`OPPOSER VOKE TAB INC.’S MOTION TO SUSPEND PROCEEDINGS IN VIEW OF

`PENDING CIVIL ACTION PURSUANT TO TRADEMARK RULE §2.117§a1

`Opposer Voke Tab, Inc. (“Voke Tab”) hereby moves for suspension of these proceedings
`
`pursuant to Trademark Rule 2.117(a).
`
`PROCEDURAL BACKGROUND
`
`On August 27, 2015, Voke Tab served on Applicant Nicoventures Limited‘
`
`(“Nicoventures”) a Notice of 30(b)(6) Deposition (the “Notice”) stating that Voke Tab would
`
`take the deposition of Nicoventures on September 22, 2015. 011 September 14, Voke Tab served
`
`a First Amended Notice of Deposition (the “First Amended Notice”), continuing the date of the
`
`deposition to October 23 , 2015.

`On September 14, Nicoventures filed in this proceeding a Motion to Quash both the
`
`Deposition Notice and the First Amended Notice.
`
`On September 16, Voke Tab initiated a miscellaneous action for the issuance of a
`
`deposition subpoena in the United States.District Court for the Eastern District of Virginia
`
`against Nicoventures based on this proceeding (Case No. 1:15-mc-00027-CMI-I-TCB); Voke
`
`
`
`

`
`Tab filed with the court a Motion for the Issuance of a Subpoena to Testify at Deposition,
`
`requesting that the clerk ofthe court issue a subpoena (the “Subpoena”) to Nicoventures pursuant
`
`to Fed. R. Civ. P. 30(b)(6) and 35 U.S.C.A. § 24. The Subpoena would command Nicoventures
`
`to appear pursuant to the First Amended Notice. Voke Tab expects that the court will issue the
`
`subpoena within a matter of days.
`
`In support of this Motion to Suspend, Voke Tab submits as Exhibit 1 the following
`
`documents that it filed with the District Court: (I) cover letter; (2) filing fee; (3) Civil Cover
`
`Sheet; (4) Motion for Issuance of a Subpoena; (5) Memorandum in Support of the Motion with
`
`exhibits.

`ARGUMENT
`
`Trademark Rule 2.1 17(a) provides that “[w]henever it shall come to the attention of the
`
`Trademark Trial and Appeal Board that a party or parties to a pending case are -engaged in a civil
`
`action... which may have a bearing on the case, proceedings before the Board may be suspended
`
`until termination of the civii action or the other Board proceeding.” 37 C.F.R. § 2.117(a); see
`
`also TBMP § 510.02(a)n.i-7; Whopper-Burger Inc. v. Burger King Corp, 171 U.S.P.Q. 805,
`
`g 807 (T.T.A.B. 1971) (suspending proceeding in light of pending federal litigation where “the
`
`outcome of the civil action will have a direct bearing on the question of the rights of the parties
`
`herein. . ..") “[T]he civil action does not have to be dispositive of the Board proceeding to
`
`warrant suspension, it need only have a bearing on the issues before the Board.” New Orleans
`
`Louisiana Saints LLC & NFL Properties LLC, 99 U.S.P.Q.2d 1550 (P.T.O. July 22, 2011) (citing
`
`6 McCai'thy on Trademarks‘ and Unfair Competition §32:47 (4th ed.) (“It is standard procedure
`
`for the Trademark Board to stay administrative proceedings pending the outcome of court
`
`litigation between the same parties involving related issues”); See also TBMP § 5l0.02(a) n.7.

`(“Unless there are unusual circumstances, the Board will suspend proceedings in the case before
`
`it if the final determination of the other proceeding may have a bearing on the issues before the
`
`Board")
`
`As the Board lacks the authority to compel witnesses through the subpoena power to
`
`appear for testimony in inter partes proceedings, district courts have subpoena authority under
`
`35 U.S.C.A. § 24 to command the appearance of witnesses in administrative proceedings before
`
`the PTO. Rosenruist-Gestao E Services [DA V. Virgin Enterprises Ltd. , Sll F.3d,437, 443-44
`
`(4th Cir. 2007) (citing Frilette v. Kimberlin, 508 F.2d 205, 207 (3d Cir. 1975) (en banc); Vogel v.
`
`Jones, 443 F .2d 257, 259 (3d Cir. 1971)). “Thus, § 24 assigns a supportive role to the district
`
`courts to ensure the smooth functioning of the procedures adopted by the PTO.” Id. (citing
`
`Frilette v. Kimberlin, 508 F.2d at 210 (describing the function of the district court as “co-
`
`operatively complementing” the PTO.))
`
`The Court of Appeals for the Fourth Circuit has held that a foreign corporation shall obey
`
`a subpoena issued by the District Court for the Eastern District of Virginia, pursuant to a Rule
`
`30(b)(6) notice in a TTAB proceeding, and must appear in Virginia to give trial testimony.
`
`Rosenruist-Gestao, 511 F.3d at 448-49.
`

