`INTRODUCTION
`
`Pursuant to its Notice of Appeal filed December 4, 2019, CGTN C.V., (“Applicant”) has
`
`appealed the Trademark Examining Attorney’s refusal to register Applicant’s trademark “AGE IQ”
`
`(the “Mark”) for “cosmetic products, namely, medicated skin care preparations, namely, skin
`
`creams, facial creams, night creams, anti-aging creams, anti-wrinkle creams; medicated skin
`
`moisturizers, medicated skin emollients; medicated face and body lotions for distribution
`
`through independent sales representatives” under Trademark Act Section 1, 15 U.S.C. 1051 (use
`
`of the mark in interstate commerce).
`
`II. FACTS
`
`In the initial Office Action dated November 26, 2018, and the second Office Action dated June
`
`4, 2019 (made final), the Examining Attorney has refused registration of the Mark on the basis of
`
`Section 1 (use of the mark in interstate commerce). Applicant argued in its Response to Office
`
`Action dated May 28, 2019 and its Request for Reconsideration After Final dated December 4,
`
`2019, that the specimens submitted does show use of the mark in commerce in connection with
`
`the applied-for goods and should be accepted. Thus, Applicant has been forced to appeal the
`
`Examiner’s refusals.

`ISSUE
`

`The issue in this appeal is whether Applicant’s specimen shows the use of the Mark in interstate
`
`commerce in connection with Class 5. The answer is yes, Applicant’s specimen1 does show use of the
`
`mark in interstate commerce in connection with Class 5.
`
`
`
`Based on the arguments and evidence of record, the Trademark Act, and the reasons presented
`
`herein, Applicant submits that the refusal to register under Section 1 is improper, as Applicant’s
`
`specimen is proper. Therefore, Applicant respectfully requests that the final refusal of the Examining
`
`Attorney be reversed.
`
`IV. ARGUMENT
`
`a.
`
`The Same Specimen May Be Used in Multiple Classes
`
`The same specimen may be used for goods that may be categorized in different
`
`classes. In Re Int'l Salt Co., 166 U.S.P.Q. (BNA) ¶ 215 (T.T.A.B. June 11, 1970) (“the owner of a
`
`trademark has a right to register the trademark for a particular product in a plurality of classes
`
`covering the different purposes or uses of the article that happen to fall within two or more
`
`classification classes instead of the usual single class”); see also, TMEP § 904.01 (if a single
`
`specimen supports multiple classes, the applicant should indicate which classes are supported by
`
`the specimen). In support of the Examiner’s position, the Examiner cites the inconsequential fact
`
`that the Applicant submitted the same specimen, for the same mark, in a co-pending application
`
`for Class 3 goods.
`
`The Federal Circuit has previously held that a specimen can support classification
`
`for both Class 3 and Class 5. Jean Patou, Inc. v. Theon, Inc., 9 F.3d 971, 975 (Fed. Cir. 1993).
`
`

`Therein, the Federal Circuit stated, “by reason of [the specimen’s] various properties and uses can
`
`reasonably be categorized as either a cosmetic or a pharmaceutical and thus be entitled to
`
`registration in more than one classification.” Id., at 974 (Fed. Cir. 1993) (emphasis added). The
`
`specimen used in Jean Patou was a face gel, similar to the specimen the Applicant has submitted.
`
`Moreover, the Federal Circuit found no issue that the specimen in Jean Patou toed “the borderline
`
`between ‘cosmetics’ and ‘pharmaceuticals’,” and in line with the Federal Circuit, the Board should
`
`similarly see no issue with the same specimen supporting both a registration for Class 3 and Class
`
`5.
`
`It is clear that the same specimens may be used in multiple classes. In Re Int'l Salt
`
`Co., 166 U.S.P.Q., 215 (T.T.A.B. June 11, 1970) (“[i]t is settled, moreover, that the owner of a
`
`trademark has a right to register the trademark for a particular product in a plurality of classes
`
`covering the different purposes or uses of the article that happen to fall within two or more
`
`classification classes instead of the usual single class”). There is no bright line rule regarding the
`
`requirement for additional specimens or additional information to prove that a particular good
`
`belongs in one class versus another. Id. (“[i]n those instances where the specimens are of a
`
`general utility, and there is nothing on their surface or in the record to suggest that they cannot
`
`possibly be used in connection with a product when employed for the purpose enumerated, the
`
`examiner is obligated to accept the statement under oath in the application that the specimens are
`
`so being used”).
`
`Therefore, at least for the foregoing reasons, the Applicant requests that the Board
`
`overrule the Examiners refusal and allow the mark to register for the applied for goods.

`Specimen Submitted is Acceptable for Class 5.
`
`The Examiner has refused acceptance of the Applicant's specimen as showing use
`
`of the mark in commerce. The Examiner alleges that the specimen does not show use in commerce
`
`in connection with any other goods and/or services specified in International Class 5 in the
`
`Statement of Use. Applicant submits that the specimen does in fact show use of the mark in
`
`interstate commerce in connection with the applied-for goods and should be accepted.
`
`The Examiner asserts, without evidence, that the specimen is not “medicdated” and
`
`therefore has no connection to Class 5 goods. This Board has already held that “the examiner is
`
`obligated to accept the statement under oath in the application that the specimens are so being
`
`used.” In Re Int'l Salt Co., 166 U.S.P.Q., 215 (T.T.A.B. June 11, 1970) (reversing an examiner’s
`
`decision to refuse to register a mark in connection with a salt used for chemical purposes because
`
`the same salt was previously registered for food purposes).
`
`The International Trademark Classification System places goods in Class 5 that are
`
`listed as “medical preparations.” In reviewing Merriam-Webster dictionary, we find that
`
`“medicate” is defined as “to treat (someone or something) with or as if with medicine. See Exhibit
`
`2. As stated in the application, Applicant’s goods are: cosmetic products, namely, medicated skin
`
`care preparations, namely, skin creams, facial creams, night creams, anti-aging creams, anti-
`
`wrinkle creams; medicated skin moisturizers, medicated skin emollients; medicated face and body
`
`lotions for distribution through independent sales representatives. Applicant’s goods treat the signs
`
`of aging and contain anti-wrinkle preparations and are used to moisturize skin and therefore meet
`
`the definition of what a medicated product is.

`Therefore, at least for the foregoing reasons, the Applicant requests that the Board
`
`overrule the Examiners refusal and allow the mark to register for the applied for goods.

`c.
`
`Office Examination Should Be Consistent
`
`In the instant case, the Examiner is effectively attempting to promulgate new law
`
`not required by the TMEP. Here, it is clear that the Applicant has shown that the goods are in use
`
`in interstate commerce and that they support use in Class 5 as the goods treat conditions “with or
`
`as with medicine.” There is no requirement that the specimen state that the good is “medicated”
`
`and no requirement for the Examiner to require such specimen. As such, the specimen should be
`
`accepted and the Statement of Use should be accepted.
`
`There should be consistency within the Office. Applicant is also the owner of the
`
`following registrations for which the same specimens were used to support both Class 3 and Class
`
`5 goods, shown below in Table 1.2 Moreover, the Office has registered multiple other marks that
`
`used identical specimens as support for disparate classes. Such examples are shown below in Table
`
`2.3
