`attorney has considered applicant’s arguments, but is not persuaded. (cid:160) While a final action previously
`issued on October 16, 2012, this subsequent final refusal is now being issued because the evidence
`enclosed herewith includes internet evidence, which was not previously included.(cid:160) Accordingly, for the
`reasons set forth below, the FINAL refusal under Trademark Act Section 2(d) is maintained and continued

`Registration of the applied-for mark is FINALLY refused because of a likelihood of confusion with the
`marks in U.S. Registration Nos. 0947075 and 3444758.(cid:160) Trademark Act Section 2(d), 15 U.S.C. §1052(d);

`Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark
`that it is likely that a potential consumer would be confused or mistaken or deceived as to the source of the
`goods and/or services of the applicant and registrant.(cid:160) See 15 U.S.C. §1052(d).(cid:160) The court in In re E. I. du
`Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to be
`considered when determining whether there is a likelihood of confusion under Section 2(d).(cid:160) See TMEP
`§1207.01.(cid:160) However, not all of the factors are necessarily relevant or of equal weight, and any one factor

`determine whether they are similar or commercially related or travel in the same trade channels.(cid:160) See

`attractants; insect hormones and analogs; and air deodorizing composition in connection with the mark

`imilarity of the Marks
`Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial
`impression.(cid:160) In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012) (quoting In
`re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973)); TMEP
`§1207.01(b)-(b)(v).(cid:160) Similarity in any one of these elements may be sufficient to find the marks

`pplicant contends that the addition of(cid:160) “CON” in the registered marks “…gives Registrant’s marks an
`entirely distinct appearance from Applicant’s mark” and “…insofar as ZOE is a girl’s name, it
`contributes to a unique commercial impression that is completely absent from that of the Registrant’s
`Mark.” (cid:160) (Applicant’s September 6, 2012 Response, page 3). (cid:160) But marks may be confusingly similar in
`appearance where there are similar terms or phrases or similar parts of terms or phrases appearing in both
`applicant’s and registrant’s mark.

`oreover, ZOE is a dominant feature of the registered marks, as it is the first term in the marks.(cid:160)
`Consumers are generally more inclined to focus on the first word, prefix or syllable in any trademark or
`service mark.(cid:160) See Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F. 3d
`1369, 1372, 73 USPQ2d 1689, 1692 (Fed. Cir. 2005); see also Mattel Inc. v. Funline Merch. Co., 81
`USPQ2d 1372, 1374-75 (TTAB 2006); Presto Prods., Inc. v. Nice-Pak Prods., Inc., 9 USPQ2d 1895,
`1897 (TTAB 1988) (“it is often the first part of a mark which is most likely to be impressed upon the
`mind of a purchaser and remembered” when making purchasing decisions).

`urther, as there is no such term ZOECON, consumers would focus on the recognizable name ZOE in the
`registered marks and see it as a female name.(cid:160) As this term is the only term in the applicant’s proposed
`mark, consumers would focus on this term and believe that the overlapping goods emanate from a single
`
`source.(cid:160)(cid:160)
`
`The mere deletion of wording from a registered mark may not be sufficient to overcome a likelihood of
`confusion.(cid:160) See In re Mighty Leaf Tea, 601 F.3d 1342, 94 USPQ2d 1257 (Fed. Cir. 2010); In re Optica
`Int’l , 196 USPQ 775, 778 (TTAB 1977); TMEP §1207.01(b)(ii)-(iii).(cid:160) Applicant’s mark does not create a
`distinct commercial impression because it contains the same common wording as registrant’s mark, and
`there is no other wording to distinguish it from registrant’s mark.

`hen comparing marks, the test is not whether the marks can be distinguished in a side-by-side
`comparison, but rather whether the marks are sufficiently similar in their entireties that confusion as to the
`source of the goods offered under applicant’s and registrant’s marks is likely to result.

`hird-Party ZOE Formative Registrations
`Applicant argues “[ i]t must be recognized that severable [sic] notable Principal Registrations, all owned
`by different third-party registrants, support Applicant’s position that ‘ZOE’ and ‘ZOECON’ are not
`confusingly similar and are capable of coexisting on the Principal Register.” (cid:160) (Applicant’s January 8,
`2013 response, page 3).(cid:160) As a preliminary matter, it must be noted that applicant did not attach to its
`response any of the registrations which it discusses in its response.(cid:160) However, the mere submission of a
`list of registrations does not make such registrations part of the record.(cid:160) In re Promo Ink, 78 USPQ2d
`1301, 1304 (TTAB 2006); TBMP §1208.02; TMEP §710.03.