`Here, in its Motion for Issuance of a Subpoena, Voke Tab has asked that the District
`
`Court issue the Subpoena commanding Nicoventures, a foreign corporation, to appear in Virginia
`
`for deposition pursuant to the Rosenruist-Gestao rule. The Subpoena would command
`
`Nicoventures to appear pursuant to the First Amended Notice, the same Notice that Nicoventures
`
`has asked the Board to quash in this proceeding. The pending civil action accordingly involves
`
`issues that are involved in this proceeding, namely whether Nicoventures may be compelled to
`
`appear in Virginia to give trial testimony. The District Court’s determination of this issue will
`
`

`
`have a direct bearing on the questions that Nicoventures has raised in its Motion to Quash. See
`
`37 C.F.R. § 2.117(a). Because the Board customarily defers to determination by the District
`
`Court’s on legal issues having a direct bearing on Board proceedings, it is appropriate for the
`Board to suspend of this proceeding pending the issuance of a subpoena by the District Court for
`
`the Eastern District of Virginia.
`
`Voice’ Tab therefore respectfuliy requests that the Board follow its customary practice of
`
`deferring to determinations by the federal district courts (see TBMP § 510.02(a) n.7) and
`
`suspend this proceeding pending the District Court’s issuance of the Subpoena, and
`
`Nicoventures’ compliance therewith, pursuant to Trademark Rule 2.117(a).

`MEMORANDUM IN SUPPORT OF MOTION FOR
`ISSUANCE OF A SUBPOENA TO TESTIFY AT A DEPOSITION

`Movant, Voice Tab, Inc. (“Voke Tab”), by counsel, pursuant to 35 U.S.C. § 24, hereby
`
`requests that the Clerk of the Court issue the Subpoena to Testify at a Deposition pursuant to
`
`Fed. R. Civ. P. 30(b)(6), attached hereto as Exhibit A, to Nicoventures Limited (“Nicovcntures")
`and in support thereofstates as follows:

`This case originates from Voice Tab’s Opposition to Nicoventures' application to register
`
`the trademark “VOKE” in the United States Patent & Trademark Office (USPTO). This
`
`contested case is currently pending before the Trademark Trial & Appeal Board (TTAB) and has
`
`been assigned Opposition No. 91218369. The Clerk of Court for the Eastern District of Virginia
`
`is authorized to issue the requested Subpoena pursuant to 35 U.S.C. § 24, which states that, “
`
`[t]he clerk of any United States court for the district wherein testimony is to be taken for use in
`
`any contested case in the Patent and Trademark Office, shall, upon the application of any party
`
`thereto, issue a subpdena for any witness residing or being within such district, commanding him
`
`to appear and testify before an officer in such district authorized to take depositions and
`
`

`affidavits, at the time and place stated in the subpoena.” 35 U.S.C. § 24. Additionally, Rule 45
`
`of the Local Rules for the United States District Court for the Eastern District of Virginia
`
`provides in pertinent part:
`
`Proof of service of a notice to take depositions as provided in Fed.
`R. Civ. P. 30(b) and 3103) constitutes sufiicient authorization for
`the issuance of a subpoena by the Clerk for the district in which the
`deposition is to be taken for the attendance of persons named or
`described therein. .
`.
`. No subpoena for the taking of depositions
`shall be issued by the Clerk unless there be exhibited to the Clerk a
`copy of the notice to take deposition together with a statement of
`the date and manner of service and of the name of the persons
`served, certified by the person who made service.
`
`Voice Tab has satisfied both the statutory and procedural requirements for the issuance of
`
`the attached subpoena. By applying for a trademark registration in the United States Patent &
`
`Trademark Office, Nicoventures is within the Eastern District of Virginia, as required by the
`
`statute. See Rosenruist-Gestao E Services LD/Ii v. Virgin Enters. Ltd, 511 F.3d 437, 446 (4th
`
`Cir. 2007). Nicoventures is a foreign corporation with its principal place of business in the
`
`United Kingdom. Nicoventures has designated a domestic representative in the United States on
`
`whom may be served notices or processes in proceedings affecting the mark “VOKE,” as
`
`required by 15 U.S.C. § 1051(6):

