the
`wording MINERALS displayed separate from this wording to such a degree that it does not make a single
`commercial impression.
`
`An application based on Trademark Act Section l(a) must include a specimen showing the applied-for
`mark in use in commerce for each class of goods and/or services. Trademark Act Sections 1 and 45, 15
`U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(l)(iv), 2.56(a); TMEP §§904, 904.07{a). The mark on the
`drawing must be a substantially exact representation of the mark on the specimen. 37 C.F.R. §2.5 l{a);
`TMEP §807.12(a); see37 C.F.R. §2.72{a)(l).
`
`· Generally, the drawing of the.mark ean be amended only if the amendment does not materially alter the
`mark as originally filed. 37 C.F.R. §2.72{a){2); seeTMEP §§807.12(a), 807.14 et seq. However,
`amending the mark in the drawing to conform to the mark on the specimen would create a duplicate
`application to the applicant's prior pending Application Serial Number 85879785. The USPTO will not
`issue duplicate registrations. 37 C.F.R. §2.48; lMEP §703.
`
`Therefore, applicant must submit the following:
`
`(I) A substitute specimen showing use in commerce of the mark on the drawing. SeeTMEP
`§807.12(a).; and
`
`(2) The following statement, verified with an affidavit or signed declaration under 37 C.F.R.
`§2.20: "The substitute specimen was in use in commerce at least as early as the filing date of
`the application."' See 37 C.F.R. §§2.59(a), 2.193(c)( I); lMEP §904.05. If submitting a
`specimen requires an amendment to the dates of use. applicant must also verify the amended
`dates. 37 C.F.R. §2.71(c): TMEP §904.05.
`
`Examples of specimens for goods are tags, labels, instrnction manuals, containers, photographs that show
`the mark on the actual goods or packaging, or displays associated with the actual goods at their point or
`sale. See TMEP §§904.03 ef seq. Examples of specimens for services arc signs, photographs, brochures,
`website printouts or advertisements that show the mark used in the actual sale or advertising of the
`services. See TM EP §§ 1301 .04 et seq.
`
`lfapplicant cannot satisfy the above requirements, applicant may amend the application from a use in
`commerce basis under Trademark Act Section 1 (a) to an intent to use basis under Section l(b), for which
`no specimen is required. See TMEP ~806.03( c). However, if applicant amends the basis to Section !(b ).
`registration will not be granted until applicant later amends the application back to use in commerce by
`filing an acceptable allegation of use with a proper specimen. See I 5U.S.C.§105 l(c)-(d): 37 C.F.R.
`§§2.76, 2.88; TMEP §1103.
`
`To amend to Section I (b). applicam must submit the following statement, verified with an affidavi t or ·
`signed declaration under 37 C.F.R. §2.20: .. Applican t has had a bona fiM intention to usl' the mark

`in commerce on or in connection with the goods and/or services listed in the application as of the
`filing date oftbe application." 37 C.F.R. §2.34(a)(2); TMEP §806.0l(b); see 15 U.S.C. §1051(b); 37
`C.F.R. §§2.35(b)(l), 2.193(e)(l).

`Pending receipt of a proper response, registration is refused because the specimen does not show the
`applied-for marlc in use in commerce as a trademark and/or service mark. Trademark Act Sections 1 and
`45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2-34(a)(l)(iv). 2.56(a); TMEP §§904, 904.07(a).
`
`Applicant may respond by using the Trademark Electronic Application System (TEAS) Response to
`Office Action Form to satisfy one of the following:
`
`( l) Submit a verified substitute specimen as follows: (a) answer "yes" to the TEAS response
`form wizard question to "submit a new or substitute specimen;" (b) on the next page, attach a jpg
`or pdf file of the substitute specimen; ( c) check the box next to the statement "The substitute (or
`new, if appropriate) specimen( s) was/were in use in commerce at least as early as the filing date of
`the application"; and (d) on the next page, applicant must personally sign or personally enter
`bis/her electronic signature and date after the declaration at the end of the TEAS response form,
`and print or type the name of the signatory immediately below or adjacent to bis/her signature or
`identify it elsewhere in the filing.; or
`
`(2) Amend the application to an intent to use tiling basis under Trademark Act Section l(b)
`as follows: (a) answer "yes" to the TEAS response form wizard questions to "change filing
`basis" and for a "signed declaration," respectively; (b) on the next page, uncheck the box for
`~Filing Basis Section l(a);" (c) check the box for "Filing Basis Section l(b);" and (d) on the next
`page, applicant must personally sign or personally enter his/her electronic signature and date after
`the declaration at the end of the TEAS response form, and print or type the name of the signatory
`immediately below or adjacent to his/her signature or identify it elsewhere in the filing.

`Inc., 340 F2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP §1213. An unregistrable
`component of a mark includes wording and designs that are merely descriptive/generic/deceptively
`misdescriptive/primarily geographically descriptive of an applicant's goods and/or services. 15 U.S.C.
`§1052(e); see1MEP §§l209.03(f), 1213.03 et seq. Such words or designs need to be freely available for
`other businesses to market comparable goods or services and should not become the proprietary domain
`of any one party. See Dena Corp. v. Belvedere Int'/, Inc. , 950 F.2d 1555, 1560, 21 USPQ2d l 047, 1051
`(Fed. Cir. 1991 ); In re Aug. Storck KG, 218 USPQ 823, 825 (IT AB 1983).
`
`If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark.

`RESPONSE GUIDELINES
`
`For this application to proceed toward registration, applicant must explicitly address each refusal and/or
`requirement raised in this Office action. If the action includes a refusal, applicant may provide arguments
`and/or evidence as to why the refusal should be withdrawn and the mark should register. Applicant may
`also have other options for responding to a refusal and should consider such options carefully. To
`respond to requirements and certain refusal response options, applicant should set forth in writing the
`required changes or statements.

`If applicant does not respond to this Office action within six months of the issue/mailing date, or responds
`by expressly abandoning the application, the application process will end, the trademark will fail to
`register, and the application fee will not be refunded. See 15 U.S.C. §I 062(b); 37 C.F.R. §§2.65{a),
`2.68(a), 2.209(a); TMEP §§405.04, 7 18.0 I, 718.02. Where the application has been abandoned for
`failure to respond to an Office action, applicant's only option would be to file a timely petition to revive
`the application, which, if granted, would allow the application to return to live status. See 37 C.F.R.
`§2.66; TMEP § 1714. There is a $100 fee for such petitions. See 37 C.F.R. §§2.6, 2.66(b)( I).