`o make third party registrations part of the record, an applicant must submit copies of the registrations, or

`Prior decisions and actions of other trademark examining attorneys in registering different marks for
`different goods and services have little evidentiary value and are not binding upon the Office.(cid:160) TMEP
`§1207.01(d)(vi).(cid:160) Each case is decided on its own facts, and each mark stands on its own merits.(cid:160) See AMF
`Inc. v. Am. Leisure Prods., Inc., 474 F.2d 1403, 1406, 177 USPQ 268, 269 (C.C.P.A. 1973); In re Int’l
`Taste, Inc., 53 USPQ2d 1604, 1606 (TTAB 2000); In re Sunmarks, Inc., 32 USPQ2d 1470, 1472 (TTAB

`elatedness of the Goods
`Applicant states in its response that “…the goods are quite distinguishable.”(cid:160) (Applicant’s Response, page
`5).(cid:160) But the fact that the goods of the parties differ is not controlling in determining likelihood of
`confusion.(cid:160) The issue is not likelihood of confusion between particular goods, but likelihood of confusion
`as to the source or sponsorship of those goods.(cid:160) In re Majestic Distilling Co., 315 F.3d 1311, 1316, 65
`USPQ2d 1201, 1205 (Fed. Cir. 2003); In re Shell Oil Co., 992 F.2d 1204, 1208, 26 USPQ2d 1687, 1689
`(Fed. Cir. 1993); TMEP §1207.01.

`ndeed, the goods of the parties need not be identical or directly competitive to find a likelihood of
`confusion.(cid:160) See Safety-Kleen Corp. v. Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480 (
`C.C.P.A. 1975); TMEP §1207.01(a)(i).(cid:160) Rather, they need only be related in some manner, or the
`conditions surrounding their marketing are such that they would be encountered by the same purchasers
`under circumstances that would give rise to the mistaken belief that the goods come from a common
`source.(cid:160) In re Total Quality Group, Inc., 51 USPQ2d 1474, 1476 (TTAB 1999); TMEP §1207.01(a)(i);
`see, e.g., On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086-87, 56 USPQ2d 1471, 1475-76

`pplicant also argues that “[t]he goods offered under Applicant’s ZOE mark are to be used solely in the
`manufacture of other products, namely paints and other microbial coatings” and “Registrant’s goods, on
`the other hand, are pesticides and insecticides used to exterminate living insects and pests.” (cid:160) (Applicant’s
`January 8, 2013 Response, page 6).(cid:160) But the goods of registrant specifically include “pesticides
`for…commercial, industrial…use” and its insecticides, insect attractants, insect hormones and analogs are
`not indicated for any specific purpose, use, consumer or channel of trade.(cid:160) The goods of the registrant
`
`therefore include those that may be used in the manufacture of other products.(cid:160)(cid:160)
`
`Further, as shown by the dictionary definition for BIOCIDE attached to the March 7, 2012 Office action, a
`BIOCIDE is “a chemical agent, such as a pesticide, that is capable of destroying living organisms.” (cid:160) See
`
`the dictionary definition of BIOCIDE from Yahoo!® Education.(cid:160)(cid:160)
`
`It is also noted that on the specimen submitted with the application, under the heading STORAGE AND
`DISPOSAL:, the label includes subheadings of PESTICIDE STORAGE and PESTICIDE DISPOSAL.(cid:160)
`Accordingly, applicant itself considers its biocides to be pesticides.
`
`(cid:160)T
`
`he trademark examining attorney has attached evidence from the USPTO’s X-Search database
`consisting of a number of third-party marks registered for use in connection with the same or similar
`goods and/or services as those of both applicant and registrant in this case.(cid:160) This evidence shows that the
`goods and/or services listed therein, namely, biocides, pesticides, and insecticides are of a kind that may
`
`
`
`emanate from a single source under a single mark.(cid:160) See In re Anderson, 101 USPQ2d 1912, 1919 (TTAB
`2012); In re Albert Trostel & Sons Co., 29 USPQ2d 1783, 1785-86 (TTAB 1993); In re Mucky Duck
`Mustard Co., 6 USPQ2d 1467, 1470 n.6 (TTAB 1988); TMEP §1207.01(d)(iii).

`n addition, the attached Internet evidence consists of websites from various chemical manufacturing
`companies.(cid:160) This evidence establishes that the same entity commonly manufactures the relevant goods and
`markets the goods under the same mark and the relevant goods are sold or provided through the same
`trade channels and used by the same classes of consumers in the same fields of use.(cid:160) Therefore,
`applicant’s and registrant’s goods are considered related for likelihood of confusion purposes.

`he overriding concern is not only to prevent buyer confusion as to the source of the goods, but to protect
`the registrant from adverse commercial impact due to use of a similar mark by a newcomer.(cid:160) See In re
`Shell Oil Co., 992 F.2d 1204, 1208, 26 USPQ2d 1687, 1690 (Fed. Cir. 1993).(cid:160) Therefore, any doubt
`regarding a likelihood of confusion determination is resolved in favor of the registrant.(cid:160) TMEP
`§1207.01(d)(i); see Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1265, 62 USPQ2d 1001,

`TEAS Plus Status Lost – Additional Fee Required (cid:160)
`Applicant filed a TEAS Plus application based on use in commerce under Trademark Act Section 1(a);
`however, the specimen provided does not show the applied-for mark.(cid:160) See 15 U.S.C. §1051(a); 37 C.F.R.
`§2.34(a)(1)(iv).(cid:160) At the time of filing, a TEAS Plus application based on Section 1(a) must be filed with a
`specimen showing the applied-for mark in use in commerce in connection with the goods and/or services
`
`identified in the application.(cid:160) TMEP §§819.01(f)(i); see 37 C.F.R. §§2.22(a)(7), 2.34(a)(1)(iv).(cid:160)(cid:160)