`(c) Place ofcompliancc.
`

`person to attend a trial, hearing, or deposition only as foliows:
`(A) within 10D miles of where the person resides, is employed, or
`regularly transects business in person: or
`(B) within the state where the person resides, is employed, or regularly

`(i) is at party or a party's officer; or'
`(ii) is commanded to attend a trial and would not incur substantial

`(2) Command to Produce Materiuis or Permit Inspection.

`production or inspection unless also commanded to appear for a deposition,
`hearing, or trial.

`things or to permit inspection may serve on the party or attorney designated
`in the subpoena a written objection to inspecting, copying, testing, or
`sampling an or all ofthe materials or to inspecting the prcmises—or to
`producinge ectronically stored information in the form or forms requested.
`The objection must be served before the earlier oi‘tl1e time specified for
`compliance or i4 days afler the subpoena is served. ifan objection is made,
`the following rules apply:
`(it At any time, on notice to the commanded person, the serving party
`may move the court for the district where compliance is required for an
`order compelling production or inspection.
`(it) These acts may be required only as directed in the order, and the
`order must protect a person who is neither a party not a party’s officer from
`significant expense resulting from compliance.
`
`(3) Qmrsiring or Modifying a Strbpoemr.
`
`(A) When Reqrrired. On timely motion, the court for the district where
`compliance is required must quash or modify a subpoena that:
`
`(I) falls to allow a reasonable time to comply;
`(ii) requires a person to comply beyond the geographical limits
`specified in Rule 45(c):
`(ill) requires disclosure ofpriviicged or other protected miter, if no
`exception or waiver applies: or
`(iv) subjects a person to undue burden.
`(B) When Permitted. To protect a person subject to or affected by a
`subpoena, the court for the district where compliance is required may, on
`motion. quash or modify the subpoena if it requires:
`
`(l) disclosing a trade secret or other confidential research, development,
`or commercial information; or
`(ii) disclosing an unretained expcrt’s opinion or infonnation that does
`not describe specific occurrences in dispute and results fi'om the expert's
`study that was not requested by a party.
`(C) Specyjvtng Conditions as an Alternative. in the circumstances
`described in Rule 45(r;l)(3)(B), the court may, instead of quashing or
`modifying a subpoena, order appearance or production under specified
`conditions it‘ the serving party:
`(i) shows a substantial need for the testimony or material that cannot be
`othenvisc met without undue hardship; and

`(it) ensures that the subpoenaed person will be reasonably compensated.
`
`(c) Dutiesin Responding to a Subpoena.
`
`(1) Pronltrclrrg Docrrmerrts or Etectrorricofly Stored fl'(f0i'r1mi'J‘0t‘t. These
`procedures apply to producing documents or electronically stored
`information:
`(A) Dacwarents. A person responding to a subpoena to produce documents
`must produce them as they are kept in the ordinary course ofbusiness or
`must organize and label them to correspond to the categories in the demand.
`(B) Formfor Producing Electronically Stored lnjbrnration Not Specylied.
`ifa subpoena does not specify a form for producing electronically stored
`information, the person responding must produce it in a form or forms in
`which it is ordinarily maintained or in a reasonably usable fonn or forms.
`(C) Electronically Stored Information Produced in Only One Form. The
`person responding need not produce the same electronically stored
`infonnation in more than one form.
`(D) lnoccessibie Eiecrrorricaity Stored Injbrnration. The person
`responding need not provide discovery ofelectronically stored infomration
`from sources that the person identifies as not reasonably accessible because
`of undue burden or cost. On motion to compel discovery or for a protective
`order, the person responding must show that the inforrnation is not

`reasonably accessible because ofunduc burden or cost. it‘ that showing is
`made, the court may nonetheless order discovery fiom such sources ifthe
`requesting party shows good cause, considering the limitations of Rule
